Prosecutors have said that a fraud case would have depended on demonstrating that any individual who solicited funds for the indyref campaign did so with the specific intention of defrauding contributors.

In August 2024, police submitted a request to the Crown Office for advice and guidance on Sturgeon. It did not seek prosecution for embezzlement or fraud, but focused on whether there should be further investigation, officials said previously.

The Crown Office has also said that the decision not to charge Sturgeon was not marginal or finely balanced, and that the conclusion had been considered independently by a KC.

Stuart Campbell runs the Wings Over Scotland blog (Image: Archive)

However, Wings Over Scotland blogger Stuart Campbell has been pushing for police to re-open the investigation into the SNP over the £600,000 raised for a second referendum campaign, pointing to First Minister John Swinney’s admission in June that the money had been spent on the day-to-day expenses of the SNP.

Campbell has threatened to take Police Scotland to court over the case, with his lawyers alleging that the force had not given “proper, intelligible, and adequate reasons for declining to investigate”.

Speaking to The Times, the Scottish Information Commissioner said he was “not particularly confident that the likes of Stuart Campbell is going to go away quietly”.

Hamilton said: “The Crown Office is an interesting one, because never more has there been questions about some of their decisions.

READ MORE: Two island community organisation face bankruptcy after legal row with American

“Now, I’m not saying they’re the wrong decisions.
