The submission made by Ng\u0101ti Kuku hap\u016b and Whareroa Marae trustees said the expansion proposal \u201ccannot be granted\u201d due to adverse impacts and inconsistency with the Ng\u0101i Te Rangi Settlement Deed<\/a>.<\/p>\n

Whareroa Marae is affiliated with Ng\u0101ti Kuku, a hap\u016b of Ng\u0101i Te Rangi iwi.<\/p>\n

\u201cThe intent underlying the settlement deed was to recognise the mana of Ng\u0101i Te Rangi, which includes Ng\u0101ti Kuku, and to ensure their rangatiratanga [sovereignty] was not ignored,\u201d the submission said.<\/p>\n

It said the development would negate Ng\u0101ti Kuku identity.<\/p>\n

\u201c[It would] continue the extinction of Ng\u0101ti Kuku\u2019s relationships, beliefs, and tikanga [customs] relating to their ancestral whenua, waters, w\u0101hi tapu [sacred places], and taonga [treasures].\u201d<\/p>\n

The submission also said the development would encroach on Ng\u0101ti Kuku and Whareroa Marae cultural and physical landscapes.<\/p>\n

It said the hap\u016b and marae would require direct compensation if the proposal was approved.<\/p>\n

The recommended amount was at least $19m per year \u2013 a 35-year present value of $335m to $475m.<\/p>\n

This included $10m to $11m per year in fair revenue sharing of incremental project revenues. A further $8.7m per year was for the adverse impacts on the hap\u016b\u2019s ability to discharge cultural obligations.<\/p>\n

The port had proposed a cultural mitigation package including $6.1m in total compensation.<\/p>\n

Other proposed measures to mitigate cultural and environmental effects included an advisory group, design changes, a monitoring plan and marae-focused funding.<\/p>\n

Ng\u0101ti Kuku\u2019s submission follows a court ruling ordering the port to pay iwi $298,023.<\/p>\n

The sum was compensation for costs incurred by iwi<\/a> in earlier submissions against the Stella Passage project before the port withdrew its initial 2021 Resource Management Act application.<\/p>\n

The port instead pursued fast-track approval at the end of 2024. <\/p>\n

Progress was halted when Ng\u0101ti Kuku Hap\u016b Trust sought a judicial review over the scope wording<\/a>.<\/p>\n

The port withdrew that application and reapplied in January this year.<\/p>\n

In a formal response to Ng\u0101ti Kuku Hap\u016b Trust and Whareroa Marae\u2019s submission, the port said the proposal did not remove or override Ng\u0101ti Kuku\u2019s rangatiratanga.<\/p>\n

The port also acknowledged the effects of the port development and associated industrial activity.<\/p>\n

\u201cHowever, the historical record demonstrates that pressures experienced by the Whareroa community cannot be attributed solely, or primarily, to [the port\u2019s] operations.\u201d<\/p>\n

The port\u2019s statement said expansion within Te Awanui (Tauranga Harbour) had occurred since the late 19th century. <\/p>\n

\u201cIn this context, port development has operated as part of a wider system of economic and urban growth rather than as an isolated or singular cause of cumulative effects.\u201d<\/p>\n

The scale of development at the southern end of the Mount Maunganui wharves<\/a> had been reduced to prevent further expansion towards the marae.<\/p>\n

Development next to the marae would be \u201crelatively minor structures only\u201d.<\/p>\n

The hap\u016b, marae and port had been unable to agree on a financial contribution figure.<\/p>\n

However, the port said financial compensation had been accepted by the hap\u016b and marae to address residual cultural effects.<\/p>\n

The port stated it had taken actions to address environmental concerns, and there were other industrial activities in Mount Maunganui not connected to the port.<\/p>\n

The panel\u2019s decision on the application was due by September 7<\/a>.<\/p>\n

Representatives for the Port of Tauranga, Ng\u0101ti Kuku and Whareroa Marae declined to comment for this story.<\/p>\n

What is the Stella Passage project?<\/p>\n

The project, if approved, will extend the Sulphur Point Container Terminal and Mount Maunganui bulk wharves by a combined 700 metres on reclaimed land, allowing more vessel berths.<\/p>\n

It would also involve dredging about 1.5 million cubic metres from the Stellar Passage bed to allow clearance for ships berthing at the extensions.<\/p>\n

The port has said it has reached capacity<\/a> at both the container terminal and Mount wharves.<\/p>\n

New Zealand\u2019s largest port, it handled 25 million tonnes of cargo and 1.2 million containers per year.<\/p>\n

The port shipped 48% of the country\u2019s container exports<\/a> \u2013 accounting for 70% of export dairy, 65% of red meat exports and 90% of kiwifruit exports.<\/p>\n

The port engaged the New Zealand Institute of Economic Research for an Economic Effects Assessment, which projected the development\u2019s annual economic benefit would be $792m to $1 billion nationwide.<\/p>\n

Tauranga\u2019s economy would receive $54m to $79m of that.<\/p>\n

Identified benefits also included improved ship frequency and scheduling, reduced ship waiting times and increased profitability.<\/p>\n

Shane Jones responds<\/p>\n

Regional Development Minister Shane Jones<\/a> said the Stella Passage would open opportunities for the North Island economy.<\/p>\n

He previously made comments on social media about Ng\u0101ti Kuku\u2019s submission, calling the matter a \u201cbattle of legal whackamole\u201d.<\/p>\n

He said there was a significant M\u0101ori investment in kiwifruit. <\/p>\n

\u201cNg\u0101ti Kuku themselves are beneficiaries of a burgeoning kiwifruit industry.\u201d<\/p>\n

Jones said there was already a mitigation package in place to address the hap\u016b\u2019s \u201creasonable concerns\u201d.<\/p>\n

The Bay of Plenty Times asked Jones if the mitigation amount was enough.<\/p>\n

\u201cIt\u2019s a debatable point as to how much is ever enough, but this is why the hap\u016b and other stakeholders need to accept there are always trade-offs.\u201d<\/p>\n

Jones said the project delay had cost the Bay of Plenty and shrunk the \u201csize of the economic pie\u201d.<\/p>\n
