{"id":584958,"date":"2026-08-30T13:32:10","date_gmt":"2026-08-30T13:32:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/nz\/584958\/"},"modified":"2026-08-30T13:32:10","modified_gmt":"2026-08-30T13:32:10","slug":"kickboxer-hayden-barnard-sentenced-to-11-months-home-detention-for-brutal-assault-in-tasman","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/nz\/584958\/","title":{"rendered":"Kickboxer Hayden Barnard sentenced to 11 months\u2019 home detention for \u2018brutal assault\u2019 in Tasman"},"content":{"rendered":"<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Hayden Barnard, a recognised martial arts exponent, was sentenced in the <a href=\"https:\/\/www.nzherald.co.nz\/topic\/district-court\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/district-court\/\">Nelson District Court<\/a> on Friday after being found guilty at trial of wounding with intent to cause grievous bodily harm. <\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">A jury acquitted him of charges of strangulation and possessing an offensive weapon.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The court heard differing accounts at trial from the victim and Barnard about what happened, which led to the jury\u2019s verdicts.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Barnard claimed he reacted in self-defence, albeit \u201cexcessively\u201d.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">But there was no dispute he had attacked the victim in the head, causing serious injury, Judge Garry Barkle said.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">\u201cThe victim was vulnerable and significantly older than you.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">\u201cYou were a trained martial arts exponent and therefore, once there was an encounter, there was little doubt about who would prevail,\u201d Judge Barkle said.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The victim said the suddenness of the attack had made it difficult to come to terms with what had happened or why.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">\u201cThe person I was before this is not the person I am today,\u201d he said in his victim impact statement, read in court on his behalf.<\/p>\n<p>Attacked at home<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">On the night of November 23, 2023, the victim and his partner were relaxing at their semi-rural <a href=\"https:\/\/www.nzherald.co.nz\/topic\/tasman-district\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/tasman-district\/\">Tasman District<\/a> address.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The victim claimed at trial he was in the living room, stepped outside, and when he returned was surprised to see Barnard in the living room, uninvited.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">At the time, Barnard was living at a nearby property. The victim said he recognised him as a \u201cnew neighbour\u201d.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The victim said he went back outside, thinking his partner might have invited Barnard in, and Barnard followed him outside and began attacking him.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The victim said he tried to stop Barnard but was overpowered.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Barnard\u2019s version of events, which the victim denied, was that he stopped at the house to have a smoke.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">He claimed to have been invited in by the victim\u2019s partner and was standing in the couple\u2019s kitchen when the victim came in from outside and yelled at him: \u201cGet the f*** out of my house\u201d.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Barnard claimed he had to defend himself. He started throwing punches and the pair ended up wrestling on the ground.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Crown prosecutor Jeremy Cameron said it was a \u201cserious wounding event\u201d regardless of how it started and a \u201csignificant beating\u201d had been delivered.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The Crown called for a prison sentence because Barnard had \u201cused his fighting skills\u201d to attack a physically weaker man.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The defence, in seeking home detention, accepted it was an aggravating matter but the court needed to factor in \u201cexcessive self-defence\u201d.<\/p>\n<p>Extensive injuries<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">The extent of the victim\u2019s injuries was revealed in his impact statement. He said they had \u201caffected every aspect\u201d of his life in the almost three years since.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">He said his recovery was slow and ongoing and he had been left with permanent injuries, including to his spine.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">A broken nose had required reconstructive surgery and was unlikely to be straight again, the victim said.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">He had permanent nerve damage to his forehead, which was so badly bruised it needed draining. He also received bruising to his neck, ears and face and now suffered ringing in his ears from tinnitus.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">He had also suffered a significant psychological impact, including PTSD.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">\u201cI was active and independent and looked forward to a future that has been taken away from me,\u201d he said.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">His partner, who had witnessed the \u201cbrutal assault\u201d, said it was \u201cincredibly painful\u201d to see the person she loved in agony, in hospital and then sleeping through much of his recovery, which their relationship had since centred on.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">She said <a href=\"https:\/\/www.nzherald.co.nz\/topic\/justice-system\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/justice-system\/\">the court process<\/a>, which had been physically and emotionally exhausting, had prolonged their trauma.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">\u201cGiving evidence was one of the most distressing episodes of my life,\u201d she said.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">\u201cThe assault stole something that can never be returned. I don\u2019t know if I will ever fully recover.\u201d<\/p>\n<p>Harm acknowledged<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Defence lawyer John Wayne Howell said Barnard acknowledged the harm caused. He accepted he had assaulted the victim and caused serious harm, but the genesis remained unclear.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Judge Barkle said at sentencing it would be unfair to Barnard and unsafe not to factor in the matter of self-defence.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">He said what wasn\u2019t in dispute was that Barnard was intoxicated on a mix of alcohol and LSD, and for unknown reasons, entered the couple\u2019s property late that night.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">\u201cThat\u2019s when events unfolded resulting in really horrendous consequences and injuries to the pair,\u201d Judge Barkle said.<\/p>\n<p><img  alt=\"Senior barrister John Wayne Howell in earlier proceedings in the High Court at Nelson. Photo \/ Tracy Neal<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">He said the impact on the couple had been \u201chugely significant\u201d and \u201clife-changing\u201d.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Judge Barkle adopted a three-and-a-half-year starting point before applying a 25% discount for mitigating factors, including remorse and steps taken voluntarily towards rehabilitation.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">He allowed a further reduction for the two years and eight months Barnard had spent on electronic bail, arriving at a final sentence of 11 months\u2019 home detention to be served at an address in <a href=\"https:\/\/www.nzherald.co.nz\/topic\/waihi\/\" target=\"_self\" rel=\"nofollow noopener\" title=\"https:\/\/www.nzherald.co.nz\/topic\/waihi\/\">Waihi<\/a>.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Barnard was also ordered to pay $2500 to the victim in emotional harm reparation.<\/p>\n<p class=\"TpGGueVENmajZwYgWe\" style=\"display:none\">Tracy Neal is a Nelson-based Open Justice reporter at NZME.
