{"id":483955,"date":"2026-03-19T11:59:13","date_gmt":"2026-03-19T11:59:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/483955\/"},"modified":"2026-03-19T11:59:13","modified_gmt":"2026-03-19T11:59:13","slug":"charity-bodies-to-produce-guidance-on-will-writing-services","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/483955\/","title":{"rendered":"Charity bodies to produce guidance on will-writing services"},"content":{"rendered":"<p>Two sector bodies have announced that they will produce guidance for charities offering will-writing services to donors in the coming months as legacy income becomes an increasingly significant income stream.<\/p>\n<p>This comes after a recent report in <a href=\"https:\/\/www.thetimes.com\/article\/8e465231-5965-45f8-a4a6-f243f528b454?shareToken=a174e0ce040c8b37d70dc20cba5a2d77\" rel=\"nofollow noopener\" target=\"_blank\">the Times<\/a> warned that errors and oversights in free will-writing by charities could lead to costly legal disputes and surprise tax bills, stating it was advisable to use a solicitor.\u00a0<\/p>\n<p>However, many charity schemes are offered in partnership with solicitors such as <a href=\"https:\/\/freewillsmonth.org.uk\/\" rel=\"nofollow noopener\" target=\"_blank\">Free Wills Month,<\/a> running this month with several major charities signed up, and <a href=\"https:\/\/www.willaid.org.uk\/\" rel=\"nofollow noopener\" target=\"_blank\">Will Aid,<\/a> which offers a service in November.<\/p>\n<p>The Chartered Institute of Fundraising (CIOF) and Remember A Charity will publish their guidance in the spring on will-writing partnerships.<\/p>\n<p>Crisis, National Trust, Amnesty International, NSPCC and Alzheimer\u2019s Society are among several charities which offer that service.<\/p>\n<p>Claire Stanley, policy and communications director at CIOF, warned that charities should carefully consider the opportunities and risks, as well as the levels of regulation.<\/p>\n<p>Stanley said: \u201cWill-writing is an extremely complex area.<\/p>\n<p>\u201c[The framework] will provide charities with a framework to ask the right questions to make the decisions that are right for themselves and their supporters.\u201d<\/p>\n<p>Remember A Charity, a UK consortium of about 200 voluntary organisations and campaign arm of CIOF, added that free will-writing can remove a significant hurdle for people.<\/p>\n<p>\u201cFree wills can remove a key barrier and help people take that crucial first step of putting a will in place, and for many supporters a simple will is sufficient,\u201d said director Lucinda Frostick.<\/p>\n<p>However, she said clear signposting was needed for supporters who need specialist advice to ensure they are protected.<\/p>\n<p>\u201cUltimately, charities will want to ensure that their supporters have access to the right level of advice for them.\u201d<\/p>\n<p>Frostick said charities should safeguard supporters by educating them on the opportunities and risks in will-writing, including any potential \u201cupselling\u201d.\u00a0<\/p>\n<p>Ashley Rowthorn, Legacy Futures executive director, emphasised the fact that most charities partner with solicitors to offer free will writing services.\u00a0<\/p>\n<p>&#8220;Charities have been promoting free will services to their supporters for several decades, and is now a key part of most legacy strategies,&#8221; Rowthorn said.<\/p>\n<p>He added that 97% of charity participants in its\u00a0Legacy Marketing Benchmarks analysis said they run a free will scheme, and 43% of campaigns have a free will offer connected to them.<\/p>\n<p>\u2018Considerable risks\u2019<\/p>\n<p>Legacy income for charities in the UK increased to \u00a34.5bn overall last year, according to analysis from Smee &amp; Ford and Legacy Futures.<\/p>\n<p>According to their analysis, <a href=\"https:\/\/www.civilsociety.co.uk\/news\/uk-legacy-income-grows-to-4-5bn-as-probate-backlog-clears-report-shows.html\" rel=\"nofollow noopener\" target=\"_blank\">legacies<\/a> represented 30% of all fundraising and 14% of total income for the 1,000 charities in England and Wales that received the most money from legacies.<\/p>\n<p>Longer term, legacy income for UK charities is forecast to exceed \u00a37.5bn by 2040 and \u00a311bn by 2050.<\/p>\n<p>In its recently updated code of practice, the <a href=\"https:\/\/www.fundraisingregulator.org.uk\/code\/standards-which-apply-specific-fundraising-methods\/legacies\" rel=\"nofollow noopener\" target=\"_blank\">Fundraising Regulator (FR)<\/a> warns that there are \u201cconsiderable risks\u201d in charities paying for someone\u2019s will which includes a legacy donation to their organisation.<\/p>\n<p>Fundraisers \u201cmust not insist that your charitable institution receives a legacy or is appointed as executor in exchange for paying for the will\u201d in this situation, it says.<\/p>\n<p>It also warns that close relationships between a fundraiser and someone considering leaving a legacy to a charity can also carry risks.<\/p>\n<p>\u201cThis can lead to the fundraiser benefiting rather than the charitable institution, as a legacy may be left to the individual fundraiser rather than to the charitable institution,\u201d it states.<\/p>\n<p>It states that fundraisers themselves must not be involved in drafting any wills in their favour.<\/p>\n<p>Meanwhile, the <a href=\"https:\/\/www.gov.uk\/guidance\/wills-and-charitable-legacies\" rel=\"nofollow noopener\" target=\"_blank\">Charity Commission\u2019s guidance<\/a> states that legacy fundraising is a \u201cdelicate subject\u201d and urges charities to be sensitive.<\/p>\n<p>It states that a will must comply with legal requirements to be valid, namely, to be signed in front of two witnesses with no charitable association.<\/p>\n","protected":false},"excerpt":{"rendered":"Two sector bodies have announced that they will produce guidance for charities offering will-writing services to donors in&hellip;\n","protected":false},"author":2,"featured_media":483956,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[14],"tags":[84,4176,4174,4175,56,54,55],"class_list":["post-483955","post","type-post","status-publish","format-standard","has-post-thumbnail","category-personal-finance","tag-business","tag-finance","tag-personal-finance","tag-personalfinance","tag-uk","tag-united-kingdom","tag-unitedkingdom"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/483955","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/comments?post=483955"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/483955\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media\/483956"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media?parent=483955"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/categories?post=483955"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/tags?post=483955"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
