{"id":553024,"date":"2026-04-27T09:29:14","date_gmt":"2026-04-27T09:29:14","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/553024\/"},"modified":"2026-04-27T09:29:14","modified_gmt":"2026-04-27T09:29:14","slug":"intervention-in-landmark-european-court-case-on-citizenship-rights-and-trafficking-shamima-begum-v-the-uk","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/553024\/","title":{"rendered":"Intervention in landmark European Court case on citizenship rights and trafficking: Shamima Begum v. the UK"},"content":{"rendered":"<p>On 10 April 2026, the Institute on Statelessness and Inclusion (ISI) and the International Commission of Jurists (ICJ) filed a joint third-party intervention in the landmark case before the European Court of Human Rights (ECtHR),\u00a0<a href=\"https:\/\/hudoc.echr.coe.int\/app\/conversion\/pdf\/?library=ECHR&amp;id=003-8422437-11918945&amp;filename=Notification%20to%20UK%20Government%20of%20case%20brought%20by%20Shamima%20Begum.pdf\" target=\"_blank\" rel=\"noopener nofollow\">Shamima Begum v. the United Kingdom<\/a>, making submissions on critical human rights concerns arising from trafficking, citizenship deprivation, and State responsibility under the\u00a0European Convention on Human Rights (ECHR).<\/p>\n<p>The intervention highlights that, under the ECHR, States cannot use citizenship stripping to evade their human rights obligations, particularly where there are credible indicators that an individual may have been a victim of trafficking.<\/p>\n<p>Drawing on international human rights law and standards, including those referenced in the <a href=\"https:\/\/files.institutesi.org\/PRINCIPLES.pdf\" target=\"_blank\" rel=\"noopener nofollow\">Principles on Deprivation of Nationality<\/a>, the intervention makes submissions on matters relevant to the Court\u2019s ultimate determination of the <a href=\"https:\/\/hudoc.echr.coe.int\/eng?i=001-247810\" rel=\"nofollow noopener\" target=\"_blank\">questions<\/a> it put to the parties, focusing on:<\/p>\n<p>Jurisdiction under the ECHR:\u00a0States may bear responsibility for harms occurring abroad where their actions or omissions contributed to those harms.<br \/>\nTrafficking: States have an ongoing obligation to identify, protect, and assist victims of trafficking under Article 4 of the ECHR \u2013 which enshrines the prohibition of slavery and forced labour \u2013 especially children, and this must inform their decisions, including on citizenship deprivation.<br \/>\nCitizenship deprivation:\u00a0 Decisions to remove citizenship must be assessed under both Article 4 and Article 8 of the ECHR \u2013 which guarantees the right to private and family life \u2013 with due regard to the individual\u2019s right to nationality and to safeguards against arbitrariness, discrimination and statelessness. Citizenship deprivation is analogous to a criminal prosecution and is a \u201cpenalty\u201d, raising serious concerns under the ECHR and international law more broadly.<\/p>\n<p>The ISI-ICJ joint intervention comes at a critical moment, as the ECtHR considers the State\u2019s duty to take into account trafficking risks and other human rights obligations whenever exercising citizenship deprivation powers.
