{"id":410044,"date":"2026-02-05T22:17:11","date_gmt":"2026-02-05T22:17:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/410044\/"},"modified":"2026-02-05T22:17:11","modified_gmt":"2026-02-05T22:17:11","slug":"main-uk-data-use-and-access-act-provisions-enter-into-force","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/410044\/","title":{"rendered":"Main UK Data (Use and Access) Act Provisions Enter into Force"},"content":{"rendered":"<p>On February 5, 2026, the next phase of the UK Data (Use and Access) Act (\u201cDUAA\u201d) officially came into force, bringing most of its provisions, including the major reforms under Part 5, into effect. However, a notable exception is Section 103, which requires organizations to implement a formal complaints procedure; this requirement is scheduled to take effect on June 19, 2026, approximately 12 months after the DUAA received Royal Assent. Additionally, certain provisions related to the restructuring of the UK Information Commissioner\u2019s Office (\u201cICO\u201d) will commence at a later date. For more information on the DUAA\u2019s implementation timeline, see our previous blog <a href=\"https:\/\/www.hunton.com\/privacy-and-information-security-law\/uk-government-publishes-commencement-dates-for-the-uk-data-use-and-access-act\" rel=\"nofollow noopener\" target=\"_blank\">here<\/a>.<\/p>\n<p>The DUAA grants the ICO new powers to strengthen its regulatory oversight. These include the authority to compel witnesses to attend interviews, require technical reports, and issue substantial fines of up to \u00a317.5 million or 4% of global turnover under the Privacy and Electronic Communications Regulations.<\/p>\n<p>To mark the commencement of the main provisions of the DUAA, the ICO has updated its suite of guidance materials to help organizations navigate the new regulatory framework. In particular, the ICO updated its <a target=\"_blank\" title=\"Data protection by design and by default guidance\" rel=\"noopener nofollow\" href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/accountability-and-governance\/guide-to-accountability-and-governance\/data-protection-by-design-and-by-default\/\">\u2018Data protection by design and by default\u2019 guidance<\/a> which now includes a subsection on the \u2018children\u2019s higher protection matters\u2019 duty introduced by the DUAA, alongside updated <a target=\"_blank\" title=\"guidance on subject access requests\" rel=\"noopener nofollow\" href=\"https:\/\/ico.org.uk\/for-organisations\/uk-gdpr-guidance-and-resources\/individual-rights\/right-of-access\/\">guidance on subject access requests<\/a>.
