The justices affirmed the earlier judgment of the U.S. Court of International Trade in <a data-analytics-id=\"inline-link\" href=\"https:\/\/libertyjusticecenter.org\/cases\/v-o-s-selections-inc-v-trump\/\" data-url=\"https:\/\/libertyjusticecenter.org\/cases\/v-o-s-selections-inc-v-trump\/\" target=\"_blank\" referrerpolicy=\"no-referrer-when-downgrade\" data-hl-processed=\"none\" data-mrf-recirculation=\"inline-link\" rel=\"nofollow noopener\">Trump v. V.O.S. Selection<\/a>. Among the plaintiffs was <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.cyclingweekly.com\/news\/we-felt-like-our-backs-were-up-against-the-wall-the-cycling-clothing-company-taking-on-trumps-tariffs\" data-url=\"https:\/\/www.cyclingweekly.com\/news\/we-felt-like-our-backs-were-up-against-the-wall-the-cycling-clothing-company-taking-on-trumps-tariffs\" data-hl-processed=\"none\" data-mrf-recirculation=\"inline-link\" data-before-rewrite-localise=\"https:\/\/www.cyclingweekly.com\/news\/we-felt-like-our-backs-were-up-against-the-wall-the-cycling-clothing-company-taking-on-trumps-tariffs\" rel=\"nofollow noopener\" target=\"_blank\">Terry Precision Cycling<\/a>, the Vermont-based women\u2019s cycling apparel brand we reported on in November. Terry joined a coalition of 12 states and five small companies challenging the tariffs&#8217; legality, arguing that the added duties placed financial strain on its business.<\/p>\n<p><a id=\"elk-seasonal\"\/><\/p>\n<p id=\"e99d3b1e-0be7-4947-aefe-218278bfca83-2\" class=\"paywall\" aria-hidden=\"true\">IEEPA was designed to allow U.S. presidents to respond to national emergencies involving foreign threats by sanctioning or restricting financial transactions. The Supreme Court ruled that the statute does not authorise sweeping import tariffs. Tariffs fall under Congress&#8217;s authority, though it can delegate limited powers to the executive branch.<\/p>\n<p>You may like<\/p>\n<p class=\"paywall\" aria-hidden=\"true\">As a result, tariffs enacted specifically under IEEPA no longer have a legal foundation. Additionally, the billions of dollars collected in duties under that authority are meant to be refunded to importers, although federal agencies have not yet clarified how or when that process will unfold.<\/p>\n<p>&#8220;This decision represents a significant check on executive tariff authority and will shape presidential tariff policy going forward,&#8221; said <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.peopleforbikes.org\/news\/2026-bike-industry-tariff-updates\" data-url=\"https:\/\/www.peopleforbikes.org\/news\/2026-bike-industry-tariff-updates\" target=\"_blank\" referrerpolicy=\"no-referrer-when-downgrade\" data-hl-processed=\"none\" data-mrf-recirculation=\"inline-link\" rel=\"nofollow noopener\">PeopleForBikes<\/a>, the U.S. bicycle industry\u2019s trade association. &#8220;While it is anticipated that billions of dollars in duty collected under IEEPA will be refunded to importers, the process and timetable for that to happen is not yet clear.&#8221;<\/p>\n<p class=\"paywall\" aria-hidden=\"true\">Industry leaders say any near-term relief for the bicycle market may be limited.<\/p>\n<p>Following the Supreme Court\u2019s decision, President Trump today said he would pursue a temporary, across-the-board 10% tariff using a different statutory authority to replace the voided IEEPA measures.<\/p>\n<p class=\"newsletter-form__strapline\">The latest race content, interviews, features, reviews and expert buying guides, direct to your inbox!<\/p>\n<p class=\"paywall\" aria-hidden=\"true\">In speaking with Bicycle Retailer &amp; Industry News (BRAIN), <a data-analytics-id=\"inline-link\" href=\"https:\/\/www.cyclingweekly.com\/news\/kona-founders-buy-back-the-brand-return-it-to-being-rider-owned-and-operated\" data-url=\"https:\/\/www.cyclingweekly.com\/news\/kona-founders-buy-back-the-brand-return-it-to-being-rider-owned-and-operated\" data-hl-processed=\"none\" data-mrf-recirculation=\"inline-link\" data-before-rewrite-localise=\"https:\/\/www.cyclingweekly.com\/news\/kona-founders-buy-back-the-brand-return-it-to-being-rider-owned-and-operated\" rel=\"nofollow noopener\" target=\"_blank\">Kona Bikes<\/a> CEO Jacob Heilbron said that companies should temper expectations around both the timing and likelihood of tariff repayments, while suggesting that bike prices won&#8217;t be lowered any time soon.<\/p>\n<p>&#8220;I think the industry needs to get a firm footing on the tariff situation before adjusting prices,&#8221; Heilbron <a data-analytics-id=\"inline-link\" href=\"https:\/\/bicycleretailer.com\/industry-news\/2026\/02\/20\/industry-praises-supco%E2%80%99s-tariff-decision-expects-no-immediate-relief\" data-url=\"https:\/\/bicycleretailer.com\/industry-news\/2026\/02\/20\/industry-praises-supco%E2%80%99s-tariff-decision-expects-no-immediate-relief\" target=\"_blank\" referrerpolicy=\"no-referrer-when-downgrade\" data-hl-processed=\"none\" data-mrf-recirculation=\"inline-link\" rel=\"nofollow noopener\">told BRAIN.<\/a> &#8220;As far as collecting refunds, we\u2019ve been unable to get duty drawbacks for product we\u2019ve exported from our U.S. warehouse for more than a decade. We also need to temper our expectations that refunds will be made, and made in a timely manner.&#8221;<\/p>\n<p class=\"paywall\" aria-hidden=\"true\">The ruling also does not affect tariffs imposed under Section 232, which allows duties on national security grounds, or Section 301, which targets unfair trade practices.<\/p>\n<p class=\"paywall\" aria-hidden=\"true\">To that end, PeopleForBikes said it is continuing to advocate for reducing and eliminating tariffs affecting the bike sector, including the proposed inclusion of additional bicycle and e-bike product categories under Section 232 tariffs.
