{"id":286373,"date":"2026-02-16T06:54:10","date_gmt":"2026-02-16T06:54:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/286373\/"},"modified":"2026-02-16T06:54:10","modified_gmt":"2026-02-16T06:54:10","slug":"can-artificial-intelligence-legally-be-an-inventor","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/286373\/","title":{"rendered":"Can artificial intelligence legally be an inventor?"},"content":{"rendered":"<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2026\/01\/4K3TG61_AI_fact_check_jpg.jpeg\" width=\"1050\" height=\"656\" alt=\"Stylised illustration of AI brain and documents\"\/><\/p>\n<p class=\"photo-captioned__information\">\nStephen Thaler is seeking a patent for a new type of food container.<br \/>\nPhoto: RNZ\n<\/p>\n<p>An American computer scientist wants New Zealand&#8217;s courts to decide whether <a href=\"https:\/\/www.rnz.co.nz\/news\/on-the-inside\/586712\/ai-researchers-are-sounding-the-alarm-on-their-way-out-the-door\" rel=\"nofollow noopener\" target=\"_blank\">AI can legally be an inventor<\/a> in a global test case next week.<\/p>\n<p>Stephen Thaler is seeking a patent for a new type of food container.<\/p>\n<p>The sticking point is he named his <a href=\"https:\/\/www.rnz.co.nz\/news\/world\/586024\/digital-ghosts-are-ai-replicas-of-the-dead-an-innovative-medical-tool-or-an-ethical-nightmare\" rel=\"nofollow noopener\" target=\"_blank\">artificial intelligence system<\/a>, called DABUS, as the inventor.<\/p>\n<p>The Patent Office turned his application down in 2022, and the High Court agreed, with both saying an &#8220;inventor&#8221; had to be human.<\/p>\n<p>Thaler was set to challenge that in the Court of Appeal on February 24.<\/p>\n<p>His lawyer Clive Elliott KC said when Thaler filled out his application for a patent, he was simply stating the truth.<\/p>\n<p>&#8220;He didn&#8217;t actually invent this food container, it was his machine,&#8221; he said.<\/p>\n<p>&#8220;He invented what he calls an autonomous invention machine, in other words, an AI system which is itself able to invent.&#8221;<\/p>\n<p>But in its 2023 decision, the High Court said the law in New Zealand did not allow for DABUS to get the credit.<\/p>\n<p>&#8220;If the legislators had intended to allow granting of patents in New Zealand for inventions devised solely by non-humans such as artificial intelligences, or life forms other than human beings they would have drafted the Act to accommodate these possibilities specifically and explicitly,&#8221; it said.<\/p>\n<p>But Elliot said New Zealand&#8217;s Patents Act was only passed in 2013 so parliament knew about artificial intelligence when they created it &#8211; and did not exclude it.<\/p>\n<p><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2025\/11\/4N87UJ1_copyright_image_203389\" width=\"576\" height=\"383\" alt=\"Auckland University professor Alex Sims says NZ faces the risk of being left behind.\"\/><\/p>\n<p class=\"photo-captioned__information\">\nAuckland University professor Alex Sims says NZ faces the risk of being left behind.<br \/>\nPhoto: Supplied\n<\/p>\n<p>Auckland University law professor and intellectual property expert Alex Sims said beyond the technicalities of the case, there was a bigger picture about whether AI could truly be an inventor.<\/p>\n<p>&#8220;What AI does is it&#8217;s hoovering up human creativity and then it&#8217;s using that to produce something. So some people would actually argue that it&#8217;s not being creative because it&#8217;s all premised on what has gone before,&#8221; she said.<\/p>\n<p>Thaler was part of a group taking cases about AI and patents around the world to try to set a precedent.<\/p>\n<p>Auckland University lecturer Joshua Yuvaraj followed his &#8211; unsuccessful &#8211; attempt in Australia.<\/p>\n<p>People had been at the heart of intellectual property law as it developed over centuries, because there was no mechanism for creation other than the human mind, he said.<\/p>\n<p>&#8220;That is why AI is challenging that notion because AI, it appears, can do a lot of what the human mind can do is the argument.
