People over State Pension age may also be entitled to an increased award for the mobility part of PIP even if they have stopped getting the benefit.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">However, it\u2019s important to be aware the <a aria-label=\"change in lawLink opens in a new tab.\" class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.gov.uk\/government\/publications\/personal-independence-payment-changes\/unpaid-enhanced-mobility-changes-to-pip-law-from-30-november-2020\" rel=\"nofollow noopener\" tabindex=\"0\" target=\"_blank\">change in law<\/a> only relates to claimants over State Pension age and their entitlement to the enhanced mobility award. DWP guidance explains it only applies to PIP claims that were reviewed between April 8, 2013 and November 20, 2020.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">This change in law follows a <a aria-label=\"tribunal rulingLink opens in a new tab.\" class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.gov.uk\/guidance\/apply-for-your-pip-claim-to-be-looked-at-if-your-mobility-award-was-not-increased-because-you-reached-state-pension-age?utm_medium=email&amp;utm_campaign=govuk-notifications-topic&amp;utm_source=b1599f26-1a10-42e4-92ca-0f7d0a2c6c75&amp;utm_content=immediately\" rel=\"nofollow noopener\" tabindex=\"0\" target=\"_blank\">tribunal ruling<\/a> on May 22, 2020 which identified an unintentional gap in regulation 27 of the Social Security (Personal Independence Payment) Regulations 2013.<\/p>\n<p>READ MORE: <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" data-tmdatatrack=\"read-more\" data-tmdatatrack-articleid=\"36678729\" data-tmdatatrack-source=\"editorial\" href=\"https:\/\/www.dailyrecord.co.uk\/lifestyle\/money\/pensioners-blue-badge-parking-36678729\" tabindex=\"0\" rel=\"nofollow noopener\" target=\"_blank\">Older people without a Blue Badge may be able to use disabled parking spaces<\/a>READ MORE: <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" data-tmdatatrack=\"read-more\" data-tmdatatrack-articleid=\"36679830\" data-tmdatatrack-source=\"editorial\" href=\"https:\/\/www.dailyrecord.co.uk\/lifestyle\/money\/dwp-confirms-pip-award-changes-36679830\" tabindex=\"0\" rel=\"nofollow noopener\" target=\"_blank\">DWP confirms changes to length of PIP awards from April<\/a><\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">The guidance states: \u201cDWP did not have the legal powers to restrict the mobility award for claimants who were in receipt of the standard rate of the mobility award and over State Pension age, on the grounds of new medical evidence. New medical evidence is a report from a health professional requested by DWP which recommended the enhanced rate of the mobility award.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">\u201cDWP were only able to restrict the mobility award for claimants if a relevant change in circumstances was identified after they reached State Pension age.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Changes to PIP regulations took effect from November 30, 2020 to correct this unintentional gap.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">DWP is encouraging anyone who thinks they may have been affected to ask for their claim to be reviewed.<\/p>\n<p>Who may be eligible for PIP enhanced mobility rate?<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">DWP previously used a health professional report when reviewing your claim, and if you had not reported a change in your mobility needs, you may be entitled to an increase in your mobility award.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">This is because DWP should not have told you it could not be increased because you had reached State Pension age &#8211; which means you could have got more money.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">The enhanced mobility rate is worth \u00a377.05 each week during the current financial year, some \u00a3308.20 every four-week pay period. An award for the enhanced mobility rate, could also enable someone to join the Motability Scheme, to help them get around.<\/p>\n<p>Eligibility<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">You may be entitled to an increased award for the mobility part of your PIP, even if you have stopped getting PIP, if all of the following apply:<\/p>\n<p>you had your PIP claim reviewed between April 8, 2013 and November 20, 2020you were over State Pension ageyou received the standard rate of the mobility awardyou did not report a change in your circumstances that affected your mobility needsyou had a health professional assessmentyou continued to receive the standard rate of the mobility awardyour decision letter told you we could not increase your mobility award because you were over State Pension age<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">DWP has also previously said if you are getting PIP now, they will not reduce your award because of this change. However, it added it cannot look again at any decisions made by a tribunal.<\/p>\n<p>How to apply<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Contact the PIP enquiry line on 0800 121 6579 and say you are enquiring about the \u2018Regulation 27 administrative exercise review\u2019.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">You will need your National Insurance number.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">PIP.
