{"id":625715,"date":"2026-06-07T09:09:06","date_gmt":"2026-06-07T09:09:06","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/625715\/"},"modified":"2026-06-07T09:09:06","modified_gmt":"2026-06-07T09:09:06","slug":"nhs-trust-agreed-28million-settlement-with-family","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/625715\/","title":{"rendered":"NHS trust agreed \u00a328million settlement with family"},"content":{"rendered":"<p>\n  Barking, Havering and Redbridge University Hospitals NHS Trust (BHRUT) acknowledged an error in the delivery of the girl who suffered severe hypoxia-ischaemia.\n<\/p>\n<p>\n  Lawyers for the family, who brought legal action at the High Court, said the girl, who is now of primary school age, will need lifelong care to alleviate her cognitive and language impairments and will need constant supervision as she has no danger awareness and is over-friendly with strangers.\n<\/p>\n<p>\n  She also has epilepsy with unpredictable seizures and is predicted to lose mobility throughout her life.\n<\/p>\n<p>\n  Despite her difficulties, she is finding joy through music therapy and is particularly fond of the piano and drums, which has boosted her confidence and communication abilities, the lawyers said.\n<\/p>\n<p>\n  Her mother said: \u201cMy daughter is thriving and doing well but it\u2019s impossible for me to forget that I was robbed of the precious experience of most mothers giving birth by the horror of what happened to us.\n<\/p>\n<p>\n  \u201cSeven years on, I\u2019m still deeply affected by seeing the hospital\u2019s name crop up in the press regarding tragedies for other families and their babies.\n<\/p>\n<p>\n  \u201cThis is despite the repeated promises of the Government and endless reviews into maternity safety. Surely someone must take the bull by the horns and take action to change things.\u201d\n<\/p>\n<p>\n  The order, approved by Deputy Judge Christopher Kennedy, says the trust must pay a lump sum of \u00a38 million, followed by an annual sum of \u00a3225,000 for 10 years, with further annual payments of \u00a3335,000 after that.\n<\/p>\n<p>\n  Health secretary James Murray said on Monday (June 4) that recommendations for NHS maternity services must not sit \u201con shelves\u201d and that the reforms must be \u201ccomprehensive\u201d.\n<\/p>\n<p>\n  He told the BBC he has been meeting families whose babies died, which \u201cbrings it home in the strongest possible sense, how human and how devastating this can be, and how important it is that we change\u201d.\n<\/p>\n<p>\n  Jane Weakley from Fieldfisher, who represented the family in the negligence claim, said: \u201cToo many times the medical negligence team at Fieldfisher takes on cases where the same terrible mistakes are repeated, bringing untold tragedy.\n<\/p>\n<p>\n  &#8220;We fully support the NHS and appeal to the government to please fulfil their promise to make maternity care safe for mothers and babies.\u201d\n<\/p>\n<p>\n  Nic Kane, chief nurse at BHRUT, said: \u201cWe\u2019re extremely sorry the care this child and their family experienced was not good enough.\n<\/p>\n<p>\n  \u201cWe\u2019d like to reassure them, and all our expectant mothers, that since this birth in 2019, we\u2019ve learned lessons, made significant changes, and our maternity department has been rated good by the Care Quality Commission.\n<\/p>\n<p>\n  \u201cThe improvements include more obstetric and midwifery staff in triage to ensure women are reviewed and concerns escalated quicker, more robust training on CTG monitoring \u2013 used to monitor the baby\u2019s heart rate and mother\u2019s contractions \u2013 and we are part of a national programme, run by the Royal College of Obstetricians and Gynaecologists, which focuses on reducing the risk of avoidable harm in childbirth.\u201d\n<\/p>\n<p>\n  Reporting by PA.<\/p>\n","protected":false},"excerpt":{"rendered":"Barking, Havering and Redbridge University Hospitals NHS Trust (BHRUT) acknowledged an error in the delivery of the girl&hellip;\n","protected":false},"author":2,"featured_media":625716,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[43],"tags":[102,2960,56,54,55],"class_list":["post-625715","post","type-post","status-publish","format-standard","has-post-thumbnail","category-healthcare","tag-health","tag-healthcare","tag-uk","tag-united-kingdom","tag-unitedkingdom"],"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/625715","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/comments?post=625715"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/posts\/625715\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media\/625716"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/media?parent=625715"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/categories?post=625715"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/uk\/wp-json\/wp\/v2\/tags?post=625715"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
