{"id":246675,"date":"2025-11-06T05:08:09","date_gmt":"2025-11-06T05:08:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/246675\/"},"modified":"2025-11-06T05:08:09","modified_gmt":"2025-11-06T05:08:09","slug":"asics-damning-findings-on-smsf-advice","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/246675\/","title":{"rendered":"ASIC\u2019s damning findings on SMSF advice"},"content":{"rendered":"<p id=\"breadcrumbs\" class=\"yoast\"><a href=\"https:\/\/financialnewswire.com.au\/\" rel=\"nofollow noopener\" target=\"_blank\">Home<\/a> &gt; <a href=\"https:\/\/financialnewswire.com.au\/.\/financial-planning\/\" rel=\"nofollow noopener\" target=\"_blank\">Financial Planning<\/a> &gt; ASIC\u2019s damning findings on SMSF advice<\/p>\n<p><img width=\"1200\" height=\"630\" class=\"attachment-full size-full wp-post-image nectar-lazy toploaded loaded nectar-lazy toploaded loaded\" alt=\"ASIC website browser image\" title=\"\" decoding=\"async\" fetchpriority=\"high\" data-nectar-img-src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2025\/11\/ASIC_financial-min.jpg\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2025\/11\/ASIC_financial-min.jpg\"\/><\/p>\n<p>An Australian Securities and Investments Commission (ASIC) review of 100 financial advice files has concluded that poor financial advice around self-managed superannuation funds (SMSF) establishment has placed retirement savings at risk.<\/p>\n<p>ASIC said it had identified concerns that 62 files failed to demonstrate compliance with the best interests duty, with 27 files \u2013 over a quarter \u2013 raising significant concerns about client detriment relating to recommendations to set up an SMSF.<\/p>\n<p>Barely a third of advice files \u2013 38 of 100 \u2013 demonstrated compliance with the longstanding obligation for advisers to act in clients\u2019 best interests.<\/p>\n<p>Commenting on the findings, ASIC Commissioner Alan Kirkland said, \u201cPeople often set up an SMSF because they think it will give them more control over their retirement savings, but they aren\u2019t suitable for everyone.<\/p>\n<p>:SMSF trustees should be aware of the associated costs, responsibilities and risks. People who move their super from an APRA-regulated fund to an SMSF also lose important protections, including the benefits of prudential regulation and the ability to make a complaint about the fund or its trustees to AFCA.<\/p>\n<p>\u201cFinancial advisers who recommend that clients establish SMSFs without properly considering whether it is suitable for their objectives, financial situation and needs, are not helping them take control of their future \u2014 they are placing it at risk.\u201d<\/p>\n<p>The SMSF sector in Australia is growing, accounting for around $1 trillion, or nearly a quarter, of the $4.3 trillion superannuation sector.
