Photo \/ Dean Purcell<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>When Judge Paul Geoghegan queried this, commenting \u201cthat\u2019s a lot of tamariki going to Rainbow\u2019s End?\u201d, Walker replied, \u201cabout 200\u2033.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>About 1000 entries were available for the draw, which could amount to a return of $50,000 if all tickets were sold.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>For that level of proceeds, the gambling needed to be conducted by a society and the net proceeds must not benefit a private individual.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Neither Walker, 57, nor Fisher, 40, had the required Class 3 gambling licences.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Posts advertising the raffle were made by a social media account connected to Walker between December 2023 and March 2024.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>One contained his bank account number and the post invited people to comment how many tickets they wanted or contact Walker directly.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Fisher\u2019s bank account details were included in another post, requesting people to transfer money for tickets into the account with their name and the number of tickets.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The posts were promoted with comments including \u201ctickets available wh\u0101nau\/Gangsters GDMC Bike Raffle\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The court summary of facts said that, given Walker\u2019s association with the Greazy Dogs, it \u201cis likely GDMC stands for \u2018Greazy Dogs Motorcycle Club\u2019\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p><img alt=\"The raffle was promoted as a \" gdmc=\"\" raffle=\"\" which=\"\" the=\"\" prosecution=\"\" said=\"\" referred=\"\" to=\"\" greazy=\"\" dogs=\"\" gang.=\"\" photo=\"\" bevan=\"\" conley=\"\"  data-test-ui=\"article-media__image\" style=\"width: 100%;\"\/>The raffle was promoted as a &#8220;GDMC&#8221; raffle, which the prosecution said referred to the Greazy Dogs gang. Photo \/ Bevan Conley<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The Facebook posts were publicly available and promoted the raffle.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>When the Department of Internal Affairs searched Walker\u2019s address in Mount Maunganui, a notebook with \u201craffle tickets\u201d written on the front was found, along with bike raffle tickets.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>At Fisher\u2019s address, two notebooks were found that referred to a bike raffle.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Along with the tickets for the draw, officers found several other raffle tickets with different prizes, including a new 2019 motorbike.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Between December 18, 2023, and February 27, 2024, about $9400 was paid into Walker\u2019s account, with transfers containing references such as \u201craffle\u201d, \u201craff\u201d, \u201craffl\u201d and \u201cticket\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>There were also transactions for amounts in multiples of $50, which investigators said supported an inference that they too were for raffle tickets, given the ticket price.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>During that same period, about $4650 was transferred into Fisher\u2019s account and a notebook found at his address \u201csuggested a total of $43,000 had been obtained from sales (cash and transfer) and a further $6500 was expected\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The summary of facts said this amounted to \u201ca total of $49,500\u2033, which would have delivered a profit of $29,500, after taking into account the costs of the prizes.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>A search of the addresses found they were both keeping a written record of ticket numbers, payments and allocation to entrants. Bundles of cash were also found.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Both men were represented in court by defence lawyer Michael Douglas, who advised the judge that all the money had been returned to those who had bought tickets and there was \u201cno outstanding loss\u201d.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Both men pleaded guilty to the three charges they jointly faced of conducting illegal gambling, making a direct or indirect pecuniary gain from illegal gambling, and promoting illegal gambling.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Judge Geoghegan referred to Walker\u2019s affidavit, which said: \u201cI was advertising the raffle openly and I was trying to encourage as many entries as possible.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>\u201cI did not realise I was breaking the law. Obviously, I wouldn\u2019t have been making publicly viewable Facebook posts about the raffle if I knew it was illegal.\u201d<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Judge Geoghegan said there was \u201csome force\u201d in that statement.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>The prosecution did not dispute that all the money had been returned.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Judge Geoghegan fined the men $500 each, per charge, and they were ordered to pay court costs on each charge.<\/p>\n<p>&#13;<br \/>\n&#13;<\/p>\n<p>Hannah\u00a0Bartlett\u00a0is a Tauranga-based Open Justice reporter at NZME.
