\"Sunjay Karisma Kapoor<\/a>‘s children, Samaira and Kiaan, are currently fighting a legal battle against their late father Sunjay Kapur\u2019s purported will in the Delhi High Court. On Monday, the siblings claimed that the document, reportedly listing assets worth Rs 30,000 crore, contained \u201cglaring errors\u201d and could not have been prepared by him.As reported by PTI, their counsel made the submission before Justice Jyoti Singh<\/a> while hearing their plea challenging the will. \u201cHe had a very good relationship with his children. How can he have written his daughter’s address wrong and misspelt his son’s name in multiple places in the will,\u201d the counsel said.<\/p>\n

Errors in Sunjay Kapur\u2019s will seen as highly suspicious<\/p>\n

The legal team described the will as having \u201cbloopers\u201d and being \u201cvery uncharacteristic\u201d of Sunjay Kapur. \u201cIt is so casual. There are glaring errors in this will. This is not a will which Sunjay Kapur had prepared, read or made,\u201d the counsel added.They highlighted the unusual mistakes, such as misspelt names and incorrect addresses, which raised doubts over the document\u2019s validity.<\/p>\n

Priya Kapur accused of forgery<\/p>\n

The counsel also pointed out that there was no evidence of anyone preparing the will except the children\u2019s stepmother, Priya Kapur, and others. \u201cIf this will is a forgery, then only one person could have forged it,\u201d the counsel said.The children had earlier accused Priya of being \u201cgreedy\u201d and called her a \u201cCinderella stepmother\u201d during the October 9 hearing. The term refers to the fairy tale where a young woman is mistreated by her stepmother, who favours her own daughters.<\/p>\n

Court had allowed sealed asset list filing<\/p>\n

On September 26, the Delhi High Court allowed Priya Kapur to submit a list of Sunjay Kapur\u2019s assets in a sealed cover. The court also suggested that parties involved in the dispute should not share details with the media.According to the children\u2019s counsel, Priya had received 60 per cent of the assets and approximately 12 per cent went to her son. \u201cShe is also getting 75 per cent of the trust,\u201d he claimed.<\/p>\n

Probe requested into alleged will forgery<\/p>\n

The counsel told the court there was \u201cenough evidence\u201d to conduct a probe into the will. He accused Priya Kapur of forgery and asked the court to maintain the status quo on Sunjay Kapur\u2019s assets. \u201cShe is a nominee, and she holds the assets. How far the forgery of documents goes will have to be unravelled, and there is enough evidence to conduct a probe,\u201d he added.He further accused Priya of being in a \u201cglaring hurry\u201d to restrict the children\u2019s shares. \u201cThis is a Cinderella stepmother,\u201d he said.<\/p>\n

Questions raised over legal procedure followed<\/p>\n

The counsel questioned the authenticity of the will, saying Sunjay Kapur did not consult a lawyer while making it. He argued that it was \u201cnot possible that he would not have consulted an advocate before creating a will and bequeathing such a large estate.\u201dHe also mentioned that the executor of the will received it just one day before its reading. The counsel claimed the will had been modified when Sunjay Kapur was on holiday with his son and that the person who forged the document had been rewarded.<\/p>\n
