{"id":580018,"date":"2026-08-25T16:32:17","date_gmt":"2026-08-25T16:32:17","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/580018\/"},"modified":"2026-08-25T16:32:17","modified_gmt":"2026-08-25T16:32:17","slug":"americas-cup-new-court-papers-reveal-ratcliffe-rejected-good-faith-use-of-ac75","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/580018\/","title":{"rendered":"America&#8217;s Cup: New Court papers reveal Ratcliffe rejected &#8220;good faith&#8221; use of AC75"},"content":{"rendered":"<p>        <a id=\"LeftContentPlaceHolder_IconHyperLink\" class=\"aspNetDisabled icon\"><img decoding=\"async\" id=\"LeftContentPlaceHolder_IconImage\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2025\/11\/americascup.gif\" \/><\/a><\/p>\n<p>        America&#8217;s Cup: New Court papers reveal Ratcliffe rejected &#8220;good faith&#8221; use of AC75<br \/>\n        by Richard Gladwell\/Sail-World.com\/nz 25 Aug 02:21 EST<\/p>\n<p>            <img decoding=\"async\" id=\"LeftContentPlaceHolder_TopPhotoImage\"  src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2026\/08\/yysw583294.jpg\" \/><br \/>\n            Sir Jim and Sir Ben &#8211; INEOS Britannia &#8211; Louis Vuitton Cup Final &#8211; Sept 9, 2024 &#8211; Barcelona \u00a9 Ricardo Pinto \/ America&#8217;s Cup<\/p>\n<p>        <a href=\"https:\/\/www.henrilloyd.com\/pages\/corporate\/?utm_source=yachtsandyachting&amp;utm_medium=referral&amp;utm_campaign=banner\" class=\"banner\" onclick=\"return redirect(&#039;\/Library\/LogAction.aspx?website=2&amp;region=15&amp;type=UPM&amp;theid=14455&#039;);\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2025\/09\/TeamKit-202504241710.gif\" alt=\"Henri-Lloyd Dynamic Range\" \/><br \/><\/a><a href=\"https:\/\/www.rssailing.com\/\" class=\"banner\" onclick=\"return redirect(&#039;\/Library\/LogAction.aspx?website=2&amp;region=15&amp;type=UPM&amp;theid=13843&#039;);\" rel=\"nofollow noopener\" target=\"_blank\"><img decoding=\"async\" loading=\"lazy\" src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2025\/11\/RSSailing2021-300x250-202103241853.gif\" alt=\"RS Sailing 2021 - MPU\" \/><br \/><\/a><\/p>\n<p>&#13;<br \/>\nThe positions of the parties involved in the legal action stemming from the 2024 British America&#8217;s Cup appear to have been crystallised in an amended Defence file by Athena Racing.&#13;\n<\/p>\n<p>&#13;<br \/>\nA peace offer made by Sir Ben Ainslie for use of the AC75 at the upcoming America&#8217;s Cup in Naples was rejected by an INEOS lawyer, and the matter seems unlikely to end in a hug and a handshake.&#13;\n<\/p>\n<p>&#13;<br \/>\nLast week, Athena Racing, which was under the control of Sir Ben Ainslie at the time of the 2024 America&#8217;s Cup, was given permission by the Admiralty Court of England and Wales to lodge an amended Defence to the Claim lodged on April 15, 2026 by INEOS Racing, controlled by Sir Jim Ratcliffe. &#13;\n<\/p>\n<p>&#13;<br \/>\nThe claim, arising from Agreements signed in 2021, concerns ownership of residual assets related to the 2024 America&#8217;s Cup challenge by the team known as INEOS Britannia. &#13;\n<\/p>\n<p>&#13;<br \/>\nAthena Racing Ltd has claimed ownership, and has possession, of the assets which include the AC75 that Challenged for the America&#8217;s Cup. &#13;\n<\/p>\n<p>&#13;<br \/>\nINEOS Racing, the financial backer to the tune of \u00a3174 million for the 2024 Challenge, has claimed ownership, and lodged a Claim to that effect on April 15, 2026. The three parties to the 2021 Agreement were INEOS Racing, INEOS Industries Holdings Ltd and Athena Racing.&#13;\n<\/p>\n<p>&#13;<br \/>\nLate last week, Athena Racing lodged an amendment to their Defence lodged almost three months earlier on May 28, 2026. INEOS Racing responded six weeks later on July 13.&#13;\n<\/p>\n<p>&#13;<br \/>\nMany of the amendments appear to be a legal patchwork clarifying or correcting relatively minor issues in the 41-page May 28 Defence document, the opening recital of which is that &#8220;the Claimant&#8217;s claim is denied in its entirety.&#8221;&#13;\n<\/p>\n<p>&#13;<br \/>\nThe contract between the two parties which covered the 2021 and 2024 America&#8217;s Cup Challenges is still not revealed in the documents placed before the Court, with the dispute being centred around clauses in the document relating to wind-down of the 2024 Challenge conducted under the INEOS Britannia banner, or the continuance of a British team by Athena Racing for the 38th America&#8217;s Cup, as well as the ownership of the assets. They include the AC75 INEOS Britannia, the winner of the Challenger Final, and Challenger in the 37th Match for the America&#8217;s Cup.&#13;\n<\/p>\n<p>&#13;<br \/>\nThe latest papers reveal that a letter sent on April 22 by Sir Ben Ainslie to Jonny Ginns, a Director of INEOS Sport requested &#8220;that the Claimant consider in good faith a proposal that the Defendant Claimant would retain these assets for the purposes of competing in AC38.&#8221; Ginns is also Group General Counsel for INEOS and has been with the company for 20 years.&#13;\n<\/p>\n<p>&#13;<br \/>\nIn the May 28 Defence response, Athena Racing mentioned the peace offer had been made and noted that: &#8220;The Defendant has not, to date, received a response to this letter.&#8221;&#13;\n<\/p>\n<p>&#13;<br \/>\nIn the amended statement of Defence, Athena Racing says their proposal was rejected: &#8220;By a letter dated 5 June 2026, Mr Ginns (for and on behalf of the Board of Directors of the Claimant) declined the Defendant\u2019s request outright.&#8221; &#13;\n<\/p>\n<p>&#13;<br \/>\nSignificantly, the letter signed by Jonny Ginns was sent nine days after Athena Racing told the Court they had not received a reply to their proposal, which they had sent a month earlier. The text of the proposal has not been released, but it would have defused much of the legal heat and stress inherent in the current situation. The America&#8217;s Cup challenger selection series starts in nine months, and at a minimum teams need to be sailing in six months. &#13;\n<\/p>\n<p>&#13;<br \/>\nThe effect of Ainslie&#8217;s proposal would have allowed Athena Racing to use the disputed AC75 and other assets related to the 2024 British campaign without operating under the shadow of the legal dispute between the Challenger and its former Investor\/Sponsor.&#13;\n<\/p>\n<p>&#13;<br \/>\nCurrently, the 2024 America&#8217;s Cup Challenger&#8217;s AC75 is undergoing modification at an unnamed location, with no launch date announced. The team is building a base in Bagnoli, Naples. It has been sailing its AC40s, which are racing under the new entities of &#8220;GB1&#8221; and &#8220;GB2&#8221;. They will both compete in the second America&#8217;s Cup Preliminary regatta from September 24-27 in Naples.&#13;\n<\/p>\n<p>&#13;<br \/>\nIt is not certain that the matter will be determined by the Admiralty Court before the start of the Louis Vuitton Cup.&#13;\n<\/p>\n<p>&#13;<br \/>\nAnother consistent change in the Amended Defence is the insertion of the word &#8220;forecasts&#8221; whenever &#8220;cash flow reports&#8221; were mentioned. This is believed to be in response to the INEOS Racing Ltd claim that they were not advised of expenditure by Athena Racing, and, in their original claim, requested a full statement of the distribution of funding provided by INEOS Racing and an asset schedule relating to the 2024 America&#8217;s Cup Challenge.&#13;\n<\/p>\n<p>&#13;<br \/>\nAthena Racing has refused to provide these documents, saying they are unnecessary as full financial reporting was provided to INEOS during the period of their investment\/sponsorship.&#13;\n<\/p>\n<p>&#13;<br \/>\nOwnership of the AC75, INEOS Britannia, only really became an issue after the final version of the Protocol governing the conduct of the 38th America&#8217;s Cup was publicly announced on August 12, 2025.
