ARN<\/a> has scored a win in its legal fight<\/a> with former breakfast radio host Jackie \u201cO\u201d Henderson<\/a>, after the Federal Court<\/a> ruled it could rely on evidence from her longtime co-host Kyle Sandilands<\/a> as it prepares to defend her multimillion-dollar lawsuit.<\/p>\n

On Friday, Federal Court Justice Angus Stewart ruled that affidavits filed by Sandilands and his manager Bruno Bouchet<\/a> were not bound by a rule preventing them from being used in Henderson\u2019s separate proceedings against the broadcaster.<\/p>\n

ARN has secured a fresh court win in its legal battle with former breakfast radio host Jackie O Henderson.\u00a0WireImage<\/p>\n

The decision means ARN and its subsidiary Commonwealth Broadcasting Corporation can rely on the material as Henderson continues pursuing legal action over the collapse of her radio career at KIIS FM.<\/p>\n

Henderson is suing the broadcaster<\/a>, alleging she was unlawfully dismissed from her reported $100 million contract after telling the company she could no longer continue hosting the breakfast program alongside Sandilands following their on-air bust-up<\/a>, which reduced her to tears earlier this year.\u00a0<\/p>\n

Henderson is seeking damages of at least $82 million after the termination of her employment.\u00a0<\/p>\n

Sandilands, who launched his own legal action against ARN after both hosts were dismissed, reached a settlement<\/a> with the broadcaster in June worth $12.09 million over three years.<\/p>\n

Court documents show ARN lodged an interlocutory application earlier this month seeking a declaration that the affidavits sworn by Sandilands and Bouchet could be used in Henderson\u2019s case.<\/p>\n

Justice Stewart found the affidavits were not subject to an obligation restricting their use in Henderson\u2019s proceedings. In his reasons, he noted there was \u201cno explanation as to why the affidavits were nevertheless filed,\u201d per The Sydney Morning Herald<\/a>.\u00a0<\/p>\n

The latest ruling marks another development in the fallout from the spectacular breakdown of one of Australian radio\u2019s biggest partnerships.<\/p>\n

Kyle and Jackie O had worked together for 25 years.\u00a0ARN<\/p>\n

The radio hosts\u2019 highly public feud began during a February broadcast in which Sandilands criticised Henderson<\/a>, accusing her of being \u201coff with the fairies\u201d and \u201cunfocused\u201d.<\/p>\n

Henderson later told ARN she could no longer work with Sandilands, before both presenters\u2019 employment with the broadcaster came to an end.<\/p>\n

The pair each launched separate Federal Court proceedings against ARN. While Sandilands has since settled his claim, Henderson\u2019s lawsuit remains ongoing and is expected to go to trial later this year.<\/p>\n

ARN is also defending the proceedings and denies Henderson\u2019s allegations. In court documents previously filed, the broadcaster argues Henderson\u2019s complaints were not made in line with workplace law.<\/p>\n

Sandilands has since gone on to announce plans for a new subscription-based show, Kyle Sandilands Live<\/a>, which employs some of those made redundant<\/a> when the Kyle and Jackie O Show went off air.<\/p>\n

As part of the settlement, ARN will provide the show with an additional $1.5 million worth of advertising services on its partner platforms over three years, while receiving 19.9 per cent of any revenue it generates. Sandilands is banned from working with ARN\u2019s direct competitors until March 2027.<\/p>\n

On Friday, Sandilands promised<\/a> it\u2019s \u201cfinally time to let everyone know what happened\u201d in an explosive trailer for his tell-all docuseries, At Home With Kyle. <\/p>\n

\u201cThis isn\u2019t a taking sides thing. I\u2019ll always love her. She\u2019s like a sister to me.
