In the background is rolling countryside hills lit up by the sun.\" class=\"sc-5340b511-0 hLdNfA\"\/><\/p>\n<p>Juliet Light provided utility bills as evidence of her living in the annexe in the Monmouthshire countryside <\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">In Mrs Light&#8217;s application for a certificate of lawful development, she accepted her use of the annexe was at odds with that condition, but because the four-year period in which the council could take enforcement action had passed, the breach of the planning permission was deemed lawful.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Mr Rees claimed the longest continuous period his mother lived in the annexe was eight months, from December 2021 until September 2022.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">He argued his mother&#8217;s application was &#8220;incorrect and misleading&#8221;, claiming she bought a separate property with her husband in Pandy.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">He said his mother used the annexe but did not stay overnight.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Council planning officer Kate Bingham said Mr Rees did not want to make an affidavit in support of his claims contesting what his mum had declared.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">Ms Bingham said Mrs Light&#8217;s statutory declaration stated she moved into the annexe in December 2019 &#8220;despite the occupier of that dwelling being the applicant&#8217;s son&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 eZyhnA\">This meant the council had &#8220;no evidence to contradict the statutory declaration and evidence provided by the applicant&#8221;, Ms Bingham said.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2025\/12\/1766238669_168_grey-placeholder.png\" class=\"sc-5340b511-0 gUePlo hide-when-no-script\" aria-label=\"image unavailable\"\/><img decoding=\"async\"   src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2025\/12\/afa0df50-e660-11f0-8e2a-3df90dbf71c4.png.webp.webp\" loading=\"lazy\" alt=\"A sign for the village of Llanvihangel Crucorney on a leafy roadside verge.
