The Fair Work Commission (FWC) is <a data-i13n=\"cpos:2;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/major-work-from-home-update-impacting-millions-of-aussie-workers-disrupt-push-back-to-office-024610780.html\" data-ylk=\"slk:currently investigating whether changes need to be made;cpos:2;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">currently investigating whether changes need to be made<\/a> to the Clerks Award, a test case that could spark similar adjustments to other work contracts across the country.<\/p>\n<p class=\"yf-1090901\">The Australian Services Union (ASU) believes <a data-i13n=\"cpos:3;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/work-from-home-shift-for-millions-of-aussies-as-clear-link-with-salaries-revealed-300000-or-more-235800601.html\" data-ylk=\"slk:staff deserve to have the right to work from home;cpos:3;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">staff deserve to have the right to work from home<\/a> (WFH), but if circumstances change, they need to have enough time to get their affairs in order. ASU national secretary Emeline Gaske said this clause would be essential to workers who <a data-i13n=\"cpos:4;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/warning-for-working-from-home-aussies-over-common-practice-employer-has-the-legal-right-200058440.html\" data-ylk=\"slk:might have certain commitments;cpos:4;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">might have certain commitments<\/a>.<\/p>\n<p class=\"yf-1090901\">\u201cA fair notice period is a critical protection that recognises the reality of people\u2019s lives. For many people, particularly women, working from home is deeply integrated into how they manage their family and caring responsibilities.<\/p>\n<p class=\"yf-1090901\">\u201cSuddenly removing that arrangement isn\u2019t a simple change \u2013 it pulls a thread that can unravel a family\u2019s entire routine.<\/p>\n<p class=\"yf-1090901\">&#8220;It means finding new after-school care where there are often long waiting lists, rearranging transport, or finding alternative support for an elderly parent.\u201d<\/p>\n<p class=\"yf-1090901\">Big-name companies like <a data-i13n=\"cpos:8;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/amazon-orders-7000-aussie-workers-back-into-the-office-5-days-a-week-015050102.html\" data-ylk=\"slk:Amazon;cpos:8;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">Amazon<\/a>, <a data-i13n=\"cpos:9;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/woolworths-jumps-on-major-work-from-home-trend-for-10000-workers-key-priority-043427327.html\" data-ylk=\"slk:Woolworths;cpos:9;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">Woolworths<\/a>, and <a data-i13n=\"cpos:10;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/coles-orders-thousands-back-to-office-as-australias-work-from-home-resistance-builds-214325578.html\" data-ylk=\"slk:Coles;cpos:10;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">Coles<\/a> have told staff they have to return to the office after several years of WFH privileges.<\/p>\n<p class=\"yf-1090901\">Do you have a story? Email stew.perrie@yahooinc.com<\/p>\n<p class=\"yf-1090901\">Some only have to come in a few days, while others now have to come back from Monday to Friday, as it was before the pandemic.<\/p>\n<p class=\"yf-1090901\">Some offices have adopted a staggered approach to give workers time to adjust, while others have only been given a <a data-i13n=\"cpos:11;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/major-work-from-home-turning-point-as-employees-return-the-office-worst-behind-us-003808446.html\" data-ylk=\"slk:few weeks to go from full WFH to being in the office full-time;cpos:11;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">few weeks to go from full WFH to being in the office full-time<\/a>.<\/p>\n<p class=\"yf-1090901\">Gaske wants to prevent that latter circumstance from happening to people on the Clerks Award, as the union believes employers shouldn&#8217;t be able to &#8216;pull the rug out from under their employees&#8217;.<\/p>\n<p class=\"yf-1090901\">The ASU has submitted its proposal to the FWC over how WFH rights should operate for the roughly 1.8 million workers on the Clerks Award.<\/p>\n<p class=\"yf-1090901\">At the moment, these workers <a data-i13n=\"cpos:12;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/work-from-home-warning-after-aussie-dads-request-denied-in-new-ruling-troubling-235242495.html\" data-ylk=\"slk:have the right to make a WFH request;cpos:12;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">have the right to make a WFH request<\/a> and explain why they should be allowed to do it.<\/p>\n<p class=\"yf-1090901\">But this is only available to workers who have been with their employer for at least 12 months and are pregnant, a parent, someone with a disability, over the age of 55, a carer, or someone experiencing domestic violence.<\/p>\n<p> Story Continues <\/p>\n<p class=\"yf-1090901\">The ASU wants there to be a built-in presumption that when a staff member applies to work remotely, it will be approved.<\/p>\n<p class=\"yf-1090901\">The employer and employee would have to try to reach an agreement to accommodate the staff member&#8217;s request, and if that can&#8217;t be done, then the worker would need at least 26 weeks&#8217; notice before returning to the office.<\/p>\n<p class=\"yf-1090901\">This would also apply to employers seeking to vary or pause a worker&#8217;s current WFH setup.<\/p>\n<p class=\"yf-1090901\">An ASU survey recently found a whopping 98 per cent of respondents felt WFH rights were important or extremely important to them.<\/p>\n<p class=\"yf-1090901\">A separate poll of nearly 8,500 Yahoo Finance readers discovered 59 per cent would leave their job if they couldn&#8217;t work from home.<\/p>\n<p>  <img decoding=\"async\" src=\"data:image\/gif;base64,R0lGODlhAQABAIAAAAAAAP\/\/\/ywAAAAAAQABAAACAUwAOw==\" alt=\"ASU national secretary Emeline Gaske\" loading=\"lazy\" height=\"517\" width=\"960\" class=\"yf-1gfnohs loader\"\/> ASU national secretary Emeline Gaske said workers need to be given enough time to adjust to return-to-office mandates. (Source: AAP)    <\/p>\n<p class=\"yf-1090901\">New research from Roy Morgan also found 46 per cent of employed Australians <a data-i13n=\"cpos:13;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/work-from-home-warning-after-aussie-dads-request-denied-in-new-ruling-troubling-235242495.html\" data-ylk=\"slk:work from home;cpos:13;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">work from home<\/a> at least some of the time, with that figure rising to 51 per cent for <a data-i13n=\"cpos:14;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/topic\/work\/\" data-ylk=\"slk:full-time workers;cpos:14;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \" rel=\"nofollow noopener\" target=\"_blank\">full-time workers<\/a>.<\/p>\n<p class=\"yf-1090901\">The union said this should serve as a wake-up call for bosses that things have changed massively since 2019.<\/p>\n<p class=\"yf-1090901\">\u201cWorking from home is now a permanent feature of the modern Australian workplace, and our submission will make it clear that the location of work does not diminish its value,\u201d Gaske said.<\/p>\n<p class=\"yf-1090901\">The ASU&#8217;s submission comes after <a data-i13n=\"cpos:15;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/work-from-home-rights-could-cost-18-million-australians-their-penalty-rates-230004263.html\" data-ylk=\"slk:other groups have proposed to the FWC;cpos:15;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">other groups have proposed to the FWC<\/a> that WFH rights could continue to operate, but workers might have to give up certain work perks like <a data-i13n=\"cpos:16;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/woolworths-coles-kmart-penalty-rate-fight-intensifies-in-major-intervention-for-353200-workers-213249121.html\" data-ylk=\"slk:penalty rates;cpos:16;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">penalty rates<\/a>, minimum hour requirements, <a data-i13n=\"cpos:17;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/topic\/money\/\" data-ylk=\"slk:overtime pay;cpos:17;pos:1;elm:context_link;itc:0;sec:content-canvas\" class=\"link \" rel=\"nofollow noopener\" target=\"_blank\">overtime pay<\/a>, and rest breaks.<\/p>\n<p class=\"yf-1090901\">The Clerks Award covers roles such as administrative assistants, receptionists, and bookkeepers.<\/p>\n<p class=\"yf-1090901\">HR expert Lara Nercessian <a data-i13n=\"cpos:18;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/major-work-from-home-update-impacting-millions-of-aussie-workers-disrupt-push-back-to-office-024610780.html\" data-ylk=\"slk:told Yahoo Finance;cpos:18;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">told Yahoo Finance<\/a>\u00a0a lot is riding on the FWC investigation, as it could start a domino effect with other work contracts.<\/p>\n<p class=\"yf-1090901\">&#8220;A lot of businesses and organisations are going to be quite apprehensive in terms of the way that this unfolds,&#8221; she said.<\/p>\n<p class=\"yf-1090901\">&#8220;After their significant efforts and attempts to get people back into the office full-time, I think a lot of organisations may see it as undoing the work that they&#8217;ve done.&#8221;<\/p>\n<p class=\"yf-1090901\">But this also comes at a time when moves are being made to protect WFH rights for all workers in two Aussie states.<\/p>\n<p class=\"yf-1090901\">The Victorian government <a data-i13n=\"cpos:19;pos:1\" href=\"https:\/\/au.news.yahoo.com\/home-legal-australian-first-reform-200000220.html\" data-ylk=\"slk:wants to enshrine a legal right;cpos:19;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">wants to enshrine a legal right<\/a> for employees to WFH at least two days a week.<\/p>\n<p class=\"yf-1090901\">It&#8217;s the first attempt at a state-wide mandate for public and private sector workers who could reasonably do their work from home.<\/p>\n<p class=\"yf-1090901\">The South Australian Greens are <a data-i13n=\"cpos:20;pos:1\" href=\"https:\/\/au.finance.yahoo.com\/news\/drive-wedge-divide-over-wfh-052313269.html\" data-ylk=\"slk:also preparing a bill;cpos:20;pos:1;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" rel=\"nofollow noopener\" target=\"_blank\">also preparing a bill<\/a> that could grant public sector workers the right to work from home at least one day a week.<\/p>\n<p class=\"yf-1090901\">But state Premier, Peter Malinauskas, has already indicated the proposal won&#8217;t go very far.<\/p>\n<p class=\"yf-1090901\">\u201cTo mandate things, I think, runs the risk of having unintended consequences,\u201d he said.<\/p>\n<p class=\"yf-1090901\">\u201cAnd occasionally I think employers should have the ability to say, \u2018Look, we\u2019re paying you to do a particular task and this is where I need you to perform those tasks.'&#8221;<\/p>\n<p class=\"yf-1090901\">Get the latest Yahoo Finance news &#8211;
