“He accepts that was a reckless decision, a foolish decision to get in his car instead of taking an Uber.”

The lawyer said Warner, who previously captained Australia’s ODI and T20I teams, had drunk three glasses of wine at a friend’s apartment on Easter Sunday before deciding to drive home.

“It’s not a crime to have a glass of wine on the day of the Lord’s resurrection,” Hill said.

“His crime is, as I said, choosing a foolish plan A instead of a plan B.”

Hill claimed the former test opener had his last drink about 11 minutes before police pulled him over and accused police of taking 52 minutes to perform the second breathalyser test.

After he was charged in April, Cricket NSW chief executive Lee Germon said the allegations were “concerning” and were being taken “very seriously”.

“At Cricket NSW, we are strong advocates for safe driving, not drink-driving,” Germon said.

Warner is still listed as captain of Australian Big Bash league side the Sydney Thunder on their website and is expected to still be with the team when the season starts in December after signing an extension in January.

“He knows what he did was wrong,” Hill said at the time.
