{"id":37727,"date":"2025-09-23T01:52:09","date_gmt":"2025-09-23T01:52:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/37727\/"},"modified":"2025-09-23T01:52:09","modified_gmt":"2025-09-23T01:52:09","slug":"a-great-lakes-oil-pipeline-faces-3-controversies-with-no-speedy-resolutions","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/37727\/","title":{"rendered":"A Great Lakes oil pipeline faces 3 controversies with no speedy resolutions"},"content":{"rendered":"<p>For more than a decade, controversy over an oil pipeline that passes directly through a Native American reservation and then across a sensitive waterway that is also a key shipping lane has brewed in Wisconsin and Michigan.<\/p>\n<p>Since taking office in January 2025, the Trump administration has joined an already complex fray, with policy decisions and legal filings as well as administrative and judicial appointments that have shifted the strategies and potential outcomes of the situation. The changes affect not just pipeline operator Enbridge but also the environmental, Indigenous and political leaders working to shut down the pipeline, known as <a href=\"https:\/\/www.enbridge.com\/projects-and-infrastructure\/public-awareness\/line-5-michigan\/about-line-5\" rel=\"nofollow noopener\" target=\"_blank\">Line 5<\/a>. <\/p>\n<p>Part of the dispute is slated to come before the U.S. Supreme Court <a href=\"https:\/\/www.scotusblog.com\/case-files\/terms\/ot2025\/\" rel=\"nofollow noopener\" target=\"_blank\">in the coming months<\/a>, but that will not deliver the final resolution of the situation.<\/p>\n<p>I am a <a href=\"https:\/\/seas.umich.edu\/research\/faculty\/mike-shriberg\" rel=\"nofollow noopener\" target=\"_blank\">water policy and politics analyst<\/a> and a former gubernatorial appointee to <a href=\"https:\/\/www.michigan.gov\/psab\" rel=\"nofollow noopener\" target=\"_blank\">Michigan\u2019s Pipeline Safety Advisory Board<\/a>. I see these controversies raising critical questions about the environmental and economic future of the Great Lakes region and serving as a <a href=\"https:\/\/theconversation.com\/michigan-pipeline-standoff-could-affect-water-protection-and-indigenous-rights-across-the-us-208923\" rel=\"nofollow noopener\" target=\"_blank\">proxy for wider national battles<\/a> over water policy, Indigenous rights and the role of fossil fuels in the nation\u2019s future.<\/p>\n<p>Scrutiny of the pipeline<\/p>\n<p><a href=\"https:\/\/www.enbridge.com\/projects-and-infrastructure\/public-awareness\/line-5-michigan\/about-line-5\" rel=\"nofollow noopener\" target=\"_blank\">Built in 1953<\/a>, Enbridge\u2019s Line 5 oil pipeline carries petroleum products mostly from western Canada\u2019s tar sands to refineries in eastern Canada, using the Great Lakes as a shortcut. It <a href=\"https:\/\/www.enbridge.com\/projects-and-infrastructure\/public-awareness\/line-5-michigan\/about-line-5\" rel=\"nofollow noopener\" target=\"_blank\">traverses 645 miles (1,040 km) through Wisconsin and Michigan<\/a> and transports <a href=\"https:\/\/www.michigan.gov\/egle\/about\/featured\/line5\/overview\" rel=\"nofollow noopener\" target=\"_blank\">approximately 23 million gallons of oil and natural gas liquids<\/a> per day from Superior, Wisconsin, to Marysville, Michigan, and then across the Saint Clair River to Sarnia, Ontario.<\/p>\n<p>The pipeline has been the subject of intense scrutiny since soon after a <a href=\"https:\/\/www.fws.gov\/project\/enbridge-2010-kalamazoo-river-oil-spill-natural-resource-damage-assessment-and-restoration\" rel=\"nofollow noopener\" target=\"_blank\">2010 oil spill into the Kalamazoo River in Michigan<\/a> from another Enbridge pipeline <a href=\"https:\/\/www.greatlakesnow.org\/2022\/02\/new-report-enbridge-line-5-closure-michigan\/\" rel=\"nofollow noopener\" target=\"_blank\">with a similar start and endpoint<\/a>. The 2012 publication of <a href=\"https:\/\/www.nwf.org\/Educational-Resources\/Reports\/2012\/10-08-2012-Sunken-Hazard\" rel=\"nofollow noopener\" target=\"_blank\">Sunken Hazard<\/a>, a report from the National Wildlife Federation about the potential for a spill from Line 5, <a href=\"https:\/\/bridgemi.com\/michigan-environment-watch\/10-years-later-kalamazoo-river-spill-still-colors-enbridge-pipeline\/\" rel=\"nofollow noopener\" target=\"_blank\">fomented public concern and launched an advocacy movement<\/a> that began with questions about Line 5\u2019s safety and has led to calls for its complete shutdown.<\/p>\n<p>While the entire pipeline is being scrutinized, there are two primary areas of concern. In Wisconsin, the pipeline runs for 12 miles (19 km) across the reservation of the <a href=\"https:\/\/www.badriver-nsn.gov\/\" rel=\"nofollow noopener\" target=\"_blank\">Bad River Band of Lake Superior Chippewa<\/a>. And when it crosses from Michigan\u2019s Upper Peninsula to its Lower Peninsula, the line splits into two parallel pipes <a href=\"https:\/\/www.greatlakesnow.org\/beneath-surface-line-five\/\" rel=\"nofollow noopener\" target=\"_blank\">that run along the bottom of the Straits of Mackinac<\/a>, which connect Lake Michigan and Lake Huron.<\/p>\n<p>Shutting down Line 5 in Michigan<\/p>\n<p>In 2021, Michigan Gov. Gretchen Whitmer <a href=\"https:\/\/www.michigan.gov\/whitmer\/news\/press-releases\/2021\/10\/04\/gov--whitmer-on-efforts-to-protect-the-great-lakes-from-line-5-oil-spill-after-canada-invokes-treat\" rel=\"nofollow noopener\" target=\"_blank\">revoked Enbridge\u2019s easement<\/a> to operate the pipeline across the Straits of Mackinac. The governor asserted that Enbridge \u201crepeatedly violated the 1953 easement and that the continued operation of the dual pipelines violates the <a href=\"https:\/\/www.michigan.gov\/whitmer\/news\/press-releases\/2020\/11\/13\/governor-whitmer-takes-action-to-shut-down-the-line-5-dual-pipelines-through-the-straits-of-mackina\" rel=\"nofollow noopener\" target=\"_blank\">state\u2019s solemn duty to protect the Great Lakes<\/a>.\u201d <\/p>\n<p>Some of her concerns exist because the pipeline sits in the open water of the Great Lakes and has been <a href=\"https:\/\/news.umich.edu\/line-5-and-its-risks-the-consequences-of-failure-would-be-catastrophic\/\" rel=\"nofollow noopener\" target=\"_blank\">damaged multiple times by ship\u2019s anchors<\/a>, is subject <a href=\"https:\/\/www.mlive.com\/news\/2017\/09\/line_5_coating_inspection.html\" rel=\"nofollow noopener\" target=\"_blank\">to corrosion<\/a>, and has been found to be <a href=\"https:\/\/www.mlive.com\/news\/2017\/07\/line_5_bends_ovals.html\" rel=\"nofollow noopener\" target=\"_blank\">bent and deformed<\/a> by the <a href=\"https:\/\/www.glerl.noaa.gov\/res\/straits\/\" rel=\"nofollow noopener\" target=\"_blank\">extremely powerful currents in the Straits of Mackinac<\/a>.<\/p>\n<p><a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2021\/01\/12\/enbridge-not-comply-easement-revocation-continue-line-5-operation\/6630978002\/\" rel=\"nofollow noopener\" target=\"_blank\">Enbridge refused to comply<\/a> with the shutdown order and has taken the battle into the courts while continuing to send petroleum products through the pipeline across the straits. The Trump administration \u2013 <a href=\"https:\/\/www.justice.gov\/opa\/pr\/justice-department-files-statement-interest-enbridge-case\" rel=\"nofollow noopener\" target=\"_blank\">through a Sept. 19, 2025, court filing<\/a> \u2013 is supporting Enbridge\u2019s claim that the pipeline is <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2025\/09\/20\/trump-justice-department-enbridge-michigan-line-5-straits-mackinac-oil-gas-pipeline\/86240215007\/\" rel=\"nofollow noopener\" target=\"_blank\">not subject to state regulation and oversight<\/a>.<\/p>\n<p>There has been a long back-and-forth about <a href=\"https:\/\/www.michiganpublic.org\/environment-climate-change\/2025-06-30\/us-supreme-court-to-consider-line-5-lawsuit-jurisdiction-case\" rel=\"nofollow noopener\" target=\"_blank\">whether state courts have jurisdiction<\/a>, as state officials argued, or whether federal courts should handle it, as Enbridge claimed. In June 2025 the trial was set for a state court when the <a href=\"https:\/\/www.scotusblog.com\/cases\/case-files\/enbridge-energy-lp-v-nessel\/\" rel=\"nofollow noopener\" target=\"_blank\">U.S. Supreme Court unexpectedly stepped in<\/a> at Enbridge\u2019s request. The case has not yet been scheduled for oral arguments before the court, but they \u2013 and a potential ruling \u2013 are expected <a href=\"https:\/\/www.scotusblog.com\/case-files\/terms\/ot2025\/\" rel=\"nofollow noopener\" target=\"_blank\">sometime between October 2025 and June 2026<\/a>. <\/p>\n<p>The state court has said it will <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2025\/08\/18\/enbridge-line-5-oil-pipeline-supreme-court-michigan-straits-of-mackinac\/85714813007\/\" rel=\"nofollow noopener\" target=\"_blank\">continue its proceedings without waiting<\/a> for a Supreme Court decision. But the ground is set for the continuation of an extended and complicated legal battle.<\/p>\n<p>The Great Lakes tunnel<\/p>\n<p>While Enbridge is fighting the shutdown of its existing pipeline, the company is seeking state and federal permission to build a replacement, by digging a new <a href=\"https:\/\/www.lrd.usace.army.mil\/News\/News-Releases\/Display\/Article\/4172597\/corps-of-engineers-releases-line-5-tunnel-project-tentative-timeline\/\" rel=\"nofollow noopener\" target=\"_blank\">tunnel below the Straits of Mackinac<\/a>.<\/p>\n<p>The company needs <a href=\"https:\/\/www.greatlakesnow.org\/2025\/06\/a-guide-to-the-federal-review-of-the-line-5-tunnel\/\" rel=\"nofollow noopener\" target=\"_blank\">both federal and state permits<\/a> before construction can begin. The federal permits are expected to come quickly as a result of a Trump administration policy.<\/p>\n<p>On the first day of his second term, Trump declared a \u201c<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/declaring-a-national-energy-emergency\/\" rel=\"nofollow noopener\" target=\"_blank\">national energy emergency<\/a>.\u201d In general, <a href=\"https:\/\/theconversation.com\/the-us-energy-market-has-its-troubles-though-it-may-not-be-a-national-emergency-249336\" rel=\"nofollow noopener\" target=\"_blank\">the policy<\/a> is being used to <a href=\"https:\/\/corpgov.law.harvard.edu\/2025\/02\/19\/climate-and-energy-executive-orders-implications-for-corporate-sustainability\/\" rel=\"nofollow noopener\" target=\"_blank\">try to slow the transition away from fossil fuels<\/a> and toward clean energy sources, and <a href=\"https:\/\/www.mlive.com\/environment\/2025\/05\/climate-risks-dropped-from-line-5-tunnel-review-under-trump-orders.html\" rel=\"nofollow noopener\" target=\"_blank\">to remove climate change as a factor<\/a> in environmental reviews and permitting.<\/p>\n<p>For Line 5, the most consequential provisions of the order are those that call for <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/declaring-a-national-energy-emergency\/\" rel=\"nofollow noopener\" target=\"_blank\">\u201cemergency approvals<\/a>\u201d and \u201cexpediting the Delivery of Energy Infrastructure.\u201d The tunnel is on the Army Corps of Engineers\u2019 <a href=\"https:\/\/michiganadvance.com\/2025\/04\/02\/army-corps-of-engineers-branch-overseeing-line-5-tunnel-project-gains-emergency-processing-authority\/\" rel=\"nofollow noopener\" target=\"_blank\">list of projects eligible for fast-track approval<\/a>.<\/p>\n<p>However, Enbridge still needs <a href=\"https:\/\/www.michigan.gov\/egle\/about\/featured\/line5\/permits\" rel=\"nofollow noopener\" target=\"_blank\">state permits<\/a>, which many groups are opposing based on <a href=\"https:\/\/michiganadvance.com\/2025\/08\/21\/expert-says-more-geological-testing-must-be-completed-before-line-5-tunnel-should-receive-permits\/\" rel=\"nofollow noopener\" target=\"_blank\">potential environmental damage to the shoreline<\/a>, the <a href=\"https:\/\/michiganadvance.com\/2025\/08\/26\/with-comments-closing-on-line-5-permits-pipeline-opponents-urge-whitmer-to-oppose-tunnel-project\/\" rel=\"nofollow noopener\" target=\"_blank\">safety of the tunnel<\/a> and <a href=\"https:\/\/elpc.org\/news\/green-groups-urge-army-corps-to-add-climate-change-and-ghg-effects-on-line-5-tunnel-project-in-its-eis\/\" rel=\"nofollow noopener\" target=\"_blank\">the need to address climate change by slowing down oil extraction<\/a>.<\/p>\n<p>In addition, all of the <a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/2025\/03\/2025.03.21-cooperating-agency-withdrawal-letter-final.pdf\" rel=\"nofollow noopener\" target=\"_blank\">federally recognized tribal governments in Michigan<\/a> oppose Line 5\u2019s continued existence, contending that Indigenous fishing rights in the Straits of Mackinac are at risk from the pipeline both ecologically and culturally. Their position, expressed in a <a href=\"https:\/\/www.freep.com\/story\/news\/local\/michigan\/2025\/09\/20\/trump-justice-department-enbridge-michigan-line-5-straits-mackinac-oil-gas-pipeline\/86240215007\/\" rel=\"nofollow noopener\" target=\"_blank\">state-court challenge to the tunnel<\/a>, could end up testing the power of their rights under treaties with the U.S. government.<\/p>\n<p>Bad River Band\u2019s effort<\/p>\n<p>In addition to both of those disputes, a Native American tribe in Wisconsin undertook its own efforts to reduce the risk of environmental damage from the pipeline on its land and the surrounding watershed.<\/p>\n<p>In 2013, the Bad River Band <a href=\"https:\/\/www.badriver-nsn.gov\/wp-content\/uploads\/2024\/03\/Handout-about-Line-5-3-pages.pdf\" rel=\"nofollow noopener\" target=\"_blank\">declined to renew Enbridge\u2019s pipeline easement<\/a> through its territory, <a href=\"https:\/\/www.youtube.com\/watch?v=joO_7DkLMXk&amp;t=44s\" rel=\"nofollow noopener\" target=\"_blank\">which is sometimes referred to as the \u201cEverglades of the Great Lakes\u201d<\/a> because of its extensive and pristine wetlands. In 2017 the <a href=\"https:\/\/www.badriver-nsn.gov\/wp-content\/uploads\/2019\/11\/Pipeline_Resolution_Line5_Removal_2017.pdf\" rel=\"nofollow noopener\" target=\"_blank\">tribe voted to require Enbridge to remove the line from its land<\/a>.<\/p>\n<p><a href=\"https:\/\/apnews.com\/article\/enbridge-bad-river-reservation-line-5-pipeline-05ae3c4d30c91d99bad1288abb6da9ba\" rel=\"nofollow noopener\" target=\"_blank\">Enbridge refused to comply<\/a> and has contested the validity of the Bad River Band\u2019s decision, inherently challenging the tribe\u2019s sovereignty. At the same time, the company is attempting to reroute the pipeline around the reservation \u2013 though still within the Bad River watershed.<\/p>\n<p>In 2019 the <a href=\"https:\/\/pbswisconsin.org\/news-item\/federal-judge-gives-enbridge-3-years-to-close-line-5-on-bad-river-tribal-land\/\" rel=\"nofollow noopener\" target=\"_blank\">tribe sued Enbridge<\/a> to force the removal and ultimately won a federal judge\u2019s ruling that the company <a href=\"https:\/\/pbswisconsin.org\/news-item\/bad-river-band-and-other-groups-move-to-block-reroute-plans-for-enbridges-line-5\/\" rel=\"nofollow noopener\" target=\"_blank\">must remove the pipeline by June 2026<\/a> and pay US$5.15 million for ongoing trespassing. <a href=\"https:\/\/apnews.com\/article\/enbridge-bad-river-reservation-line-5-pipeline-05ae3c4d30c91d99bad1288abb6da9ba\" rel=\"nofollow noopener\" target=\"_blank\">Enbridge has appealed<\/a>, and many observers expect that case to also come to the Supreme Court.<\/p>\n<p>As that process unfolds, Enbridge is seeking expedited state and federal permits for the reroute. Environmental advocates, tribe members and others have asked a court to decide whether <a href=\"https:\/\/www.jsonline.com\/story\/news\/local\/wisconsin\/2025\/09\/04\/environmental-groups-raise-water-impact-concerns-in-key-line-5-case\/85937301007\/\" rel=\"nofollow noopener\" target=\"_blank\">state permits that were granted in late 2024<\/a> were given without following the proper procedure. Hearings on that question continue.<\/p>\n<p>Pipeline opponents are also asking the Army Corps of Engineers, which must issue its own permits, to <a href=\"https:\/\/www.jsonline.com\/story\/news\/local\/wisconsin\/2025\/09\/04\/environmental-groups-raise-water-impact-concerns-in-key-line-5-case\/85937301007\/\" rel=\"nofollow noopener\" target=\"_blank\">reject the application<\/a> for the new route, effectively cutting off the pipeline. However, this federal permit is also subject to Trump\u2019s \u201cnational energy emergency,\u201d and so it is unlikely to be stopped by federal agencies and is expected by the end of 2025.<\/p>\n<p>A convoluted puzzle<\/p>\n<p>On all three parallel fronts, the Trump administration\u2019s shaping of policy and the judiciary has put advocates on the defensive. <\/p>\n<p>The state of Michigan is concerned that its autonomy over its portion of the Great Lakes is at risk if the federal government and courts can overrule its revocation of Enbridge\u2019s easement to operate. <\/p>\n<p>Native American governments are concerned that their treaty-guaranteed fishing and land rights will be sacrificed in service of an energy company\u2019s interests. <\/p>\n<p>And, of course, Line 5 has major implications for Great Lakes protection and mitigating climate change, where the Trump administration has tilted the playing field in favor of fossil fuels and away from clean energy and environmental protection.<\/p>\n<p>Yet the outcomes are not at all clear, and Enbridge would likely have to win on all fronts to avoid the pipeline being shut down, since it cannot operate the pipeline if any segment is inoperable.
