{"id":434044,"date":"2026-05-18T22:28:12","date_gmt":"2026-05-18T22:28:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/434044\/"},"modified":"2026-05-18T22:28:12","modified_gmt":"2026-05-18T22:28:12","slug":"ey-pays-100m-bill-to-settle-court-battle-over-nmc-health","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/434044\/","title":{"rendered":"EY pays \u00a3100m bill to settle court battle over NMC Health"},"content":{"rendered":"<p id=\"07a31b14-4b45-4cdd-81be-5a46f633cf1d\">EY is believed to have paid more than \u00a3100 million to settle the High Court claim brought by the administrators of NMC Health, a former FTSE 100 company that collapsed amid an alleged fraud scandal.<\/p>\n<p id=\"db395f55-4f80-49f0-8614-ce480d83b7fc\">The big four audit firm and the healthcare provider reached a confidential settlement in February after a long-running legal battle. A new report by Alvarez &amp; Marsal, the administrators, shows that NMC has received \u00a3105.5 million in relation to the resolution of litigation.<\/p>\n<p id=\"f489d9b9-6081-421f-aca7-65e58d6c61cc\">The administrators filed a claim against EY four years ago for breach of contract and duty of care, and negligence relating to EY\u2019s audit work for NMC between 2012 and 2018. They were seeking \u00a32 billion. The claim has been resolved without admission of liability. The settlement agreement and its terms otherwise remain confidential.\u201d<\/p>\n<p id=\"43e66d14-9436-4832-80fe-e3c0bc4bd3b5\">EY, <a href=\"https:\/\/www.thetimes.com\/business\/companies-markets\/article\/ey-and-nmc-administrators-reach-deal-on-2bn-high-court-claim-st05q22ds\" rel=\"nofollow noopener\" target=\"_blank\">which confirmed in February<\/a> that it was no longer in dispute with NMC\u2019s administrators, was approached for comment.\u00a0The firm has previously said that it \u201cdenies the claim in its entirety\u201d and EY was \u201citself a \u2026 victim\u201d.<\/p>\n<p id=\"fdf7aaf9-e1a2-49bd-b5cb-2e558e35ba09\">Following the resolution of the claim, the administrators have repaid litigation funding of almost \u00a348 million, along with an agreed litigation funding return of \u00a322.2 million, the report states.<\/p>\n<p id=\"e5c96ac8-48d1-46c1-a290-12497ec3e7f2\">In late March, the administrators also reached a confidential settlement with an unnamed former director, and expects to receive \u00a3800,000.<\/p>\n<p id=\"af49f06e-356e-4759-b083-304adb1e1d0b\">This agreement is separate from <a href=\"https:\/\/www.thetimes.com\/business\/companies-markets\/article\/54bn-fraud-founder-nmc-health-vw7r30cq5\" rel=\"nofollow noopener\" target=\"_blank\">a $5.4 billion fraud trial<\/a> against Bavaguthu Raghuram Shetty, the founder of NMC, Prasanth Manghat, a former chief executive, and Bank of Baroda.<\/p>\n<p id=\"45fca11e-9920-4c6f-afcb-ccf60b0c6bee\">A trial started in Abu Dhabi in March alleging that Shetty and Manghat committed fraud against the company, and Baroda knowingly facilitated it. The trial is due to finish in July.<\/p>\n<p id=\"b1776b6e-d037-472d-8cc9-280e1f36c671\">Alvarez &amp; Marsal was appointed in 2020 after NMC, an international private healthcare company, was plunged into crisis following a report by Muddy Waters Research, a US short-seller, that raised accounting and governance issues.<\/p>\n<p id=\"36eb4d4f-39a1-4f6b-b054-2adf1f9f106b\">An investigation by Freeh Group, a risk-management firm commissioned by NMC, led to the discovery of a $6.6 billion debt. NMC was based in the United Arab Emirates and operated in 19 countries including the UK, where it owned Aspen Healthcare.\u00a0<\/p>\n<p id=\"218ab86a-d8d8-4d29-9aa4-d77bbeff790b\">At its peak in 2018, NMC was valued at \u00a38.6 billion on the London Stock Exchange. The crisis wiped out investors and has led to claims totalling \u00a33.4 billion from creditors. Operating companies of NMC exited administration in the UAE in 2022.<\/p>\n<p id=\"40b8bc9c-9e51-4e7a-99c1-8942b00c6b43\">The administrator\u2019s report said that it expects unsecured creditors to receive a dividend, but the size and timing will depend on the outcome of litigation. The fees estimate of Alvarez &amp; Marsal has increased to \u00a369.2 million.<\/p>\n<p id=\"55c428da-c427-4c1a-aec4-914fdf6d51df\">Shetty has rejected the administrator\u2019s claim, and said he \u201cdid not act dishonestly or in bad faith\u201d and was \u201cnot enriched by transfers of monies into his accounts controlled by the fraudsters\u201d.<\/p>\n<p id=\"d1cbc892-f9b4-4233-ba27-e6a0fb15a938\">A representative for Shetty has said he was \u201ca victim of a sophisticated fraud\u201d.
