Implementation of these measures&#13;<br \/>\nis now beginning in earnest, and Ofcom has recently issued a&#13;<br \/>\nhelpful <a href=\"https:\/\/www.ofcom.org.uk\/tv-radio-and-on-demand\/broadcast-standards\/the-media-act-update-on-our-progress\" target=\"_blank\" rel=\"nofollow noopener\">update<\/a> on its latest action. With other&#13;<br \/>\nrelated proposals also coming from the UK government, it&#8217;s&#13;<br \/>\nuseful to distill where we&#8217;re at.<\/p>\n<p>In brief:<\/p>\n<p>&#13;<br \/>\nthe draft VoD Code which will be similar to&#13;<br \/>\nthe existing Broadcasting Code, but will apply to &#8216;Tier 1&#8217;&#13;<br \/>\nvideo-on-demand (VoD) services, and the related consultation is&#13;<br \/>\nexpected to be published on 1 April.&#13;<br \/>\n&#13;<br \/>\nthe new threshold for designation as a &#8216;Tier 1&#8217;&#13;<br \/>\nvideo-on-demand services has been confirmed at 50,000&#13;<br \/>\naverage monthly users.&#13;<br \/>\n&#13;<br \/>\nthe government has plans to extend the list of&#13;<br \/>\n&#8216;regulated electronic programme guides&#8217;&#13;<br \/>\n(EPGs) \u2013 this will have significance for many&#13;<br \/>\nservices\/channels found on the currently unregulated EPGs of&#13;<br \/>\npopular linear streaming platforms. If the proposals are&#13;<br \/>\nimplemented, as well as the identified EPGs becoming subject to&#13;<br \/>\nregulation, the channels\/services on them will also be subject to&#13;<br \/>\nthe Broadcasting Code, many for the first time.&#13;<br \/>\n&#13;<br \/>\nOfcom has set out its plans for new prominence rules for&#13;<br \/>\nfinding public service broadcasters (PSBs) on connected&#13;<br \/>\nTVs, with final codes and guidance coming later this&#13;<br \/>\nyear.&#13;<br \/>\n&#13;<br \/>\nnew regulation of radio selection services on voice-activated&#13;<br \/>\nplatforms (such as smart speakers) has been&#13;<br \/>\noutlined, with recommendations as to which platforms will be&#13;<br \/>\ndesignated now published and a draft Code of Practice expected&#13;<br \/>\nshortly.&#13;<\/p>\n<p>Diving into these in a little more detail:<\/p>\n<p>Video-on-demand services \u2013 content and&#13;<br \/>\naccessibility<\/p>\n<p>As video-on-demand (VoD) services have grown in popularity, the&#13;<br \/>\nMedia Act introduced a new framework to help to protect audiences&#13;<br \/>\nfrom harmful content. While UK-based on-demand services have been&#13;<br \/>\nregulated since 2010, the regime has been narrower than that for&#13;<br \/>\ntraditional linear broadcast channels under the Broadcasting Code.&#13;<br \/>\nThe new VoD Code will apply to the most popular VoD services in the&#13;<br \/>\nUK, adapting the Broadcasting Code rules to make sure that they are&#13;<br \/>\nsuitable for on-demand services.<\/p>\n<p>The UK government has <a href=\"https:\/\/www.gov.uk\/government\/news\/uks-video-on-demand-services-to-have-enhanced-ofcom-regulation\" target=\"_blank\" rel=\"nofollow noopener\">confirmed<\/a> that services which have more than&#13;<br \/>\n500,000 average monthly users in the UK will be in scope of the new&#13;<br \/>\nrules. This will mean that Netflix, Amazon Prime Video, Disney+,&#13;<br \/>\nITVX and Channel 4 On Demand will be subject to the VoD Code.<\/p>\n<p>From 1 April, Ofcom will consult on the proposed VoD Code, which&#13;<br \/>\nwill require accurate and impartial news reporting and protection&#13;<br \/>\nagainst harmful content. Also in spring 2026, Ofcom will publish a&#13;<br \/>\ndraft of the accessibility code requiring Tier 1 VoD platforms to&#13;<br \/>\nensure that 80% of catalogue content is subtitled, 10% is&#13;<br \/>\naudio-described, and 5% is signed.<\/p>\n<p>Statutory sanctions for breach of the VoD Code will include&#13;<br \/>\nfinancial penalties with a maximum fine per breach of a rule will&#13;<br \/>\nbe \u00a3250,000 or 5% of qualifying revenue.<\/p>\n<p>Electronic programme guides<\/p>\n<p>The government has published a <a href=\"https:\/\/www.gov.uk\/guidance\/government-statement-on-the-future-regulation-of-television-electronic-programme-guides\" target=\"_blank\" rel=\"nofollow noopener\">statement<\/a> on extending regulation to&#13;<br \/>\nelectronic programme guides (EPGs) not currently within scope of&#13;<br \/>\nEPG regulation and that are typically delivered over the internet.&#13;<br \/>\nRegulated EPGs have obligations to make sure that the channels&#13;<br \/>\ndisplayed on their listings are properly licensed, and that&#13;<br \/>\nlistings are allocated on a fair and non-discriminatory (FRAND)&#13;<br \/>\nbasis. Regulated EPGs must also ensure prominence of PSB channels&#13;<br \/>\nand comply with accessibility requirements.<\/p>\n<p>There are currently only four providers of regulated EPGs&#13;<br \/>\n(Everyone TV, Sky, Virgin Media, and YouView). The government plans&#13;<br \/>\nto introduce secondary legislation, firstly to regulate additional&#13;<br \/>\nEPGs of these providers, and then to regulate additional popular&#13;<br \/>\nand mainstream unregulated EPGs.<\/p>\n<p>It&#8217;s important to note that the regulation of EPGs not only&#13;<br \/>\nhas an impact on the providers of those EPGs, but on the&#13;<br \/>\nchannels\/services listed on them. This is of particular&#13;<br \/>\nsignificance for smaller and niche channels that are often found on&#13;<br \/>\nEPGs of these streaming services, but not on the traditional&#13;<br \/>\nbroadcast EPGs. If the EPGs on which they&#8217;re listed become&#13;<br \/>\nregulated, these channels will also be required to hold an&#13;<br \/>\nappropriate Ofcom licence and will become subject to the&#13;<br \/>\nBroadcasting Code (that is, they&#8217;ll be treated in the same way&#13;<br \/>\nas traditional linear broadcast channels).<\/p>\n<p>Connected TVs<\/p>\n<p>The Media Act has also made changes aimed at ensuring more&#13;<br \/>\nconsistency, regardless of how consumers access programming.&#13;<br \/>\nConnected TVs and their &#8220;Television Selection Services&#8221;&#13;<br \/>\n(not to be confused with EPGs) are caught by new rules to make PSB&#13;<br \/>\ncontent prominent and easily discoverable on connected TVs, and to&#13;<br \/>\nensure accessibility for those with sight and hearing impairments.&#13;<br \/>\nThe PSBs were invited to make applications to Ofcom about which of&#13;<br \/>\ntheir internet &#8216;players&#8217; and apps should be protected by&#13;<br \/>\nthe regime, and this will be confirmed in due course. In terms of&#13;<br \/>\nthe platforms which will need to give those PSB players\/apps&#13;<br \/>\nprominence and comply with the accessibility rules, Ofcom has said&#13;<br \/>\nthat a platform must have at least 700,000 active users to be&#13;<br \/>\ndesignated. It has said that 14 will be designated, including those&#13;<br \/>\nof Samsung, Apple and Freely. As part of last year&#8217;s&#13;<br \/>\nconsultation on the new rules, Ofcom issued a draft code of&#13;<br \/>\npractice and guidance for connected TV providers. Final versions of&#13;<br \/>\nthese will be published later this year.<\/p>\n<p>Smart speakers<\/p>\n<p>Listening habits have also changed dramatically. The Media Act&#13;<br \/>\nbrings voice-activated platforms, such as smart speakers into&#13;<br \/>\nregulation for the first time, requiring that they must carry&#13;<br \/>\ninternet radio services which correspond to UK broadcast radio&#13;<br \/>\nstations, and ensure that they play by giving spoken commands.&#13;<br \/>\nOfcom has now published its <a href=\"https:\/\/www.ofcom.org.uk\/tv-radio-and-on-demand\/digital-radio\/designation-of-radio-selection-services-draft-report-to-the-secretary-of-state?utm_medium=email&amp;utm_campaign=Designation%20of%20Radio%20Selection%20Services&amp;utm_content=Designation%20of%20Radio%20Selection%20Services+CID_0e1c38f46b78e9a77e6e4770a11dc07a&amp;utm_source=updates&amp;utm_term=recommending%20that%20the%20Secretary%20of%20State%20designate%20three%20radio%20selection%20services\" target=\"_blank\" rel=\"nofollow noopener\">final recommendations<\/a> that Amazon&#8217;s Alexa,&#13;<br \/>\nGoogle Assistant, and Apple&#8217;s Siri should be designated under&#13;<br \/>\nthe new regulations for voice-activated platforms. It now plans to&#13;<br \/>\nconsult on a new draft Code of Practice for the designated&#13;<br \/>\nplatforms about how they can comply with their new duties.<\/p>\n<p>Conclusion<\/p>\n<p>The landscape is complex and there&#8217;s a lot going on!
