{"id":243347,"date":"2025-11-04T13:29:10","date_gmt":"2025-11-04T13:29:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/243347\/"},"modified":"2025-11-04T13:29:10","modified_gmt":"2025-11-04T13:29:10","slug":"we-felt-like-our-backs-were-up-against-the-wall-us-cycling-clothing-brand-challenging-donald-trumps-tariffs-with-supreme-court-lawsuit","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/243347\/","title":{"rendered":"&#8220;We felt like our backs were up against the wall&#8221;: US cycling clothing brand challenging Donald Trump&#8217;s tariffs with Supreme Court lawsuit"},"content":{"rendered":"<p>US-based cycling clothing brand Terry Precision Cycling is one of the businesses challenging Donald Trump&#8217;s tariffs with a lawsuit at the Supreme Court next week.<\/p>\n<p>There has been widespread criticism of the US President&#8217;s controversial economic policy from across the bike industry throughout 2025, numerous brands raising prices, speaking out or ending their interest in the US market entirely.\u00a0<\/p>\n<p><img decoding=\"async\" typeof=\"foaf:Image\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2025\/11\/donaldtrump-credit-notions-capital-flickr-creative-commmons_0.jpg\" loading=\"lazy\" class=\"lazyload\" itemprop=\"image\" width=\"562\" height=\"412\" alt=\"Donald Trump\" title=\"Donald Trump\"\/>Donald Trump (credit: Notions Capital\/Flickr creative commons)<\/p>\n<p>However, Terry Precision Cycling, the long-running women&#8217;s cycling clothing manufacturer, has taken its opposition to the tariffs to the courts and is one of the businesses which has challenged Trump&#8217;s tariffs with a lawsuit to be heard at the Supreme Court next week.<\/p>\n<p><a href=\"https:\/\/road.cc\/content\/news\/bike-industry-hold-due-trumps-controversial-tariffs-315493\" rel=\"nofollow noopener\" target=\"_blank\">&gt;\u00a0Bike industry on hold as uncertainty around Trump&#8217;s controversial tariffs continues<\/a><\/p>\n<p>&#8220;We felt like our backs were up against the wall,&#8221; company president Nik Holm told <a href=\"https:\/\/abcnews.go.com\/US\/wireStory\/vermont-cycling-apparel-company-survive-trumps-tariffs-supreme-127082510\" rel=\"nofollow noopener\" target=\"_blank\">ABC News<\/a> ahead of the court date. &#8220;If it becomes so unaffordable for them to do it, less can enter into that joy, that freedom of being on a bike.\u00a0It was about surviving this uncertainty.&#8221;<\/p>\n<p>Holm added that the inconsistent nature of Trump&#8217;s tariffs, which have changed numerous times, has left Terry Precision Cycling asking: &#8220;If we don&#8217;t know the rules of the game, how are we supposed to play?&#8221;<\/p>\n<p>The clothing brand added $50 to the price of a pair of shorts when a 145 per cent tariff on Chinese imports was introduced, hiking the price to $199. Vermont-based Terry Precision Clothing uses materials\u00a0imported from countries such as France, Italy and Guatemala. The company says that the material used in its jerseys cannot be found outside of China.<\/p>\n<p>The lawsuit argues that Trump &#8220;claims the authority to unilaterally levy tariffs on goods imported from any and every country in the world, at any rate, calculated via any methodology \u2014 or mere caprice \u2014 immediately, with no notice, or public comment, or phase-in, or delay in implementation, despite massive economic impacts that are likely to do severe damage to the global economy&#8221;.<\/p>\n<p>According to a report by Bicycle Retailer and Industry News from earlier in the year, it demands damages for the amount collected by Trump&#8217;s administration for tariffs,\u00a0payment of plaintiff attorneys&#8217; fees; and any other damages and relief the court deems appropriate.<\/p>\n<p><a href=\"https:\/\/road.cc\/content\/news\/trump-tariffs-led-bike-sales-free-fall-315789\" rel=\"nofollow noopener\" target=\"_blank\">&gt;\u00a0Trump tariffs led to bike sales &#8220;free fall&#8221;\u00a0says Chinese brand, as US imports plunge in first half of 2025<\/a><\/p>\n<p>&#8220;Even before this year&#8217;s increases, we were already paying tariffs of up to 39.5 per cent,&#8221; Holm commented in a press release.\u00a0With the additional 145 per cent\u00a0now imposed, we can&#8217;t survive long enough to shift course. 20 years ago, we made all our apparel in the U.S. but gradually moved production overseas to sustain our business.<\/p>\n<p><img decoding=\"async\" typeof=\"foaf:Image\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2025\/11\/bike-shop-credit-manny-becerra-unsplash.jpg\" loading=\"lazy\" class=\"lazyload\" itemprop=\"image\" width=\"970\" height=\"704\" alt=\"Bike shop \" title=\"Bike shop \"\/>Bike shop  (credit: Manny Becerra via Unsplash)<\/p>\n<p>&#8220;Bringing manufacturing back would require a long-term strategy supported by consistent government policies, investment in factories with skilled sewers, and access to raw materials that are not subject to high tariffs. Many of our products rely on raw materials that are simply not produced in the U.S.&#8221;<\/p>\n<p>While the bike industry has been near-unanimous in its criticism of Trump&#8217;s tariffs, US bike manufacturer Guardian Bikes remains something of an outlier in that the company has <a href=\"https:\/\/road.cc\/content\/news\/bike-brand-lobbies-trump-government-over-tariffs-316473\" rel=\"nofollow noopener\" target=\"_blank\">lobbied the\u00a0Trump administration to go further<\/a> and include bicycles and frames in a\u00a0proposed 50 per cent\u00a0aluminium and steel tariff.<\/p>\n<p>Guardian Bikes&#8217; co-founder and CEO Brian Riley claimed it would &#8220;promote fair competition, enhance domestic supply chain security, and support national interests&#8221;.<\/p>\n<p><img decoding=\"async\" typeof=\"foaf:Image\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2025\/11\/2025-giant-defy-advanced-sl-1-riding-5.jpg\" loading=\"lazy\" class=\"lazyload\" itemprop=\"image\" width=\"970\" height=\"647\" alt=\"2025 Giant Defy Advanced SL 1 - riding 5.jpg\" title=\"2025 Giant Defy Advanced SL 1 - riding 5.jpg\"\/>2025 Giant Defy Advanced SL 1 &#8211; riding 5.jpg (credit: road.cc)<\/p>\n<p>Tariffs have\u00a0been one of the industry&#8217;s biggest stories this year, brands such as Giant, <a href=\"https:\/\/road.cc\/content\/news\/specialized-set-increase-prices-due-tariffs-313589\" rel=\"nofollow noopener\" target=\"_blank\">Specialized<\/a>, Trek, Brompton and numerous others raising prices in the US in response.<\/p>\n<p><a href=\"https:\/\/road.cc\/content\/news\/giant-forced-reflect-cost-trump-tariffs-313471\" rel=\"nofollow noopener\" target=\"_blank\">&gt;\u00a0Giant &#8220;inevitably forced to reflect cost&#8221;\u00a0of Trump tariffs, as manufacturers warn US bike prices could rise by 50 per cent\u00a0amid &#8220;existential threat&#8221;\u00a0to cycling industry<\/a><\/p>\n<p>Unsurprisingly, the tariffs have <a href=\"https:\/\/road.cc\/content\/news\/chinese-bikes-us-down-17-amid-trump-tariffs-313851\" rel=\"nofollow noopener\" target=\"_blank\">seen imports of Chinese bikes to the US plummet<\/a>, but the controversial economic policy has also been blamed by brands such as <a href=\"https:\/\/road.cc\/content\/news\/rotor-shuts-us-office-and-blames-trump-tariffs-313903\" rel=\"nofollow noopener\" target=\"_blank\">Rotor\u00a0for their US office shutting<\/a> and for <a href=\"https:\/\/road.cc\/content\/news\/bmc-set-slash-quarter-workforce-due-tariffs-314117\" rel=\"nofollow noopener\" target=\"_blank\">BMC slashing a quarter of its workforce<\/a>.<\/p>\n<p>In July, the industry group PeopleForBikes warned the US bike industry might not recover from the <a href=\"https:\/\/road.cc\/content\/news\/bike-industry-may-not-recover-trump-tariffs-until-2030-314737\" rel=\"nofollow noopener\" target=\"_blank\">&#8220;devastating consequences&#8221;<\/a> of Trump&#8217;s tariffs until the end of the decade.<\/p>\n","protected":false},"excerpt":{"rendered":"US-based cycling clothing brand Terry Precision Cycling is one of the businesses challenging Donald Trump&#8217;s tariffs with a&hellip;\n","protected":false},"author":2,"featured_media":243348,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[37],"tags":[4985,101,56,54,55],"class_list":{"0":"post-243347","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-cycling","8":"tag-cycling","9":"tag-sports","10":"tag-uk","11":"tag-united-kingdom","12":"tag-unitedkingdom"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/243347","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/comments?post=243347"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/243347\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media\/243348"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media?parent=243347"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/categories?post=243347"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/tags?post=243347"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
