The <a aria-label=\"\" class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.birminghammail.co.uk\/all-about\/labour-party\" rel=\"follow nofollow noopener\" tabindex=\"0\" target=\"\">Labour Party<\/a> plans a rule change to strip more criminals of public sector pensions.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">The Labour Party government lawyers are working to prevent Wayne Couzens, the killer of Sarah Everard, from receiving his taxpayer-funded pension. The government wants to block killers from claiming pensions from the Civil Nuclear Constabulary (CNC).<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Doug Mullen, of law firm Anthony Collins, added: \u201cThey wouldn\u2019t do something just for Wayne Couzens, it would need to apply to others as well. Potentially they [the Government] could find themselves in this sort of situation again.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\"><a aria-label=\"\" class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.birminghammail.co.uk\/news\/midlands-news\/uk-households-urged-ration-popular-33454938\" rel=\"follow nofollow noopener\" tabindex=\"0\" target=\"\">READ MORE UK households urged to ration popular painkiller &#8211; major shortage to last 4 months<\/a><\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">\u201cI think it\u2019s the sort of offence where the public would expect forfeiture to apply and it\u2019s relatively rare to make a law retrospective, but it\u2019s not impossible.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Andrew Campbell, of law firm Doyle Clayton, said any legislation would have to be \u201cwatertight\u201d to avoid legal challenges.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">He said: \u201cThe Government could extend legislation to cancel someone\u2019s pension when they\u2019re convicted of a serious crime and it was in the public interest to do so.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">&#8220;For example, where payment of a publicly funded pension would offend the public conscience, as is unquestionably the case here.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">\u201cIt would be important to set the bar for cancelling a pension at an appropriately high level, as inevitably there could be legal challenges brought to forfeiting a pension, such as on the grounds of judicial review of how this power was exercised.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">\u201cCare would need to be taken to ensure that the legislation was watertight and could only be used in the most serious and obvious cases, rather than, say, someone just losing their job on the grounds of gross misconduct.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">&#8220;Particularly as this power would be introduced to be used in other cases in the future and not just for one individual.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">A DESNZ spokesman said: \u201cWe are absolutely determined that Wayne Couzens does not receive a Civil Nuclear Constabulary pension, and are actively working on a targeted and proportionate solution that would resolve this.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"Government plans a rule change to strip more criminals of public sector pensions.
