An Everton fan has been given a three-year football banning order after being convicted of posting racist, homophobic and transphobic comments on social media. Francis Fleming, 44, from Liverpool, appeared at Sefton Magistrates’ Court yesterday (Thursday, March 19) after pleading guilty to 10 offences relating to malicious communications under Section 127 of the Communications Act, 2003.

The majority of his social media posts, posted between 2023 and 2024, were connected to football and it was reported to Merseyside Police by Everton Football Club who became aware of his activity online.

As well as being handed a community order and fines, Fleming was also given a football banning order.

DC Tom Sharrocks said: “I hope this result shows that people can’t hide behind their social media accounts and post racist, homophobic and transphobic comments online.

“This will never be accepted and it’s pleasing that Fleming is now subjected to a three-year football banning order for his appalling behaviour.

“Merseyside Police will continue to work alongside our local clubs and the Kick it Out campaign to identify and bring to justice anyone found responsible for committing a hate crime whether it’s inside a stadium or on social media.

“I hope this sends a clear message and acts as a deterrent to others that we will be put you before the courts to be prosecuted if you choose to behave in such a deplorable way.”
