{"id":466191,"date":"2026-03-09T16:25:07","date_gmt":"2026-03-09T16:25:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/466191\/"},"modified":"2026-03-09T16:25:07","modified_gmt":"2026-03-09T16:25:07","slug":"top-us-banks-weigh-suing-federal-regulator-over-crypto-banking-rules-banking","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/466191\/","title":{"rendered":"Top US banks weigh suing federal regulator over crypto banking rules | Banking"},"content":{"rendered":"<p class=\"dcr-130mj7b\">Some of the largest US banks are considering suing their financial regulator, arguing that a new raft of licenses for crypto, payment and fintech could put American consumers and the wider financial system at risk.<\/p>\n<p class=\"dcr-130mj7b\">The Bank Policy Institute (BPI), which represents 40 of the biggest US lenders including JP Morgan, <a href=\"https:\/\/www.theguardian.com\/business\/goldmansachs\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Goldman Sachs<\/a> and Citigroup, is understood to be weighing its legal options after the Office of the Comptroller of the Currency (OCC) failed to heed repeated warnings from influential banking groups and state regulators over its reinterpretation of federal licensing rules.<\/p>\n<p class=\"dcr-130mj7b\">The OCC, which is led by Jonathan Gould, a <a href=\"https:\/\/www.theguardian.com\/us-news\/donaldtrump\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a> appointee and former crypto executive, has effectively made it easier for crypto and fintech upstarts to secure and operate under a national bank trust charter, giving them the right to serve customers across all 50 states.<\/p>\n<p class=\"dcr-130mj7b\">However, banks say giving these firms the OCC\u2019s stamp of approval means letting firms loose into the US financial system without the same rigorous supervision and controls required of fully fledged banks.<\/p>\n<p class=\"dcr-130mj7b\">The reforms brought forward by the OCC are widely seen as playing into the Trump administration\u2019s <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/feb\/22\/crypto-big-tech-trump\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">ideological<\/a> <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/jun\/17\/trump-crypto-memecoin-corruption\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">push<\/a> <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/apr\/14\/critics-slam-deregulation-of-crypto-as-trump-family-expands-its-footprint-in-industry\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">to<\/a> <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/may\/14\/trump-crypto-conflict-interest\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">bring<\/a> <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/aug\/07\/trump-executive-order-cryptocurrency\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">crypto<\/a> and previously fringe financial firms into the mainstream.<\/p>\n<p class=\"dcr-130mj7b\">Trump\u2019s own family-run cryptocurrency business, World Liberty Financial, <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/18\/trump-financial-products-conflicts-of-interest\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">made headlines<\/a> after applying for one of the OCC\u2019s national trust bank charters in January. Although bank lobby groups have so far stopped short of commenting on the firm\u2019s bid for regulatory approval, the move has sparked <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-resolution\/243\/history\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">opposition<\/a> in Congress.<\/p>\n<p class=\"dcr-130mj7b\">The BPI in October <a href=\"https:\/\/bpi.com\/bpi-urges-occ-to-preserve-the-integrity-of-national-trust-charters\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">urged the OCC<\/a> to reject applications by crypto and blockchain firms Circle and Ripple, as well as London-headquartered payments firm Wise, all of which lodged applications for so-called national trust charters.<\/p>\n<p class=\"dcr-130mj7b\">The BPI, which has a <a href=\"https:\/\/bpi.com\/about-us\/\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">board<\/a> that includes JP Morgan boss Jamie Dimon, Bank of America\u2019s Brian Moynihan, and Goldman Sachs chief David Solomon, warned at the time that \u201callowing firms to choose a lighter regulatory touch while offering bank-like products could blur the statutory boundary of what it means to be a \u2018bank,\u2019 heighten systemic risk and undermine the credibility of the national banking charter itself\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The BPI is now considering whether to sue the OCC, according to a source familiar with the lobby group\u2019s thinking.<\/p>\n<p class=\"dcr-130mj7b\">It would be a rare but not unprecedented move for the industry body, which also <a href=\"https:\/\/www.cnbc.com\/2024\/12\/24\/biggest-banks-planning-to-sue-the-federal-reserve-over-annual-stress-tests.html\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">sued<\/a> the Federal Reserve in late 2024 following an uproar over changes to the central bank\u2019s stress tests. The Fed eventually agreed to change its rules, with final proposals due later this month.<\/p>\n<p class=\"dcr-130mj7b\">The Guardian understands the BPI has not yet made a decision on whether it will pursue legal action against the OCC.<\/p>\n<p class=\"dcr-130mj7b\">The BPI declined to comment on the potential legal action.<\/p>\n<p class=\"dcr-130mj7b\">The OCC has also come up against smaller banking groups and state regulators in its pro-crypto licensing push.<\/p>\n<p class=\"dcr-130mj7b\">The Conference of State Bank Supervisors, which represents financial regulators from all 50 states, <a href=\"https:\/\/www.csbs.org\/sites\/default\/files\/other-files\/CSBS%20Comment%20Letter_OCC%20Trust%20Charter%20NPR.pdf\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">said in a letter<\/a> to the OCC last month that handing regulatory approval to crypto and payments companies that ultimately fall outside \u201ccore federal banking laws\u201d would mean \u201cundermining competition, consumer protection and financial stability\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Similar warnings were issued by the Independent Community Bankers of America (ICBA), representing about 5,0000 smaller lenders, which urged the OCC to pull or change its proposals for how it planned to issue licenses to crypto firms.
