{"id":345514,"date":"2026-03-24T15:22:16","date_gmt":"2026-03-24T15:22:16","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/345514\/"},"modified":"2026-03-24T15:22:16","modified_gmt":"2026-03-24T15:22:16","slug":"sunlive-bop-rafting-death-coroner-releases-findings","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/345514\/","title":{"rendered":"SunLive &#8211; BOP rafting death: Coroner releases findings"},"content":{"rendered":"<p>&#13;<\/p>\n<p>Coroner Robb\u2019s findings said Pincott and her son Bryden Frizell, 25, had booked the rafting trip with River Rats the night before.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>On arrival at the Kaituna River, they received safety instructions, lifejackets and helmets, and signed a waiver before setting off with two experienced instructors for the Grade 5 rapid.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>They were headed for the Tutea Falls, advertised online as the highest commercially rafted waterfall in the world.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>About one million people have \u201cnavigated the fall without incident\u201d, the Coroner found.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The raft navigated several drops without incident, and the pair was \u201ckeen to continue\u201d when guides checked in.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Coroner Robb reviewed photos and video of the raft going over the final drop.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The raft became submerged and full of water before resurfacing with three on board.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Pincott surfaced behind the raft within 10-15 seconds. She was heard saying \u201chelp\u201d, and her head kept going under the whitewater.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Her lifejacket appeared loose and it was unclear if she was wearing her helmet.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>A guide swam her to a rock. She did not appear to have ingested or inhaled water.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The guides believed she may have suffered a complication of her heart condition, so administered the angina spray she had provided.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>She was taken to shore \u201cvery pale\u201d but was conscious when emergency services arrived.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>She complained of something \u201ctight around her neck\u201d and her lifejacket was cut off.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Pincott said; \u201cIt doesn\u2019t feel like my last heart attack 10 years ago\u201d, before losing consciousness. She could not be revived.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>A pathologist found her death was caused by chest injuries with \u201cfractured thoracic spine and torn inferior vena cava\u201d from \u201chigh-energy impact\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nFalls from rafts \u2018common\u2019&#13;<br \/>\n&#13;<\/p>\n<p>River Rats\u2019 long-time owner Justin Hutton provided evidence to the coroner.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>His report said he believed Pincott was washed from the raft when it hit the pool at the bottom of the waterfall.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Her injuries may be from \u201cpotentially being driven to the bottom of the river by the power of the water\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Customers falling from rafts was \u201cextremely common\u201d at Tutea Falls but this \u201cseldom\u201d resulted in injury, he said.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Robb found the river level and nature of the falls was the same as on \u201cthousands of other rafting tours\u201d and the raft was correctly guided to reduce the risk of flipping.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p><img alt=\"The Kaituna River near Okere Falls. Photo \/ Andrew Warner<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Maritime New Zealand found no other record of a death or significant injury at that location, but Hutton told the coroner a\u00a0<a href=\"https:\/\/www.nzherald.co.nz\/rotorua-daily-post\/news\/rafting-adventure-turns-to-tragedy\/M3IHWDREEKDW4RLHOA37IHJYRY\/\" rel=\"nofollow noopener\" target=\"_self\" title=\"https:\/\/www.nzherald.co.nz\/rotorua-daily-post\/news\/rafting-adventure-turns-to-tragedy\/M3IHWDREEKDW4RLHOA37IHJYRY\/\">rafter died at Tutea Falls in 2008<\/a>.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Hutton\u00a0<a href=\"https:\/\/www.nzherald.co.nz\/rotorua-daily-post\/news\/commerce-commission-weighs-proposal-to-merge-rotorua-rafting-operators\/OCYAMB3KPFDPNCTCKXM2V3XLUY\/\" rel=\"nofollow noopener\" target=\"_self\" title=\"https:\/\/www.nzherald.co.nz\/rotorua-daily-post\/news\/commerce-commission-weighs-proposal-to-merge-rotorua-rafting-operators\/OCYAMB3KPFDPNCTCKXM2V3XLUY\/\">sold the rafting side<\/a>\u00a0of the business in November 2025.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>He told the coroner he \u201cput a lot of thought\u201d into continuing rafting after Pincott\u2019s accident.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Losing his passion for higher-grade rafting trips was a factor in the decision to sell.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cI don\u2019t believe there was anything we could do different (other than not rafting) that would stop the incident happening again.\u201d<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>He could not think of any past instances when a customer decided not to go rafting after learning of the one commercial rafting death on the river. He believed they saw it as \u201ca statistically acceptable risk\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\n&#13;<br \/>\n&#13;<\/p>\n<p>The company reduced the risk with good practices and declared it by saying \u201canything could happen from a scratch to serious injury or drowning\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Robb found nothing in Pincott\u2019s medical history, the pathologist\u2019s report or other advice to indicate any health condition that made her injuries more likely.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>He considered it \u201cunlikely\u201d the loose lifejacket had \u201cany direct bearing on her death\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cWhat occurred to Vivienne was a wholly unexpected and tragic outcome.\u201d<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Robb considered she most likely was injured from being \u201cwashed from the raft\u201d, then \u201cforced either into rocks or onto the floor of the river\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<br \/>\nAgency apologises for delay&#13;<br \/>\n&#13;<\/p>\n<p>Robb said the greatest delay in the coronial process was Maritime New Zealand not providing its report to Rotorua police until May 2024.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Police then took almost a year to send the investigation file to the coroner. Coroner Robb took over the case in December.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>In a statement, a Maritime New Zealand spokesperson said the agency unreservedly apologised to the coroner and Pincott\u2019s family for the delay, resulting from an \u201cadministrative error\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The agency had improved its system for managing coronial requests and tracking cases since 2021 and it was \u201csure a delay of this nature will not happen again\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>In a statement, Rotorua area commander Inspector Herby Ngawhika said police accepted its part in the \u201cunnecessary delay\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>He said the \u201cunprecedented\u201d national Covid-19 level four lockdown ordered shortly after Pincott\u2019s death consumed most police resources and led to a backlog of coronial files.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Both organisations acknowledged the delay\u2019s impact on Pincott\u2019s family and friends and offered condolences.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>A WorkSafe New Zealand spokesperson said it did not take any action in relation to Pincott\u2019s death.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>River Rats\u2019 routine audits had shown its compliance with the safety audit standard for adventure activities.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Approached for comment on the report, Hutton said he wanted to express his condolences to Pincott\u2019s family and friends.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p><a href=\"https:\/\/www.nzherald.co.nz\/bay-of-plenty-times\/author\/megan-wilson\/\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/bay-of-plenty-times\/author\/megan-wilson\/\" target=\"_blank\">Megan Wilson<\/a>\u00a0is a health and general news reporter for the Bay of Plenty Times and the Rotorua Daily Post.
