counsel<\/a>, Mark Jepson, told the judge he had multiple background factors to take into account, including his drug and alcohol use, along with several brain injuries he\u2019d suffered over the years.<\/p>\n

\n\u2018I don\u2019t have any ill-will towards him\u2019

<\/p>\n
The judge explained how on the night of the attack, the victim, who was one of his supports, was home when Newton popped in.<\/p>\n
\n
<\/p>\n
She was sitting on the couch, and the pair began arguing.<\/p>\n
\n
<\/p>\n
His shopping bag had two cans of baked beans inside, and he swung it \u201cviolently\u201d, striking her in the face several times.<\/p>\n
\n
<\/p>\n
He then unleashed his physical assault, and she was left with a fractured jaw and swelling to the left side of her face and wrists.<\/p>\n
\n
<\/p>\n
The judge said it was obvious the attack had a \u201csignificant emotional impact and physical impact\u201d on the victim, and a wider impact on the family.<\/p>\n
\n
<\/p>\n
Her victim impact statement outlined that despite the attack, she had no ill-will or hatred towards him, but was disturbed by it, and she now hoped to live the rest of her life with \u201cwhatever peace and happiness she can have\u201d.<\/p>\n
\n
<\/p>\n
She\u2019d also requested a protection order, which Judge Philip Crayton granted.<\/p>\n
\n
\n\u2018He lives on the brink of society\u2019
\n
<\/p>\n
Jepson said his client was regularly beaten as a child and urged the judge to acknowledge his upbringing as a causative factor in his offending.<\/p>\n
\n
<\/p>\n
Newton lived \u201con the brink of society\u201d, outside of social norms. He used drugs and alcohol and had violence in his upbringing.<\/p>\n
\n
<\/p>\n
\u201cIt\u2019s all a package deal,\u201d Jepson said.<\/p>\n
\n
<\/p>\n
But Judge Crayton wasn\u2019t convinced.<\/p>\n
\n
<\/p>\n
\u201cBut he was supported?\u201d the judge asked.<\/p>\n
\n
<\/p>\n
\u201cHe lives with his family,\u201d Jepson replied.<\/p>\n
\n
<\/p>\n
\u201cYeah, so this isn\u2019t someone who has been surviving outside of society without support,\u201d the judge said.<\/p>\n
\n
<\/p>\n
Jepson reiterated the \u201cmultiple\u201d head injuries his client had previously suffered, and that the Crown had reduced the charge down from the more serious wounding with intent to cause grievous bodily harm.<\/p>\n
\n
\n\u2018You deal with situations poorly\u2019
\n
<\/p>\n
In sending him to prison, Judge Crayton said Newton had relevant previous convictions, including injuring with intent to injure, and was assessed as being at a high level of reoffending and medium risk of harm to others.<\/p>\n
\n
<\/p>\n
A psychologist\u2019s report detailed the repeated victim-blaming and shifting of responsibility, along with head injuries and a diagnosis of a traumatic brain injury.<\/p>\n
\n
<\/p>\n
That affected his cognitive function due to his impulsiveness, emotional dysregulation, and lack of tolerance. No one could tell him what to do.<\/p>\n
\n
<\/p>\n
\u201cYou deal with situations poorly,\u201d the judge noted.<\/p>\n
\n
<\/p>\n
Judge Crayton jailed Newton for two years, three months, and three weeks.<\/p>\n
\n
