{"id":286701,"date":"2026-02-16T12:01:12","date_gmt":"2026-02-16T12:01:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/286701\/"},"modified":"2026-02-16T12:01:12","modified_gmt":"2026-02-16T12:01:12","slug":"sunlive-coroner-rules-teen-drivers-death-was-preventable","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/286701\/","title":{"rendered":"SunLive &#8211; Coroner rules teen driver&#8217;s death was preventable"},"content":{"rendered":"<p>&#13;<\/p>\n<p>It was March 10, 2023, when the 17-year-old and three friends were illegally hunting with dogs in the Kaingaroa Forest, near Murupara in the Bay of Plenty.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The group was understood to have been smoking cannabis, though the quantity and timing of that remained unclear.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>But soon after 10pm, Butler was driving a Mitsubishi, and was on his learner\u2019s licence.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>He encountered a security patrol on High Level Rd, near the intersection with Waimihia Rd.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The Mitsubishi slowed briefly, and security staff identified themselves, before Butler took off at speed.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The security patrol activated its lights and pursued for a short distance before abandoning the chase.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>But Butler continued driving the car at high speed for several kilometres.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>About 10 minutes later, the Mitsubishi was travelling north on Kiorenui Rd, on a straight section of road that alternates between sealed and unsealed surfaces.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Another vehicle was travelling in the opposite direction at low speed, when the Mitsubishi entered an unsealed portion of the road at an estimated speed of 90\u2013100km\/h.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The two vehicles collided near the centre of the roadway, and the Mitsubishi rotated clockwise, left the roadway, rolled, and struck a large tree.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>When the police and ambulance services arrived at the scene, Butler was located in the driver\u2019s seat, and it was apparent that he had died on impact.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>His death was formally verified at the scene by an attending paramedic.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Other surviving parties were taken to hospital with \u201cvarying degrees of injury\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>On March 12, 2023, a post-mortem examination found that Butler died from serious head injuries.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The toxicology analysis report found that while there was no alcohol detected in Butler\u2019s blood, cannabis was.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nCoroner says death highlights \u2018yet again\u2019 the risk of young, inexperienced drivers&#13;<br \/>\n&#13;<\/p>\n<p>Now, Coroner Ian Telford\u00a0<a href=\"https:\/\/www.nzherald.co.nz\/topic\/coronerscourt\/\" rel=\"nofollow noopener\" target=\"_self\" title=\"https:\/\/www.nzherald.co.nz\/topic\/coronerscourt\/\">has released his findings<\/a>\u00a0into Butler\u2019s death, noting the police investigation had concluded his limited driving experience and lack of formal assessment of his ability to operate a motor vehicle were considered contributing factors to the crash.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>There were no faults with either vehicle, and the road was in good condition, though he noted the change in road surface from sealed to unsealed.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Excessive speed was considered a factor, as although Butler had not been travelling excessively over the speed limit for the road, \u201cit was excessive under the circumstances given the type of road\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Police hypothesised that, after actively fleeing from forestry security immediately beforehand, Butler believed the oncoming vehicle was another security patrol.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cThis perception likely influenced him to continue driving at high speed. Driving at speed with reduced visibility in the enclosed forestry environment led to a misjudgement of the roadway ahead.\u201d<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Coroner Telford said the young man\u2019s death highlights \u201cyet again, the serious risks associated with young and inexperienced drivers operating motor vehicles on public roads without a licence\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cLearner drivers lack the training, experience and judgement that develops over time, particularly when confronted with unexpected or high-stress situations,\u201d Coroner Telford said.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cIt is for these reasons their driving must be supervised until they have been assessed as competent to drive alone. Obtaining a full licence is not a meagre technicality.\u201d<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>He said in Butler\u2019s case, this already unacceptable level of risk was further compounded by the decision to flee from security staff and continue driving at speed.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cIn these circumstances, judgment can rapidly deteriorate, leading to poor decision-making and an inability to accurately assess road conditions, other road users or safe speeds,\u201d Coroner Telford said.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nThe coroner said this case also drew attention to the dangers of driving after consuming drugs, noting that toxicology confirmed Butler had cannabis in his system.&#13;<br \/>\n&#13;<\/p>\n<p>\u201cThis substance is known to impair perception, reaction time and decision-making.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cEven if the precise level of impairment cannot be determined, the presence of cannabis is concerning when combined with inexperience, speed and a complex driving environment.\u201d<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Coroner Telford said he reiterated the importance of clear public messaging that public roads were not appropriate places for \u201cunlicensed or impaired driving under any circumstances\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cYoung people, in particular, must understand that combining inexperience, drugs, speed and poor visibility is a lethal mix,\u201d he said.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cJacob\u2019s death was preventable, and it underscores the need for continued education and vigilance around driver licensing requirements, drug-impaired driving and responsible decision-making.\u201d<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>He concluded his findings by offering his \u201csincere condolences to Jacob\u2019s family and friends\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Hannah\u00a0Bartlett\u00a0is a Tauranga-based Open Justice reporter at NZME.
