{"id":559707,"date":"2026-05-01T01:01:16","date_gmt":"2026-05-01T01:01:16","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/559707\/"},"modified":"2026-05-01T01:01:16","modified_gmt":"2026-05-01T01:01:16","slug":"british-soldiers-lost-control-in-1972-springhill-shootings-inquest-finds-northern-ireland","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/559707\/","title":{"rendered":"British soldiers lost control in 1972 Springhill shootings, inquest finds | Northern Ireland"},"content":{"rendered":"<p class=\"dcr-130mj7b\">British army soldiers \u201clost control\u201d and used force that was \u201cnot reasonable\u201d in the killing of five civilians in <a href=\"https:\/\/www.theguardian.com\/uk\/northernireland\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Northern Ireland<\/a> in 1972, an inquest judge has ruled.<\/p>\n<p class=\"dcr-130mj7b\">Four of the victims \u2013 two teenagers, a father of six and a Catholic priest \u2013 posed no risk when they were shot in the Springhill and Westrock areas of west <a href=\"https:\/\/www.theguardian.com\/uk\/belfast\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" rel=\"nofollow noopener\" target=\"_blank\">Belfast<\/a> on 9 July 1972, Mr Justice Scoffield said on Thursday.<\/p>\n<p class=\"dcr-130mj7b\">The blistering verdict about one of the most highly contested events of the Troubles said two soldiers, known as A and E, overreacted to perceived threats, fired prematurely and ultimately lost control.<\/p>\n<p class=\"dcr-130mj7b\">\u201cAll fatal shootings were found to have been carried out by soldiers acting in breach of the \u2018yellow card\u2019 rules governing the use of lethal force,\u201d the 640-page report said. Four of the dead were unarmed and it was unclear whether the fifth was armed, it said. \u201cNone of the deceased should have been shot in the circumstances.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The coroner said Father Noel Fitzpatrick, 42, a curate at Corpus Christi church, and Patrick Butler, 37, a Belfast Corporation refuse worker, were killed by the same bullet as they attempted to cross a road. Margaret Gargan, 13, was shot in the head while talking to friends. All three were deemed wholly innocent.<\/p>\n<p class=\"dcr-130mj7b\">David McCafferty, 15, was seeking to retrieve the priest\u2019s body when he was shot in the back, the coroner said. The court heard that he was a member of Na Fianna \u00c9ireann, the IRA youth wing, but was unarmed and not engaged in offensive activity and was considered an innocent victim.<\/p>\n<p class=\"dcr-130mj7b\">McCafferty\u2019s sister Betty Kennedy said the ruling brought \u201ca long-awaited clarity and justice\u201d to the family. \u201cThe passage of 54 years has been marked by profound grief, perseverance and unwavering pursuit of truth. David\u2019s name is now cleared,\u201d she said.<\/p>\n<p class=\"dcr-130mj7b\">The conduct of John Dougal, 16, before his death remained unclear and suspicious but he should not have been shot because he was probably fleeing to take cover, the coroner said.<\/p>\n<p class=\"dcr-130mj7b\">He rejected the explanation that the soldiers were reacting to a mass coordinated attack on a timber yard where their unit was based, and said brigade radio logs undermined that narrative.<\/p>\n<p class=\"dcr-130mj7b\">He noted the soldiers\u2019 youth and inexperience and their ignorance of the political context in what was the bloodiest year of the Troubles. The killings happened six months after <a href=\"https:\/\/www.theguardian.com\/uk\/bloodysunday\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">Bloody Sunday<\/a>, when soldiers opened fire on civil rights demonstrators in Derry.<\/p>\n<p class=\"dcr-130mj7b\">Soldier A, who killed Dougal, Fitzpatrick, Butler and McCafferty, fired from less than 100 metres away at Corry\u2019s timber yard without first assessing what risk, if any, they posed, the coroner said. Soldier E shot Gargan.<\/p>\n<p class=\"dcr-130mj7b\">The inquest judge apologised for the delay in the verdict, which came two years after hearings concluded. The inquest was the last one to complete before a 2024 guillotine on legacy court cases passed by the previous Conservative government.<\/p>\n<p class=\"dcr-130mj7b\">The Labour government is <a href=\"https:\/\/www.theguardian.com\/uk-news\/2025\/sep\/19\/british-irish-governments-troubles-legacy-proposals\" data-link-name=\"in body link\" rel=\"nofollow noopener\" target=\"_blank\">amending the legislation<\/a> but plans to keep the independent commission for reconciliation and information recovery, which was intended to replace inquests.<\/p>\n<p class=\"dcr-130mj7b\">Butler\u2019s daughter Natasha said the commission could not supply the same detailed narrative findings or give the same closure. \u201cWhat we have seen today in terms of Springhill shows that, even after 54 years, inquests can deliver some measure of truth,\u201d she said.<\/p>\n<p class=\"dcr-130mj7b\">Paul Maskey, the Sinn F\u00e9in MP for Belfast West, said the verdict confirmed a belief that the victims had posed no threat. \u201cThis massacre has long lived in the psyche of our community, and so too has the British army\u2019s impunity,\u201d he said.<\/p>\n","protected":false},"excerpt":{"rendered":"British army soldiers \u201clost control\u201d and used force that was \u201cnot reasonable\u201d in the killing of five civilians&hellip;\n","protected":false},"author":2,"featured_media":559708,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3],"tags":[59,57,58,50,56,54,55],"class_list":["post-559707","post","type-post","status-publish","format-standard","has-post-thumbnail","category-united-kingdom","tag-gb","tag-great-britain","tag-greatbritain","tag-news","tag-uk","tag-united-kingdom","tag-unitedkingdom"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/559707","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/comments?post=559707"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/559707\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media\/559708"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media?parent=559707"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/categories?post=559707"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/tags?post=559707"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
