We\u2019ve only had two episodes available for streaming but from the way some people are going on you\u2019d think we\u2019d had seven hours of state-mandated footage we\u2019re forced to watch.<\/p>\n

Yes, I\u2019m talking about the massive reaction to the third season of Euphoria<\/a> so far.<\/p>\n

It seems to have quickly become a show this year that people are loving to watch and complain about or to have hot takes on.<\/p>\n

And that\u2019s partly thanks to some of its pretty wild scenes. The hit HBO show has already served up the likes of a gag-inducing drug-stuffing scene<\/a> with Rue (Zendaya) and Faye Valentine (Chloe Cherry), a racial slur<\/a> and numerous nude scenes from Cassie<\/a> (Sydney Sweeney).<\/p>\n

But a chunk of the reaction online has been over how Euphoria is actually allowed to show this kind of stuff, with nudity,<\/a> sex, drugs and swears flying.<\/p>\n

Well, it all comes down to how the show is accessed, basically.<\/p>\n

The US have a similar \u2018watershed\u2019 to the UK in that their law prohibits \u2018indecent and profane content\u2019 from being aired on TV or radio between the hours of 6am and 10pm. That\u2019s when the FCC says there is a \u2018reasonable risk that children may be in the audience\u2019. And Euphoria is shown in the US at 9pm ET on HBO.<\/p>\n

Here, our cut-off tends to be 9pm and Euphoria airs at 2am (thanks for that time difference America) or again at 10.15pm on Mondays. So, it\u2019s well beyond the watershed for Brits for it to be on TV.<\/p>\n

In the states, TV is regulated by the Federal Communications Commission (FCC<\/a>) with the \u2018obscene\u2019 category defined as having to meet the \u2018three-pronged test\u2019: \u201cIt must appeal to an average person’s prurient interest; depict or describe sexual conduct in a \u2018patently offensive\u2019 way; and, taken as a whole, lack serious literary, artistic, political or scientific value.\u201d<\/p>\n

And technically, the nude scenes<\/a> that seem to be filling Euphoria this year don\u2019t quite fit that \u2018obscene content\u2019 criteria \u2013 however, you might personally feel about seeing Sweeney have ice cream drip down<\/a> her, it\u2019s art.<\/p>\n

But it could maybe be argued to be close to \u2018indecent\u2019.<\/p>\n

The FCC defines that as things that \u2018portrays sexual or excretory organs or activities in a way that is patently offensive but does not meet the three-prong test for obscenity\u2019.<\/p>\n

The FCC has tried to fine networks in the past for wardrobe malfunctions on live TV, most famously when Justin Timberlake inadvertently exposed Janet Jackson’s nipple during the 2004 Super Bowl.<\/p>\n

In the end, the courts overturned the six-figure fine because the nudity was fleeting – unlike the stuff on Euphoria.<\/p>\n

\"AsAs Euphoria is on a subscription service, viewers are paying and the rules are different than broadcast. (HBO)<\/p>\n

As for \u2018profane content\u2019, this is defined as \u2018grossly offensive\u2019 language considered to be a \u2018public nuisance\u2019. So, it\u2019s that kind of thing that can\u2019t be shown in the US\u2019 watershed.<\/p>\n

Yet, Euphoria is somewhat exempt to this anyway because it\u2019s on HBO \u2013 a subscription service rather than a public channel.<\/p>\n

And the FCC explains: \u201cThe same rules for indecency and profanity do not apply to cable, satellite TV and satellite radio because they are subscription services.\u201d<\/p>\n
