That level of planning doesn\u2019t happen by accident. Driving it are their two teenage daughters, Sunday Rose, 17, and Faith Margaret, 14. The court documents, which are public in Tennessee, where Kidman filed, lay out a very detailed parenting plan with Kidman as the primary residential parent, having custody 306 days a year, compared to the country singer\u2019s 59. Kidman is also given final say in any major decisions involving the girls, should disagreements arise. The plan also states that they won\u2019t speak badly of each other or other members of each other\u2019s family. They\u2019ve agreed to stay out of court \u2014 using a mediator to handle any potential legal disagreements in the future. Urban prepaid all child support to Kidman.<\/p>\n

As their private lives shift behind the scenes, publicly, it\u2019s one foot in front of the other. Urban has been touring, letting his music be his official mouthpiece before the divorce documents. Meanwhile, Kidman hit Paris Fashion Week with their daughters (and breakup bangs!<\/a>). She\u2019s covering Vogue<\/a> and posting on Instagram<\/a>. She\u2019s navigated this kind of spotlight before, of course. (Never forget: \u201cWell, I can wear heels now.\u201d<\/a>)<\/p>\n Compared to legal wars like Pitt v. Jolie or Depp v. Heard, Kidman and Urban\u2019s uncoupling looks tame. But that\u2019s no accident. Yahoo spoke with four top divorce and family law experts, who explain how strong prenuptial agreements, structured custody arrangements and mutual interest in staying out of court \u2014 and the headlines \u2014 can go a long way in keeping things civil.<\/p>\n Chris Melcher, celebrity divorce lawyer<\/p>\n With reputations at stake, the typical celebrity marital dissolution is best handled quickly and quietly \u2014 and that seems to be exactly what this low-key couple is doing.<\/p>\n \u201cA star\u2019s brand suffers the longer one gets dragged out,” Melcher<\/a>, of Walzer Melcher & Yoda in Woodland Hills, Calif., tells Yahoo. \u201cThe goal is to handle the case in a dignified and efficient manner.\u201d<\/p>\n While some reports claimed Kidman may have wanted to save the marriage<\/a> while Urban has already moved on<\/a>, it hasn’t escalated into the kind of flashpoint that can derail a divorce.<\/p>\n Sometimes, \u201cif one spouse feels betrayed or is not ready to leave the marriage, it can end up in a lengthy court battle,\u201d Melcher says.<\/p>\n What stands out most to Melcher is the timeline \u2014 and he thinks it tells more to the story. (Paul Ellis\/AFP via Getty Images)<\/p>\n \u201cIt takes months to put a deal together, so it\u2019s likely that this couple decided to split and agreed on their split long before there was a public announcement that they were divorcing,\u201d he says.<\/p>\n One thing that did help it along is that they didn\u2019t jointly own property, according to the documents. They also had separate bank and investment accounts.<\/p>\n \u201cIt made the process easy because \u2026 each party was awarded the assets in his or her name, including their business interests and intellectual property,\u201d Melcher says.<\/p>\n He gives the couple credit for handling the whole thing with care, saying it\u2019s smart for them \u201cto get the deal done without fighting, and then to keep quiet about it so the news passes.\u201d<\/p>\n His prediction? \u201cThis one will be over quickly.\u201d<\/p>\n Alphonse Provinziano, celebrity family law attorney<\/p>\n One of the most significant \u2014 and often most contentious \u2014 aspects of any celebrity divorce is child custody. And in this split, it\u2019s clearly front and center.<\/p>\n In this case, the parenting plan was executed with a \u201chigh level of detail and control,\u201d Provinziano<\/a>, of Provinziano & Associates in Beverly Hills, Calif., tells Yahoo. And it clearly favors Kidman.<\/p>\n \u201cNicole has 306 days with final decision-making authority,\u201d he says. \u201cThis creates a significant imbalance and likely reflects Urban’s past issues with addiction<\/a>, showing that she will be considered the primary custodial parent with a more stable location and consistent daily responsibilities.\u201d<\/p>\n As far as Kidman having final say in tiebreaking between parents, the attorney says that\u2019s practical when their daughters will primarily be with her, and with Urban overnight on weekends and some holidays.<\/p>\n \u201cYou need to have someone who’s a clear decision maker,\u201d Provinziano says of Kidman getting that distinction.<\/p>\n Provinziano describes the overall approach as a \u201cstrategic celebrity divorce\u201d \u2014 \u201cthoroughly pre-negotiated.\u201d As a result, \u201cthese parties have set themselves up for success,\u201d he says.<\/p>\n Mudita Chawla, family law attorney<\/p>\n For years, there have been unconfirmed reports of a so-called \u201caddiction clause\u201d<\/a> in Kidman and Urban\u2019s prenuptial agreement. The gist being that Urban, who went into drug treatment early in the couple\u2019s relationship, would get a monetary payout of $600,000 for every year he remained sober. Neither party has confirmed nor commented on it.<\/p>\n But Chawla<\/a>, of Chemtob Moss Forman & Beyda in New York City, says so-called behavior clauses in prenups and postnups<\/a> are very real \u2014 and sometimes extreme. She\u2019s seen some doozies, ranging from sex schedules to weight loss mandates. That said, enforceability depends on the state, as each has its own rules on what makes a prenup binding or unconscionable.<\/p>\n As for Urban\u2019s limited custodial time, Chawla says it likely reflects practical realities: his touring schedule, nighttime shows and Kidman\u2019s home being the family hub near school and activities.<\/p>\n What surprised Chawla, however, was how much of the star couple\u2019s parenting plan was made public \u2014 down to specific dates they have the children \u2014 under Tennessee law.<\/p>\n \u201cEven after doing this job for 22 years, I find that to be invasive,\u201d she says. \u201cIn New York, unless someone leaks it, you can’t find it.\u201d<\/p>\n That\u2019s disappointing, Chawla continues. \u201cAt the end of the day, this is still a family like everybody else. There are still two children navigating their teen years, and a couple who are now dealing with the breakdown of their really long relationship. Everybody knowing their business makes it harder.\u201d<\/p>\n Raiford Dalton Palmer, family lawyer<\/p>\n When high-profile marriages come to an end, the public tends to zero in on what led to the split. But Palmer<\/a>, of STG Divorce Law in Chicago and author of I Just Want This Done<\/a>, says what happens after the split is the most important part \u2014 especially when kids are involved.<\/p>\n That\u2019s the time for the soon-to-be exes to \u201cstay focused on what truly matters: the kids and peace of mind,\u201d he says.<\/p>\n His advice for couples is to \u201chandle the divorce in a businesslike manner\u2014 [and] avoid emotional responses and decision-making where possible.\u201d<\/p>\n Also, \u201ccontinue being a family, for the kids,\u201d he says.<\/p>\n That means staying aligned for the girls and making sure their needs are first. Their schedules should be in line with what is best for them, not the parents, and what makes them the most comfortable during the period of instability.<\/p>\n Palmer says Kidman and Urban should be flexible over time as the kids grow up and their needs change.
