{"id":726208,"date":"2026-08-03T15:26:11","date_gmt":"2026-08-03T15:26:11","guid":{"rendered":"https:\/\/www.newsbeep.com\/uk\/726208\/"},"modified":"2026-08-03T15:26:11","modified_gmt":"2026-08-03T15:26:11","slug":"trump-administration-moves-to-block-public-from-enforcing-environmental-protection-laws","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/uk\/726208\/","title":{"rendered":"Trump administration moves to block public from enforcing environmental protection laws"},"content":{"rendered":"<p>Reducing <a href=\"https:\/\/theconversation.com\/the-us-used-to-be-really-dirty-environmental-cleanup-laws-have-made-a-huge-difference-271277\" rel=\"nofollow noopener\" target=\"_blank\">rampant pollution across the United States<\/a> was so important that when Congress passed many environmental protection laws, including the Clean Air Act, Clean Water Act and Safe Drinking Water Act, it didn\u2019t want to leave enforcement only to the executive branch.<\/p>\n<p>Congress specifically wrote into those laws ways for citizens to enforce them through the courts when the government does not act to address the problem. Called \u201c<a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/7604\" rel=\"nofollow noopener\" target=\"_blank\">citizen suit provisions<\/a>,\u201d those parts of the laws allow regular people and advocacy groups to sue companies they believe are violating the law. Citizens can also sue federal agencies that fail to enforce the laws. <\/p>\n<p>Since the 1970s, those provisions have been used in over <a href=\"https:\/\/ssrn.com\/abstract=1334218\" rel=\"nofollow noopener\" target=\"_blank\">2,000 lawsuits<\/a>. In fact, a majority of environmental cases are citizen suit cases. Citizen suits have been used to <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/437\/153\/\" rel=\"nofollow noopener\" target=\"_blank\">halt the construction of dams to protect endangered species<\/a>, <a href=\"https:\/\/earthjustice.org\/wp-content\/uploads\/18-260_5i36_scotus-maui.pdf\" rel=\"nofollow noopener\" target=\"_blank\">end the injection of wastewater into groundwater<\/a>, and <a href=\"https:\/\/www.nelc.org\/news\/supreme-court-confirms-exxons-liability-in-16-year-clean-air-citizen-suit\/\" rel=\"nofollow noopener\" target=\"_blank\">secure US$14.2 million in civil penalties<\/a> for illegal emissions from a petrochemical facility. In short, these cases have shaped modern environmental law.<\/p>\n<p>Now, in a legal filing, the Trump administration is saying <a href=\"https:\/\/www.justice.gov\/opa\/media\/1446141\/dl?inline\" rel=\"nofollow noopener\" target=\"_blank\">citizens should not be allowed<\/a> to enforce environmental laws. Rather, despite what the laws say, the U.S. Department of Justice has claimed in a case involving Elon Musk\u2019s xAI that people should be required to leave enforcement to the executive branch \u2013 even if the executive decides to take no action.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/751449\/original\/file-20260731-50-2cliiv.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A large industrial building complex sits alongside a river.\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2026\/08\/file-20260731-50-2cliiv.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              The Clairton Coke Works in Clairton, Penn., was forced to clean up its emissions and more effectively monitor pollution in a settlement of a citizen suit under the Clean Air Act.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/steels-clairton-coke-works-rests-along-the-monongahela-news-photo\/2190741650\" rel=\"nofollow noopener\" target=\"_blank\">Rebecca Droke\/AFP via Getty Images<\/a><\/p>\n<p>A history of success<\/p>\n<p>For more than 50 years, citizen suits have been an effective part of cleaning up the environment in the U.S. The process is fairly straightforward: A person or group must send a formal notification to the person, company or agency they suspect of violating the law \u2013 with a copy to the U.S. Environmental Protection Agency. If after 60 days the problem is not rectified, the people can sue. <\/p>\n<p>Citizen suits often ask the courts to order a <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/33\/1365\" rel=\"nofollow noopener\" target=\"_blank\">stop to the polluting activity<\/a>, payments for <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/42\/7604\" rel=\"nofollow noopener\" target=\"_blank\">reducing or cleaning up the harm done<\/a>, and civil penalties paid to the government. But if the government has already begun an enforcement action or is actively prosecuting the violator, a citizen suit cannot proceed.<\/p>\n<p>The success of these cases depends on the ability of the plaintiff to prove a violation of the law. Violations of the Clean Water Act are somewhat easier to prove than violations of other statutes because the simple act of <a href=\"https:\/\/www.epa.gov\/cwa-404\/clean-water-act-section-402-national-pollutant-discharge-elimination-system\" rel=\"nofollow noopener\" target=\"_blank\">discharging a pollutant without a permit<\/a> is a violation of the law. As a result, <a href=\"https:\/\/digitalcommons.pace.edu\/cgi\/viewcontent.cgi?article=1932&amp;context=lawfaculty\" rel=\"nofollow noopener\" target=\"_blank\">more citizen suit provisions<\/a> have been brought under the Clean Water Act than under any other environmental statute.<\/p>\n<p>In my area of research, <a href=\"https:\/\/scholar.google.com\/citations?hl=en&amp;user=WlPnMAkAAAAJ&amp;view_op=list_works&amp;sortby=pubdate\" rel=\"nofollow noopener\" target=\"_blank\">plastic pollution<\/a>, citizen suits have been used to hold plastic pellet manufacturers responsible for pollution. For example, the citizen suit provision of the Clean Water Act allowed <a href=\"https:\/\/www.goldmanprize.org\/recipient\/diane-wilson\/\" rel=\"nofollow noopener\" target=\"_blank\">Diane Wilson<\/a>, a shrimper from Texas\u2019 Gulf Coast, to sue Formosa Plastics in 2017 for persistent discharges of plastic pellets into Lavaca Bay, where some shrimp were caught, and which is connected to the Gulf of Mexico. In 2019, Formosa ended <a href=\"https:\/\/www.courthousenews.com\/wp-content\/uploads\/2019\/10\/formosa-consent.pdf\" rel=\"nofollow noopener\" target=\"_blank\">up settling for $50 million<\/a> to <a href=\"https:\/\/www.chron.com\/gulf-coast\/article\/texas-gulf-coast-pollution-settlement-20051288.php\" rel=\"nofollow noopener\" target=\"_blank\">pay for mitigation and remediation<\/a> projects in the bay, cleaning up plastic and other pollution. Formosa also agreed to pay court costs and attorneys fees.<\/p>\n<p>In another example, the environmental advocacy groups PennEnvironment and Three Rivers Waterkeeper in 2023 sued Styropek USA, which manufactured expandable polystyrene used for packaging and shipping, over pellet discharges into a western Pennsylvania creek. The pellets attracted and collected other toxic chemicals and were <a href=\"https:\/\/www.nelc.org\/cases\/pennenvironment-three-rivers-waterkeeper-v-bvpv-styrenics-llc-and-styropek-usa-inc\/\" rel=\"nofollow noopener\" target=\"_blank\">harming local aquatic plants and fish<\/a>. In 2025, <a href=\"https:\/\/www.nelc.org\/wp-content\/uploads\/2025\/09\/Proposed-Consent-Decree-Styropek.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Styropek settled<\/a> for $2.5 million. As part of the settlement agreement, Styropek agreed to install filters in the facility\u2019s wastewater and stormwater systems to capture plastic pellets before they reached Raccoon Creek or the Ohio River. Styropek also had to eliminate the unauthorized discharge of plastic pellets from all of the facility\u2019s stormwater drains.<\/p>\n<p>Citizen suit provisions are not included in every law. But they have arisen in other contexts. For instance, a 2025 Texas state law seeks to restrict abortion rights and <a href=\"https:\/\/www.cbsnews.com\/news\/texas-senate-passes-bill-curbs-abortion-pills-mailing-into-state\/\" rel=\"nofollow noopener\" target=\"_blank\">allows any citizen to sue doctors<\/a> or other medical providers who perform or assist with abortions.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/751291\/original\/file-20260730-50-6sldyt.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A person speaks at a lectern in a public meeting room.\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2026\/08\/file-20260730-50-6sldyt.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              Residents of Southaven, Miss., have publicly objected to the operation of gas-fired turbines to power a data center in their community.<br \/>\n              <a class=\"source\" href=\"https:\/\/newsroom.ap.org\/detail\/xAIMississippi\/2d5d7869c8754568b4180f943de7526c\/photo\" rel=\"nofollow noopener\" target=\"_blank\">AP Photo\/Adrian Sainz<\/a><\/p>\n<p>NAACP v. xAI<\/p>\n<p>In April 2026, using the citizen suit provision of the Clean Air Act, the NAACP, a nationwide civil rights organization, <a href=\"https:\/\/naacp.org\/articles\/naacp-sues-xai-illegal-pollution-data-center-power-plant\" rel=\"nofollow noopener\" target=\"_blank\">sued xAI<\/a>, an artificial intelligence company founded by Elon Musk, in federal court. <\/p>\n<p>The NAACP alleged that xAI and a subsidiary company built and operated 27 natural gas-fired turbines in Southaven, Mississippi, without the required Clean Air Act permits. The turbines generated electricity to power xAI\u2019s nearby Colossus 2 data center. The NAACP alleged that the <a href=\"https:\/\/www.courtlistener.com\/docket\/73188848\/national-association-for-the-advancement-of-colored-people-v-xai-corp\/\" rel=\"nofollow noopener\" target=\"_blank\">gas plant released harmful pollutants<\/a>, such as nitrogen oxides and formaldehyde, which can increase rates of asthma, respiratory diseases, heart problems and certain cancers.<\/p>\n<p>Had xAI <a href=\"https:\/\/eelp.law.harvard.edu\/tracker\/new-source-review\/\" rel=\"nofollow noopener\" target=\"_blank\">applied for a permit<\/a> to operate the turbines under the Clean Air Act, the EPA  would have required xAI to use the best available technology to reduce those emissions. But <a href=\"https:\/\/www.politico.com\/news\/2026\/01\/22\/epa-thwarts-musks-diesel-turbines-ai-00737605\" rel=\"nofollow noopener\" target=\"_blank\">xAI never applied to the EPA<\/a> for a permit.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/751305\/original\/file-20260730-50-q5waom.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A view across a grassy area of large metal industrial boxes.\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2026\/08\/file-20260730-50-q5waom.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              Artificial intelligence company xAI operates a data center powered by gas-fired turbines in Tennessee as well as one in Mississippi that\u2019s the subject of an antipollution lawsuit.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/gas-turbines-are-visible-at-an-xai-data-center-on-riverport-news-photo\/2217198328\" rel=\"nofollow noopener\" target=\"_blank\">Brandon Dill for The Washington Post via Getty Images<\/a><\/p>\n<p>A request from the federal government<\/p>\n<p>In June 2026, the U.S. Department of Justice asked the judge to dismiss the case, claiming, among other arguments, that <a href=\"https:\/\/www.justice.gov\/opa\/media\/1446141\/dl?inline\" rel=\"nofollow noopener\" target=\"_blank\">citizen suits cannot proceed<\/a> when the federal government does not oppose the polluting behavior. <\/p>\n<p>The Justice Department\u2019s court filing cited two executive orders signed by President Donald Trump within days of the start of his second term \u2013 one declaring a \u201c<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/declaring-a-national-energy-emergency\/\" rel=\"nofollow noopener\" target=\"_blank\">national energy emergency<\/a>\u201d and the other seeking to support \u201c<a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/removing-barriers-to-american-leadership-in-artificial-intelligence\/\" rel=\"nofollow noopener\" target=\"_blank\">American leadership in artificial intelligence<\/a>.\u201d<\/p>\n<p>According to the Justice Department, the NAACP\u2019s lawsuit threatens \u201cartificial intelligence innovation\u201d and national security. The <a href=\"https:\/\/www.justice.gov\/opa\/media\/1446141\/dl?inline\" rel=\"nofollow noopener\" target=\"_blank\">government\u2019s filing goes on to argue<\/a> that citizen lawsuits were not intended to allow everyday citizens to enforce laws in ways that go against what the federal government deems is in the public interest.<\/p>\n<p>Instead, the Justice Department claimed, citizen suits should be allowed by the court only when the government fails to enforce the statute, and not when the government has decided that executive branch policy means enforcement action is contrary to the public interest.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/751288\/original\/file-20260730-50-ntbbr9.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A man speaks into a microphone and gestures with his other hand in front of a sign saying 'dirty lie.'\" src=\"https:\/\/www.newsbeep.com\/uk\/wp-content\/uploads\/2026\/08\/file-20260730-50-ntbbr9.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              In the late 1990s, Robert F. Kennedy Jr. used citizen suit provisions to force environmental cleanups of industrial pollution in the Hudson River.<br \/>\n              <a class=\"source\" href=\"https:\/\/newsroom.ap.org\/detail\/CoalExports\/470d97f3e23f44288f64e6fcd6eb666e\/photo\" rel=\"nofollow noopener\" target=\"_blank\">AP Photo\/Rick Bowmer<\/a><\/p>\n<p>Conflict between the government and the public<\/p>\n<p>This is the first time the Justice Department has taken this position in court. But defendants and <a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/528\/167\" rel=\"nofollow noopener\" target=\"_blank\">judges have questioned<\/a> the constitutionality of citizen suits in the past.<\/p>\n<p>Some critics, including the Trump administration, view citizen suits as a way for citizens to <a href=\"https:\/\/www.justice.gov\/opa\/media\/1446141\/dl?inline\" rel=\"nofollow noopener\" target=\"_blank\">usurp the executive branch\u2019s prosecutorial authority<\/a>.
