{"id":459488,"date":"2026-06-03T21:47:10","date_gmt":"2026-06-03T21:47:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/459488\/"},"modified":"2026-06-03T21:47:10","modified_gmt":"2026-06-03T21:47:10","slug":"court-of-appeal-upholds-500k-award-in-auckland-leaky-home-case","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/459488\/","title":{"rendered":"Court of Appeal upholds $500k award in Auckland leaky home case"},"content":{"rendered":"<p class=\"rGEveXCr\" style=\"display:none\">The plaintiff, Angelina Vanifatova, purchased the Selwyn St property after making \u201cextensive inquiries\u201d about the state of the house.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The sale agreement required the vendor to provide \u201cany information held relating to the property relevant to the due diligence investigation\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">But a 2025 High Court decision by Justice Peter Andrew found the Wang family  <a href=\"https:\/\/www.nzherald.co.nz\/nz\/couple-trapped-in-negative-equity-after-being-tricked-into-buying-leaky-south-auckland-home\/65OA3SP2CZABZANOCT6TRH42RA\/\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/nz\/couple-trapped-in-negative-equity-after-being-tricked-into-buying-leaky-south-auckland-home\/65OA3SP2CZABZANOCT6TRH42RA\/\" target=\"_blank\">deliberately withheld a building report <\/a>warning of \u201celevated moisture levels\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">They also undertook \u201cconcealment works\u201d that covered signs of water damage, and misrepresented the state of the property to entice a sale.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">One of the defendants used a dehumidifier before an open home, telling the real estate agent he had  extracted only one litre of water in the previous 24 hours and the house was \u201crelatively dry\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">Justice Andrew described the Wangs\u2019 actions as \u201cdeliberate and dishonest\u201d, amounting to deceit, adding that it was highly likely their professional advisers were \u201calive\u201d to the <a href=\"https:\/\/www.nzherald.co.nz\/topic\/leaky-buildings\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/leaky-buildings\/\">compromised state of the property<\/a> during the sale, although he made \u201cno criticism of the role of the solicitors\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The Wangs appealed the High Court judgment and damages award to the Court of Appeal. A hearing took place in March this year, and a new judgment was handed down last month.<\/p>\n<p>\u2018Weathertightness failure\u2019, \u2018decay damage\u2019<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">Canvassing the facts of the case, the Court of Appeal decision said the property had been owned by Weiguo Wang (Wang Snr), who resided in China and did not speak English. He let the property out as a rental.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">Wang Snr\u2019s daughter Xiaoyue Wang, known as Crystal, and her husband He Wang, known as Wilson, acted as his agents in respect of his responsibilities as owner and landlord of the property, and as vendor for the purposes of its sale.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The decision says tenants raised earlier concerns about leaks, dampness and mould, with Wilson undertaking various repairs on the property over the years without necessary building consent.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">After making an offer on the house, Vanifatova made numerous inquiries about potential weathertightness issues before the contract went unconditional.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">This included seeking body corporate reports and asking the vendors to provide any relevant details about <a href=\"https:\/\/www.nzherald.co.nz\/nz\/couple-trapped-in-negative-equity-after-being-tricked-into-buying-leaky-south-auckland-home\/65OA3SP2CZABZANOCT6TRH42RA\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/nz\/couple-trapped-in-negative-equity-after-being-tricked-into-buying-leaky-south-auckland-home\/65OA3SP2CZABZANOCT6TRH42RA\/\">whether the building leaked<\/a>.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">She also commissioned a building inspection report, which did not identify any weathertightness issues.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">However, six months after she moved in, she discovered the house was leaking.<\/p>\n<p><img  alt=\"A judge found the previous owners of this Onehunga apartment had failed to disclose evidence of weathertightness problems before selling it in 2021. Photo \/ Jason Dorday<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">Expert reports later revealed extensive \u201cweathertightness failure\u201d and \u201cdecay damage\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The reports said the damage \u201cwould have been apparent\u201d to the previous owner and had been \u201cremediated on a superficial level only prior to the sale\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">Vanifatova launched legal proceedings in April the following year, and later reached a $75,000 settlement with the building inspection company over its \u201cflawed\u201d report.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">At trial, her lawyers claimed the defendants had made \u201cfraudulent misrepresentations\u201d, acting with deceit and in breach of contract.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The defendants denied the claims, saying the property had never leaked, except after a 2019 storm, and that they honestly believed it was sound and weathertight.<\/p>\n<p>Couple claimed they were \u2018not the vendor\u2019<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">Crystal and Wilson appealed the 2025 judgment, claiming \u201cerrors\u201d had materially affected the High Court\u2019s finding of deceit.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">They argued that Wang Snr\u2019s disclosure obligations to Vanifatova did not apply to them \u201cbecause they were not the vendor\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">\u201cIt was argued there was no evidence they had read, let alone understood, the terms of the contract or received any legal advice in relation to it. They were not proficient in English,\u201d the Court of Appeal decision says.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">They claimed their real estate agent had not explained the disclosure obligations and that they only provided what the agent requested.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">However, the Court of Appeal was unswayed, ruling the couple essentially \u201cstood in the shoes\u201d of Wang Snr during the sale.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">\u201cMr Wang Snr\u2019s own liability, which was based on contractual misrepresentation, rested on the incomplete nature of the disclosure which Mr and Ms Wang bore responsibility to provide.\u201d<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The Court of Appeal said it was satisfied \u201cthe appellants were aware of the due diligence obligation imposed by the contract, at least to the extent of knowing of the need to provide accurate information in response to Ms Vanifatova\u2019s due diligence inquiries and to furnish her with all relevant information\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The couple\u2019s second ground of appeal was that the trial judge wrongly adopted a \u201ccollective approach\u201d to the defendants\u2019 state of knowledge and liability, because they had both provided information to the real estate agent, \u201cand were husband and wife\u201d.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">But again the appellate court was unmoved, finding the High Court did consider the element of dishonesty or fraud individually against Crystal and Wilson.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">\u201cWe are satisfied the judge was entitled to conclude that Mr and Ms Wang acted in concert in respect of the recurring weathertightness issues over a very long period, during which successive attempts were made to locate the leak(s) and remedy the problem.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">\u201cIt is clear that the elongated sale process was impeded because of the existence of this issue \u2013 one which both Mr and Ms Wang must have been aware [of], given the chronic defect that had dogged the property over such a long time.\u201d<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The decision added that redecorating work carried out before the sale had the effect of \u201ccovering over\u201d signs that may have alerted prospective purchasers to water ingress problems.<\/p>\n<p class=\"rGEveXCr\" style=\"display:none\">The appeal was dismissed, and
