{"id":507517,"date":"2026-04-01T18:23:13","date_gmt":"2026-04-01T18:23:13","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/507517\/"},"modified":"2026-04-01T18:23:13","modified_gmt":"2026-04-01T18:23:13","slug":"uspto-rejects-nintendos-summon-character-and-let-it-fight-pokemon-patent","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/507517\/","title":{"rendered":"USPTO Rejects Nintendo&#8217;s &#8216;Summon Character and Let It Fight&#8217; Pok\u00e9mon Patent"},"content":{"rendered":"<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">The USPTO has rejected Nintendo\u2019s controversial &#8216;summon character and let it fight&#8217; Pok\u00e9mon patent, after it was heavily criticized by IP lawyers last year.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">In November, the director of the United States Patent and Trademark Office (USPTO) <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/us-patent-office-boss-orders-reexamination-of-nintendos-controversial-summon-character-and-let-it-fight-pokmon-patent-which-ip-lawyer-claims-further-undermines-credibility-of-its-case-against-palworld\" rel=\"nofollow noopener\" target=\"_blank\">ordered a reexamination of the patent<\/a> after <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/nintendo-should-never-have-received-controversial-summon-character-and-let-it-fight-pokmon-patent-ip-lawyers-say\" rel=\"nofollow noopener\" target=\"_blank\">IP lawyers had criticized the U.S. patent system and the USPTO for awarding it<\/a>.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">At the time, IP expert <a href=\"https:\/\/x.com\/Florian4Gamers\/status\/1965991376681664655\" class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Florian Mueller took to social media<\/a> to say Nintendo \u201cshould never\u201d have received a &#8220;summon character and let it fight&#8221; patent in the first place, while video game patent lawyer Kirk Sigmon told <a href=\"https:\/\/www.pcgamer.com\/gaming-industry\/an-embarrassing-failure-of-the-us-patent-system-videogame-ip-lawyer-says-nintendos-latest-patents-on-pokemon-mechanics-should-not-have-happened-full-stop\/\" class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">PC Gamer<\/a> &#8220;these claims were in no way allowable.&#8221;<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Nintendo and The Pok\u00e9mon Company are currently embroiled in <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/nintendo-and-the-pokmon-company-officially-suing-palworld-developer-over-multiple-patent-infringements\" rel=\"nofollow noopener\" target=\"_blank\">ongoing litigation with Pocketpair&#8217;s Palworld<\/a> in Japan, and patents are at the heart of the lawsuit. This particular patent sums up how Pok\u00e9mon games work in that you summon Pok\u00e9mon to battle other Pok\u00e9mon in the hope of adding them to your collection. But, as was pointed out last year, there are countless other games that use similar mechanics, such as Persona, Digimon, and even Elden Ring, depending upon how the patent is interpreted.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\"><a href=\"https:\/\/gamesfray.com\/u-s-patent-examiner-rejects-nintendos-summon-subcharacter-and-let-it-fight-in-1-of-2-modes-patent-as-obvious-non-final-ruling\/\" class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">Games fray<\/a> reported that the USPTO rejected all claims of the patent in question, based on \u201dprior art\u201d references in the form of published U.S. patent applications. Games fray said two of those earlier patent applications were filed by Nintendo itself, and one each by Konami and Bandai Namco.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">It\u2019s worth noting that this rejection is non-final, so there\u2019s a long way to go before Nintendo accepts the decision. It may appeal, for example, which would drag this out even longer. But what will be of most importance is its potential impact on the lawsuit with Pocketpair, which has gone quiet since October last year.<\/p>\n<p>The Best Pok\u00e9mon Spin-off Games<img alt=\"When a franchise reaches the hulking size of Pok\u00e9mon, it finds its way into everything. The Pok\u00e9mon Company\u2019s games have touched almost every genre, we\u2019ve seen its characters rendered in almost every art style, and we\u2019ve seen them battle a pantheon of gods and monsters. A universe of Pok\u00e9mon games exists outside of the core series, and this month we\u2019re treated to a new major spin-off from the franchise in Pok\u00e9mon Pokopia.&lt;br&gt;&lt;br&gt;&#10;By moving away from the classic turn-based RPG formula, spin-off games allow us to see different shades of the Pokemon universe and experience it in a new light. While the core Pok\u00e9mon games can be boiled down to the competitive side of things, they\u2019re also about building an emotional attachment to your team, immersing yourself in this strange, utopic universe and, most importantly, being enchanted by the lore of the world and interacting with myths and legends. The best spin-offs focus on those other aspects and enhance that sense of wonder.&lt;br&gt;&lt;br&gt;&#10;With Pokopia having just landed, this is the perfect time to celebrate all the different ways the pocket monsters have deviated from their usual turn-based RPG roots, and rank the top 10 Pok\u00e9mon spin-off games.&#10;\" decoding=\"async\" class=\"progressive-image jsx-2021719738 image aspect-ratio aspect-ratio-16-9 jsx-2605834259 jsx-2338608387 hover-opacity\" loading=\"lazy\" src=\"data:image\/gif;base64,R0lGODlhAQABAIAAAAAAAP\/\/\/yH5BAEAAAAALAAAAAABAAEAAAIBRAA7\" data-cy=\"progressive-image\"\/><\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Palworld launched on Steam priced $30 and straight into Game Pass on Xbox and PC early 2024, breaking sales and concurrent player number records in the process. Pocketpair boss Takuro Mizobe has said Palworld&#8217;s launch was so big that the developer <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-says-massive-profits-are-too-big-for-a-studio-with-our-size-to-handle\" rel=\"nofollow noopener\" target=\"_blank\">couldn\u2019t handle the massive profits the game generated<\/a>. Still, Pocketpair acted swiftly to capitalize on Palworld\u2019s breakout success, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-dev-signs-deal-with-sony-to-form-palworld-entertainment-and-expand-the-ip\" rel=\"nofollow noopener\" target=\"_blank\">signing a deal with Sony<\/a> to form a new business called Palworld Entertainment that\u2019s tasked with expanding the IP. It later launched the game on PS5.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">After Palworld\u2019s huge launch, comparisons were made between Palworld\u2019s Pals and Pok\u00e9mon, with some accusing Pocketpair of &#8220;ripping off&#8221; Pok\u00e9mon designs. But rather than file a copyright infringement lawsuit, Nintendo and The Pok\u00e9mon Company went down the patent route. They want 5 million yen (approx $32,846) each plus late payment damages, as well as an injunction against Palworld that would block its release.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">The case involves <a href=\"https:\/\/www.pocketpair.jp\/news\/20241108\" class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">three main patents<\/a> granted in Japan: two related to monster capture and release, and one related to riding characters. All three patents were filed in 2024, after Palworld came out. However, they are actually derived from earlier Nintendo patents dating from 2021. In other words, it seems that once Palworld exploded onto the scene, Nintendo filed divisional patents that were geared to fight specifically against Palworld\u2019s alleged infringement of the original patents.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">Since then, Pocketpair <a href=\"https:\/\/www.pocketpair.jp\/news\/20250508\" class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">has made changes<\/a> to Palworld\u2019s disputed mechanics. A November 2024 patch, for example, removed the ability to summon Pals by throwing Pok\u00e9ball-like Pal Spheres. In May last year, another Palworld update changed how you can glide in the game. At the time, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-developer-pocketpair-says-its-being-forced-to-patch-the-game-due-to-nintendo-and-the-pokmon-companys-lawsuit\" rel=\"nofollow noopener\" target=\"_blank\">Pocketpair said it was being forced to patch Palworld due the lawsuit<\/a>.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">The case has rumbled on, with Nintendo even <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/nintendo-rewrites-patent-mid-case-in-ongoing-lawsuit-against-palworld-dev-pocketpair-but-why?_gl=1*9gbndy*_up*MQ..*_ga*MTEzNjgzNTkxNi4xNzYxODIzODEz*_ga_4L6HY9G8XE*czE3NjE4MjM4MTQkbzEkZzAkdDE3NjE4MjM4MTQkajYwJGwwJGgw\" rel=\"nofollow noopener\" target=\"_blank\">rewriting a mount-related patent mid-lawsuit<\/a>, and arguing that <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/nintendo-says-mods-dont-count-as-prior-art-as-theyre-not-full-games-attempting-to-sway-judge-in-palworld-lawsuit\" rel=\"nofollow noopener\" target=\"_blank\">mods should not count as prior art<\/a>.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">All eyes will be on Presiding Judge Motoyuki Nakashima, who leads the patent division of the Tokyo District Court. Meanwhile, Pocketpair has continued to update Palworld as it prepares for its 1.0 launch.<\/p>\n<p data-cy=\"paragraph\" class=\"paragraph jsx-2269604527\">At the Game Developers Conference (GDC) in March 2025, <a class=\"link jsx-1337145738 jsx-3925284146 underlined\" data-cy=\"styled-link\" href=\"https:\/\/www.ign.com\/articles\/palworld-communications-director-speaks-on-generative-ai-controversy-online-struggles-and-why-palworld-is-misunderstood\" rel=\"nofollow noopener\" target=\"_blank\">IGN sat down for an extended conversation with John \u201cBucky\u201d Buckley, communications director and publishing manager for Palworld developer Pocketpair<\/a>. We spoke following his talk at the conference, &#8216;Community Management Summit: A Palworld Roller Coaster: Surviving the Drop.&#8217; During that talk, Buckley went into candid detail about a number of Palworld\u2019s struggles, especially the accusations of it using generative AI and stealing Pokemon\u2019s models for its own Pals.
