Photo / Michael Craig

In the sentencing submissions, Crown prosecutor Aysser Al-Janabi pointed out that it was not in dispute that Crawford was driving on the wrong side of the road at excessive speed when she hit Rhind and drove away.

That “manner of her driving” was an aggravating factor, she said, as well as Rhind’s vulnerability at the time, as he was walking alone at night with his back to the car when he was struck.

The impact of the crash shattered Crawford’s windscreen, Al-Janabi said, and she must have been aware of what had happened, but she did not stop.

While not extensive or sophisticated, Al-Janabi argued, there was a significant degree of premeditation, as shown by CCTV footage of the crash.

She said the footage clearly showed Crawford drove past Rhind before turning around, driving back and striking him.

Crawford’s lawyer, Ethan Butler, disagreed, saying the U-turn showed some premeditation but not a significant amount.

“[It could be] better classified as a knee-jerk reaction rather than a premeditated act,” he argued.

He submitted that his client had a difficult upbringing, marked by violence and drug abuse.

Methamphetamine in her system

She had also suffered the death of her partner in 2018 which led to a relapse in her methamphetamine addiction.

She again relapsed in 2021, the court heard, taking the drug almost every day, including, Crawford told a probation officer before sentencing, 10 minutes before she left the house on the day she hit Rhind.

Two psychiatrists assessed Crawford before sentencing and Butler pointed out that one of them said Crawford was likely to have been unwell, or under a drug-induced psychosis at the time.

Al-Janabi and Butler agreed Crawford should be sentenced to life imprisonment, but they were at odds on what the minimum period of imprisonment (MPI) should be.

Al-Janabi said it should be in the range of 10 to 11 years, after allowing for a “limited” one-year reduction for Crawford’s personal circumstances.

Butler submitted that 10 years was more appropriate.

<img alt="Justice Layne Harvey sentenced Toni-Ashley Crawford.
