North Norfolk District Council has told Motor Fuel Group, which operates the forecourt at Morrisons in Fakenham there is nothing to stop it staying open all night.
It applied to the authority asking whether the move would be lawful, as no agreed opening hours were stipulated when the business first opened on Clipbush Lane, near Fakenham Town FC’s football ground in 1994.
A planning officer’s report says the station has been opening from 6am to 11pm but extending the site’s opening hours would be “lawful”.
Facilities on the site are being expanded, with a larger kiosk which will include food chains Greggs and Burger King.
Some 30 new jobs will be created at the services.
