The appeal was granted and his <a href=\"https:\/\/www.nzherald.co.nz\/topic\/public-interest-open-justice\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/public-interest-open-justice\/\">sentence quashed<\/a>. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">The court then directed that he be resentenced.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">That\u2019s what happened when he appeared in the High Court at Hamilton this week on the 23-year-old charges of wounding with intent to cause grievous bodily harm, injuring with intent to injure, and threatening to kill.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Justice Mathew Downs said although he had a large amount of information about Hoggart and his history, assessing the risk he now posed \u201ccontinues to be difficult\u201d.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">In 2003, Hoggart seriously beat his then girlfriend and his mother\u2019s partner, calling her a \u201cslapper\u201d and claiming that she had been sleeping with the man.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">She asked him why he thought that, and he became enraged, pushing her on to a bed before throwing her into a wall.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He then threw her on to a chair and choked her for up to 10 seconds before she managed to push him off her with her feet.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">She ran to the door calling for help, but he grabbed her and threw her on the bed, before grabbing her by the hair and slamming her into the bedroom wall four or five times.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Choking her again, Hoggart told her to confess, or she would die. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">\u201cUnsurprisingly, the victim believed she would,\u201d Justice Downs said.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">The victim then asked him to kill her a different way, but Hoggart said no, \u201cI want to do it this way\u201d, before reapplying his grip.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">She began to see black spots and then indicated that she had slept with the man.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Hoggart released her and asked her where.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He then got a pair of scissors, kicked his mother\u2019s partner in the ribs, and then punched him about the body and head before repeatedly stabbing him around his head and upper torso.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">The victim tried to block the blows before running outside, but Hoggart kept stabbing him, striking him in the back of the head twice.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Others at the house tried to restrain him, and he was arrested by police a short time afterwards.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He pleaded guilty to charges of wounding with intent to cause grievous bodily harm, injuring with intent to injure and threatening to kill.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Sentencing him on February 19, 2004, Justice Judith Potter said if she was going to issue a finite sentence, it would be seven-and-a-half years\u2019 jail. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">She instead imposed preventive detention and ordered him to serve a minimum non-parole period of five years in prison. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He was granted parole in 2014 and released on February 17 that year.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">However, five months later, a woman with whom he had been in a relationship contacted Corrections, concerned for her safety because of his \u201cobsessive\u201d behaviour, claiming infidelity and questioning who the father of the child she was carrying was.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He was recalled to prison. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Hoggart was released again on September 26, 2018, but four months later he tested positive for cannabis.<\/p>\n<p><img  alt=\"Mark Hoggart was resentenced in the High Court at mobile phone because she wouldn\u2019t delete some messages.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">A month later, he pushed her and followed her when she tried to leave, pulled her hair and dragged her down a bank. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">A member of the public saw what happened and flagged down police.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">A non-association order was put in place and in August 2020 he was sentenced to nine months\u2019 jail. He was also recalled to prison, where he has remained since.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">The Crown argued that preventive detention should be reimposed, as he remained dangerous to women he was in a relationship with, and there was a high risk of him committing a qualifying violent offence, which has a maximum prison sentence of seven years or more.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">However, Hoggart, through his lawyer Hunter De Groot, said he wasn\u2019t the person he once was and had learned his lesson.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He emphasised the offending occurred in 2003 when he was 19. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He submitted there was an inadequate basis to conclude that he posed a high risk of committing the specified offences, and urged that he be given a finite sentence, with the consequence being that he serve no further penalty given he\u2019s spent more than 20 years behind bars.<\/p>\n<p>\u2018Difficult to assess his risk\u2019<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Of the five expert reports Justice Down had received, three psychiatrists stated that it was difficult to confirm if he would commit a qualifying violence offence, either by the rehabilitative efforts Hoggart had made or his age.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Another stated that any risk would be reduced if he had stable accommodation and employment.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">However, a Department of Corrections psychologist said Hoggart was \u201cat least a high risk\u201d of reoffending. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Although he\u2019d made efforts to rehabilitate, that hadn\u2019t translated into a consistent behavioural change outside of prison. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Hoggart\u2019s risk was exacerbated by a traumatic brain injury that he\u2019d suffered, the psychologist noted.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Justice Downs said Hoggart\u2019s violent history stretched back to 2001, when he pushed, headbutted and slammed a partner\u2019s head into a china cabinet, throwing her across the lounge, kicking and punching her, before strangling her for seven minutes, releasing his grip every 30 seconds to allow her to get a breath.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">There were two other similar attacks on women.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Justice Downs told Hoggart he had been in prison for a long time and served a penalty for what he\u2019d done.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">He had engaged in treatment, but that work was yet to be tested outside of prison. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">\u201cGiven this, I consider the evidence would need to clearly demonstrate undue risk for preventive detention to be imposed again.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">\u201cThe evidence does not clearly demonstrate undue risk.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">\u201cMr Hoggart, I hope you and the community understand what I am saying. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">\u201cI am not saying you pose no risk. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">\u201cYou do pose risk to women with whom you have a relationship with. <\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">\u201cThat you have strangled two women is alarming.\u201d<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">But after assessing all the information, he found that preventive detention was not required and sentenced Hoggart to seven-and-a-half years\u2019 prison.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Given the amount of time he\u2019s already served, he will be released on time served as soon as practicable.<\/p>\n<p class=\"gngXgPCjmfo\" style=\"display:none\">Belinda Feek is an Open Justice reporter based in Waikato.
