{"id":539503,"date":"2026-04-19T14:17:08","date_gmt":"2026-04-19T14:17:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/539503\/"},"modified":"2026-04-19T14:17:08","modified_gmt":"2026-04-19T14:17:08","slug":"vodafone-incentivised-security-staff-to-fine-its-own-franchisees-vodafone","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/539503\/","title":{"rendered":"Vodafone incentivised security staff to fine its own franchisees | Vodafone"},"content":{"rendered":"<p class=\"dcr-130mj7b\">Vodafone incentivised its security staff to increase \u201cclawbacks\u201d levied on its own franchisees, as part of a programme that led to the telecoms group fining its own shopkeepers millions of pounds for seemingly small administrative errors.<\/p>\n<p class=\"dcr-130mj7b\">The policy \u2013 which included one alleged case of a <a href=\"https:\/\/www.theguardian.com\/business\/2025\/dec\/08\/ex-vodafone-franchisees-mental-health\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">\u00a310,000 penalty for a franchisee whose mistake cost Vodafone \u00a37.08<\/a> \u2013 involved setting \u201ckey performance indicators\u201d (KPIs) for the telecoms group\u2019s internal employees to collect total annual fines of \u00a31.5m from the small business people running the FTSE 100 company\u2019s high street stores.<\/p>\n<p class=\"dcr-130mj7b\">The existence of the fines regime has proved controversial for years and forms part of <a href=\"https:\/\/www.theguardian.com\/business\/2024\/dec\/10\/vodafone-store-managers-debts-franchise-operators-legal-claim\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">a high court claim<\/a> brought by 62 former Vodafone franchisees in 2024, who allege the mobile phone company \u201cunjustly enriched\u201d itself by up to \u00a385m by using tactics <a href=\"https:\/\/hansard.parliament.uk\/Commons\/2025-07-02\/debates\/C0DFB6C5-9907-4241-AA5F-900381038365\/CorporateBusinessesAndFranchiseesRegulatoryEnvironment?highlight=vodafone#contribution-98B3856B-5E75-4364-8AC0-9F2B0358702C\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">MPs have compared<\/a> to the Post Office Horizon IT scandal.<\/p>\n<p class=\"dcr-130mj7b\">The court filings include an allegation that Vodafone attempted \u201cto increase its revenue\u201d as \u201csenior staff members were tasked with and incentivised to implement\u201d fines, as part of a policy that the group has since tacitly admitted was flawed.<\/p>\n<p class=\"dcr-130mj7b\">In 2024, Vodafone told the Guardian: \u201cWe have made a number of changes to our formal processes and governance and made a series of goodwill payments to numerous franchisees. For example, we made the decision to reimburse \u00a34.9m including VAT [\u00a34m] across our franchise estate (this included retrospective reimbursement of fines and clawbacks).\u201d<\/p>\n<p class=\"dcr-130mj7b\">However, the Guardian has seen fresh details suggesting the company had specifically encouraged its own staff to increase the fines they were collecting from franchisees \u2013 while also ring-fencing the proceeds to reduce the cost of running the company\u2019s security department.<\/p>\n<p class=\"dcr-130mj7b\">While the company did not deny it had set its employees targets to increase penalties on its own partners, it stressed individuals were not \u201cfinancially\u201d incentivised to hit these goals.<\/p>\n<p class=\"dcr-130mj7b\">The cost to Vodafone of investigating each individual case is understood to have been \u00a333.20, according to former Vodafone staff members claiming knowledge of the programme, which is considerably below the \u00a3350 minimum fine given to a franchisee for a first infringement.<\/p>\n<p class=\"dcr-130mj7b\">Figures contained within an internal Vodafone document, dubbed the \u201cconsequence matrix\u201d, go on to detail how those charges quickly ramped up: a second violation within a three-month period resulted in the forfeiture of 15% of a franchisee\u2019s monthly commissions, rising to 30% for a third complaint.<\/p>\n<p class=\"dcr-130mj7b\">Franchisees could then suffer a reduction in the number of stores in their portfolio for a fourth complaint, while their franchise agreement could be terminated for a fifth offence during a 90-day rolling period, internal Vodafone records set out.<\/p>\n<p class=\"dcr-130mj7b\">The matrix did not appear to discriminate between small stores and much larger outlets situated on bustling high streets or in busy shopping centres, which were likely to attract higher numbers of customers, complaints and commissions \u2013 and, consequently, fines. Some of the larger Vodafone franchise stores are understood to have earned commissions anywhere between \u00a340,000 and \u00a3100,000 a month.<\/p>\n<p class=\"dcr-130mj7b\">The document also gives examples of possible offences that could lead to a franchisee being fined including \u201cnot checking [a] customer\u2019s delivery address\u201d, \u201cproviding incomplete information that leads to a customer coming back\u201d and \u201cnot applying the correct plan or discount\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Clawbacks form only a small part of the high court claim, with the most significant area concerning an allegation Vodafone imposed \u201can inexplicably drastic and patently irrational and\/or arbitrary cut to the claimants\u2019 commission\u201d when it \u201cvery substantially [preferred] its own interests without any or any proper justification, analysis, and\/or process\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Many franchisees claim the move <a href=\"https:\/\/www.theguardian.com\/business\/2024\/dec\/10\/vodafone-store-operators-commission-cuts-franchisees\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">left them with six-figure debts, anxiety about losing their homes<\/a> and a \u201c<a href=\"https:\/\/www.theguardian.com\/business\/2025\/sep\/22\/vodafone-franchisees-warned-of-massive-impact-of-commission-cuts-on-mental-health\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">massive impact<\/a>\u201d on their mental health.<\/p>\n<p class=\"dcr-130mj7b\">A spokesperson for Vodafone, which continues to contest the high court claim, said: \u201cWe conduct regular audits across our retail estate to ensure regulatory compliance and that our customers receive the service they deserve. On occasion, we have issued penalties to ensure these obligations are met.<\/p>\n<p class=\"dcr-130mj7b\">\u201cFines and clawbacks are not in place to generate profit. They are designed to discourage behaviours which could lead to poor customer outcomes and regulatory non-compliance.
