As the federal government goes hands-off on AI, California is taking the reins to address workers\u2019 biggest fears.<\/p>\n<p class=\"dcr-1s160rg\">On Thursday, California governor <a href=\"https:\/\/www.theguardian.com\/us-news\/gavin-newsom\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Gavin Newsom<\/a> <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/sep\/30\/gavin-newsom-california-ai-threat\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">signed a suite of new laws<\/a> that ban bosses from relying entirely on AI to decide whether to fire workers, using it to predict employees\u2019 emotional states or collecting neural data, meaning the information from electrical signals of someone\u2019s brain or nerves. They also require companies to notify workers if layoffs were caused by AI and prohibit AI surveillance in workplace bathrooms.<\/p>\n<p class=\"dcr-1s160rg\">The new laws come as workers increasingly worry whether AI will take their jobs, lead to discrimination and increase workplace surveillance. Unions, worker advocates and even some lawmakers pushed for the new rules, a regulatory shift for a technology that has largely developed unchecked. <a href=\"https:\/\/www.theguardian.com\/us-news\/california\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">California<\/a>, home to many of the leading companies developing AI, represents one of the first states to roll out a sweeping set of workplace regulations targeting the technology.<\/p>\n<p class=\"dcr-1s160rg\">\u201cIt\u2019s a turning point,\u201d said Lorena Gonzalez, president of the California Federation of Labor Unions, AFL-CIO, who\u2019s been helping leaders across the country write regulations. \u201cIt\u2019s really the first time we\u2019re seeing California workers showing the country that we don\u2019t have to accept [this].\u201d<\/p>\n<p class=\"dcr-1s160rg\">Other states that have recently passed individual laws aimed at AI\u2019s use in the workplace include Colorado, Connecticut, Illinois and Texas, narrower in scope than California\u2019s. And more bills across the county are being lined up for consideration, Gonzalez said.<\/p>\n<p class=\"dcr-1s160rg\">California\u2019s laws aim to target workplace surveillance measures like heat maps that track employees\u2019 movements, including how long they spend in the bathroom, or having their emotional states monitored. Amazon warehouse workers have previously complained about being timed on their bathroom breaks, for example. And at Kaiser Permanente, nurses have said automated systems <a href=\"https:\/\/calmatters.org\/economy\/technology\/2026\/07\/kaiser-nurses-workplace-surveillance-ai\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">rated their tone of voice<\/a> in patient interactions.<\/p>\n<p class=\"dcr-1s160rg\">But the laws could also prevent future unexpected harms.<\/p>\n<p class=\"dcr-1s160rg\">\u201cWe don\u2019t know all the places companies are using AI, and that is and should be scary,\u201d Gonzalez said.<\/p>\n<p class=\"dcr-1s160rg\">Part of the strategy for worker advocates and union groups like the California Federation has been following AI companies\u2019 latest products. \u201cIf it\u2019s being sold, that\u2019s a good indication\u201d it could be in use, Gonzales said. The federation also plans to use the momentum to revive issues like requiring employers to disclose when they\u2019re using AI in the workplace, which was a bill that died in the state\u2019s assembly appropriations committee this year.<\/p>\n<p class=\"dcr-1s160rg\">California\u2019s new laws are a key step in gaining regulatory ground for worker advocates, said Robin Feldman, director and founder of AI Law &amp; Innovation Institute at The University of California College of the Law, San Francisco. Still, the statutes are somewhat limited in how they are implemented.<\/p>\n<p class=\"dcr-1s160rg\">\u201cThe bills have no private enforcement,\u201d Feldman said. \u201cIn other words: workers can\u2019t sue. Only the government can enforce the laws.\u201d<\/p>\n<p class=\"dcr-1s160rg\">The new regulations come amid a backdrop of record AI spending at big tech companies along with massive job cuts. But workers have started pushing back. In June, Meta paused a program that <a href=\"https:\/\/www.theguardian.com\/technology\/2026\/jun\/24\/meta-pauses-employee-tracker-for-ai-training-amid-privacy-concerns\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">tracked workers\u2019 computer activities<\/a> to train its AI models. And one month later, dozens of employees <a href=\"https:\/\/www.theguardian.com\/technology\/2026\/jul\/14\/meta-ai-mass-layoffs-lawsuit\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">filed a lawsuit <\/a>claiming the tech company\u2019s AI tools targeted those with disability accommodations or on medical or parental leaves for layoffs.<\/p>\n<p class=\"dcr-1s160rg\">Meanwhile, safety concerns, including fears that AI could destroy humanity, have been garnering more attention from lawmakers across the country and prompted OpenAI and Anthropic to call for slowing the pace of development.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-14\" class=\"dcr-76akua\">skip past newsletter promotion<\/a><\/p>\n<p class=\"dcr-vf9hps\">Sign up to TechScape<\/p>\n<p class=\"dcr-djbwnz\">A weekly dive in to how technology is shaping our lives<\/p>\n<p><img src=\"https:\/\/www.newsbeep.com\/nz\/wp-content\/uploads\/2026\/10\/1791048611_17_500.jpg\" alt=\"\" loading=\"lazy\" decoding=\"async\" class=\"dcr-gx9601\"\/><\/p>\n<p id=\"EmailSignup-skip-link-14\" tabindex=\"0\" aria-label=\"after newsletter promotion\" role=\"note\" class=\"dcr-76akua\">after newsletter promotion<\/p>\n<p class=\"dcr-1s160rg\">\u201cWorkers are increasingly part of that movement, speaking up about the fear of job loss and the dehumanizing experience of being surveilled and controlled by an algorithm,\u201d said Annette Bernhardt, senior tech policy adviser at UC Berkeley Labor Center.<\/p>\n<p class=\"dcr-1s160rg\">While the new laws \u201chave teeth\u201d, according to Danielle Ochs, shareholder at employment law firm Ogletree Deakins\u2019 San Francisco office, it\u2019s unclear how sweeping the change will be. Ochs said employers generally aren\u2019t grappling with the AI uses outlined in the new regulations and instead are more interested in how to responsibly implement AI across their systems.<\/p>\n<p class=\"dcr-1s160rg\">\u201cHaving 10 hoops you have to jump through per tool is not reflective of reality,\u201d she said. It would be better to have \u201cguardrails that are more aligned\u201d with employers\u2019 wider use of AI rather than focused on specific tools or uses.<\/p>\n<p class=\"dcr-1s160rg\">She says opponents worry that the new rules could unexpectedly prohibit helpful AI that might, for example, ensure truckers don\u2019t fall asleep at the wheel.<\/p>\n<p class=\"dcr-1s160rg\">While it\u2019s too soon to gauge how effective the laws will be, worker advocates believe the momentum is moving in a positive direction.
