{"id":553648,"date":"2026-04-27T17:45:10","date_gmt":"2026-04-27T17:45:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/553648\/"},"modified":"2026-04-27T17:45:10","modified_gmt":"2026-04-27T17:45:10","slug":"swinney-will-call-vote-on-referendum-powers-after-scottish-elections-scotland","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/553648\/","title":{"rendered":"Swinney will call vote on referendum powers after Scottish elections | Scotland"},"content":{"rendered":"<p class=\"dcr-130mj7b\">John Swinney will call a vote seeking independence powers on the first day of the next Scottish parliament even if he fails to win an overall majority, his aides have said.<\/p>\n<p class=\"dcr-130mj7b\">The Scottish National Party leader\u2019s senior adviser indicated that if necessary, he would rely on support from the pro-independence Scottish Greens to win that vote in order to demand the UK government gives Holyrood the legal powers to hold a second referendum.<\/p>\n<p class=\"dcr-130mj7b\">Swinney <a href=\"https:\/\/www.theguardian.com\/politics\/2025\/oct\/11\/snp-backs-swinneys-clear-strategy-for-new-independence-referendum\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">told his party\u2019s conference last year<\/a> that an overall SNP majority was the \u201cclear and unambiguous\u201d precondition for seeking those powers \u2013 a stance reinforced in the party\u2019s 2026 manifesto.<\/p>\n<p class=\"dcr-130mj7b\">However, a strategy document unveiled by Swinney on Monday, setting out what an SNP government would do in its first 100 days, did not specify whether a majority was needed.<\/p>\n<p class=\"dcr-130mj7b\">The document said the SNP would \u201cbring forward\u201d a vote in early May on the parliament\u2019s first sitting day if the SNP took power, without any preconditions.<\/p>\n<p>Russell Findlay, the leader of the Scottish Conservatives, said the SNP was out of touch with its focus on independence. Photograph: Jane Barlow\/PA<\/p>\n<p class=\"dcr-130mj7b\">Swinney was asked repeatedly by reporters to say whether that vote would take place if he failed to win a majority, and he refused to do so. The first minister stressed he would prefer a majority but added: \u201cI\u2019m simply saying to people, vote SNP and let\u2019s get on with it.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Swinney\u2019s most senior policy aide told reporters the vote would take place even with a minority government. \u201cYou continue to pursue your agenda to the maximum amount, as all governments do,\u201d he said. \u201cIf we\u2019re elected as a government that manifesto stands. Otherwise what\u2019s the purpose of a manifesto? The whole manifesto stands.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The first 100 days document said the SNP would publish a draft referendum bill at a later date with the same yes or no question on independence from the 2014 referendum.<\/p>\n<p class=\"dcr-130mj7b\">If it is produced, that draft bill would have no legal standing and would be highly unlikely to be formally tabled at Holyrood. Attempts to do so by former first minister <a href=\"https:\/\/www.theguardian.com\/politics\/nicola-sturgeon\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Nicola Sturgeon<\/a> were blocked by the lord advocate, Scotland\u2019s chief law officer, because those powers are solely reserved to Westminster.<\/p>\n<p class=\"dcr-130mj7b\">The supreme court <a href=\"https:\/\/www.theguardian.com\/politics\/2022\/nov\/23\/scottish-independence-supreme-court-scottish-parliament-second-referendum-indyref2\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">ruled decisively in 2022<\/a> that only the UK government could legislate for an independence referendum \u2013 a decision that precipitated Sturgeon\u2019s resignation as first minister. The UK government has repeatedly said it would refuse to approve a referendum.<\/p>\n<p class=\"dcr-130mj7b\">Speaking on Monday, Swinney declined to say whether he would go to court in an attempt to force the UK government to delegate referendum powers if there was a majority vote at Holyrood.<\/p>\n<p class=\"dcr-130mj7b\">He has previously claimed a legal challenge would be based on the precedent set by the decision of the then Conservative-led UK government in 2012 to give Holyrood the powers. The UK government did so largely because the SNP had won an overall majority in 2011.<\/p>\n<p class=\"dcr-130mj7b\">Swinney\u2019s approach appears to have been markedly softened. He said on Monday a majority was \u201can incredibly strong foundational argument\u201d and did not confirm he planned legal action to secure those powers.<\/p>\n<p class=\"dcr-130mj7b\">He made clear, however, that he wanted to prove to all Scotland\u2019s pro-independence supporters that he was committed to making independence his utmost priority.<\/p>\n<p class=\"dcr-130mj7b\">He said: \u201cMy message to people in Scotland who are independence supporters is that I\u2019m offering a pathway for Scotland to have a choice to become independent [and] I would encourage any independence supporters to vote for the SNP to make sure that happens.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Repeated opinion polls suggest that while the SNP is on course for a comfortable victory on 7 May, only about 75% of Scotland\u2019s pro-independence voters will back the SNP.
