{"id":400994,"date":"2026-04-28T04:33:09","date_gmt":"2026-04-28T04:33:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/400994\/"},"modified":"2026-04-28T04:33:09","modified_gmt":"2026-04-28T04:33:09","slug":"consent-free-granny-flat-rules-to-be-expanded","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/400994\/","title":{"rendered":"Consent-free granny flat rules to be expanded"},"content":{"rendered":"<p class=\"body-paragraph articleLinkText  [&amp;_p]:tit-sub-xl tit-sub-xl md:[&amp;_p]:d-tit-sub-xl md:d-tit-sub-xl mb-[1.3rem]\">The Government has announced it will be expanding its consent-free granny flat rules. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The <a href=\"https:\/\/www.1news.co.nz\/2026\/01\/15\/no-consent-granny-flats-from-today-but-its-not-a-free-for-all\/\" target=\"_blank\" rel=\"nofollow noopener\">new regulations for granny flats<\/a> came into force in January and allowed for units up to 70 square metres that met clear national standards to be built without consent.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Today, RMA and Housing Minister Chris Bishop, Building and Construction Minister Chris Penk and Associate Finance Minister Shane Jones announced an expansion to the scheme. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The first of the changes, expected to be made in Q3 of this year, would allow for consent-exempt granny flats to be built off-site before a\u00a0Project Information Memorandum (PIM) is issued, provided all conditions are met.\u00a0<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">\u201cThat means homes can be built in advance, giving buyers the ability to inspect them before purchase and reducing overall construction time,&#8221; Penk said. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">A PIM would still be required before any on-site work begins, so the home can be checked to ensure it is suitable for the land on which it will be placed. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">\u201cHomeowners will continue to have flexibility in how they build.\u00a0People can still choose to build entirely on-site using the\u00a0exemption or\u00a0go through the standard building consent process if that better suits their project,&#8221; Penk said. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Meanwhile, the exemption would be expanded to include Structural Insulated Panels (SIPs) with a CodeMark certificate as a building material. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">SIPs are pre-fabricated building panels that consist of rigid foam between two structural boards. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Penk said that including the material recognised a &#8220;wider range of proven building materials while\u00a0maintaining\u00a0confidence they meet Building Code requirements&#8221;.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The Government also said it would include &#8220;minor technical improvements&#8221; to ensure the rules were practical.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The changes were expected to be made by Order in Council\u00a0in Q3 of 2026. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Bishop said the expansion was &#8220;building on&#8221; <a href=\"https:\/\/www.1news.co.nz\/2026\/01\/20\/granny-flats-what-new-rules-mean-for-costs-consents-and-rates\/\" rel=\"nofollow noopener\" target=\"_blank\">January&#8217;s changes<\/a> to &#8220;give homeowners even more choice, while maintaining strong safety and quality standards&#8221;. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Jones said that for those who needed housing immediately, <a href=\"https:\/\/www.1news.co.nz\/2026\/02\/27\/new-granny-flat-rules-whos-to-blame-when-theres-a-problem\/\" target=\"_blank\" rel=\"nofollow noopener\">a granny flat <\/a>was a &#8220;commonsense decision&#8221;. <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">\u201cThese changes allow homeowners to have a range of options available to them and I look forward to seeing a boost in productivity in the construction sector this will bring.\u201d<\/p>\n<p>The new regime <\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Under the new rules that came into force at the start of the year, granny flats must have a simple design and meet the Building Code.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Work must also be carried out or supervised by licensed building professionals.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">There were also other conditions to a consent exemption.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Bishop said in mid-January: &#8220;If you read the details carefully, there&#8217;s a variety of rules in there. Site-to-boundary coverage around the area that you can use of the site, for example.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">&#8220;It&#8217;s not a complete free-for-all. You can&#8217;t just go and build something out the back. You&#8217;ve got to follow the Building Code. You&#8217;ve got to follow the standards set out.&#8221;<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">The same restrictions that apply to ordinary dwellings will apply to granny flats, meaning they cannot be built in flood zones where houses currently cannot be built.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">Penk said another requirement was that councils must be informed when a granny flat will be built.<\/p>\n<p class=\"body-paragraph articleLinkText  lg mb-4\">&#8220;It&#8217;s not an opportunity for them to say no, so it&#8217;s not a consent per se, but it&#8217;s an awareness on the part of the council of what is being built,&#8221; he said.<\/p>\n","protected":false},"excerpt":{"rendered":"The Government has announced it will be expanding its consent-free granny flat rules.
