Halle Berry\u2019s daughter, Nahla Aubry, is coming to her mom\u2019s defense after the actress\u2019 ex-husband Olivier Martinez accused her of abuse against their teen son<\/a>. <\/p>\n

Nahla, whom Berry had with ex-boyfriend Gabriel Aubry, described her mom as a \u201cloving and devoted parent\u201d who \u201ccan be strict when necessary,\u201d according to a declaration filed in Los Angeles Superior Court and obtained by Page Six.<\/p>\n

The 18-year-old claimed she never witnessed the actress physically abuse her younger brother, Maceo Martinez, 13, writing, \u201cI have never seen my mom hit, slap, choke, grab, or physically abuse Maceo in any way.\u201d<\/p>\n

She added, \u201cI have never seen my mom place her hands around Maceo\u2019s neck, put him in a chokehold, restrict his breathing, or engage in any conduct remotely resembling the allegations that have been made against her.\u201d<\/p>\n

Nahla said she has lived with Maceo for most of his life, splitting her time between Berry\u2019s home and her father Aubry\u2019s residence before recently moving from California to Massachusetts to attend college.<\/p>\n

She described Berry, 60, as a hands-on mother who \u201calways made time for me and prioritized what was important to me,\u201d adding that she has watched her mom do the same for Maceo.<\/p>\n

\u201cShe attended his games, drove him to practices and tournaments and advocated for his education,\u201d Nahla stated. \u201cShe celebrates our successes, supports us through challenges and is always there when we need her.\u201d<\/p>\n

Nahla also acknowledged that her mother can be a disciplinarian, adding, \u201cMy mom is a loving and devoted parent. She can be strict when necessary and expects her children to follow rules and be respectful. At the same time, she is warm, supportive and deeply involved in our lives.<\/p>\n

The 18-year-old said she was \u201cshocked, very sad and very upset\u201d when she learned of Martinez\u2019s allegations<\/a> against Berry.<\/p>\n

Nahla added she was \u201cheartbroken\u201d for her younger brother, whom she described as \u201cfunny, smart and full of personality.\u201d<\/p>\n

Nahla pushed back on another allegation Martinez made against Berry, saying she had never heard her mother make \u201cracially insensitive or racially charged comments.\u201d<\/p>\n

\u201cMy mom is biracial, I am biracial and Maceo is biracial,\u201d she wrote. \u201cThroughout my life, my mom taught both of us to embrace who we are, appreciate our differences and respect people from all backgrounds.\u201d<\/p>\n

Nahla said she last spoke with Maceo on Sept. 29, when Berry was driving him to school. She said they spoke on speakerphone about her college experience and that Maceo \u201csounded happy for me and didn\u2019t seem upset about anything.\u201d<\/p>\n

\u201cI want very much to speak with my brother and check on him. I want him to know that I love him,\u201d she stated, adding she has refrained from reaching out because she is uncertain what is permitted under Martinez\u2019s court filings.<\/p>\n

The declaration comes after Martinez, 60, accused Berry of choking Maceo<\/a> during an alleged Sept. 26 altercation at her home in a restraining order request.<\/p>\n

Martinez claimed in court documents that Berry grabbed their son by the neck and choked him during an argument that began while Maceo was playing a virtual reality game. <\/p>\n

He also alleged Berry had physically wrestled with Maceo on previous occasions and made racially charged remarks to their son.<\/p>\n

Martinez subsequently sought sole custody of Maceo, and a judge temporarily granted him primary custody while restricting Berry to court-ordered visitation to two days a week and every other weekend until their next hearing Oct. 16.<\/p>\n

Berry has vehemently denied the allegations through her attorney, Marina Beck.<\/p>\n

\u201cThere is voluminous evidence, including numerous judicial rulings, that Olivier Martinez repeatedly violated court orders and interfered with necessary therapeutic and educational interventions to the detriment of his and Halle Berry\u2019s minor son, Maceo \u2014 misconduct for which Mr. Martinez has already been legally sanctioned,\u201d the actress\u2019 lawyer told Page Six<\/a> on Oct. 1.<\/p>\n

In her response to Martinez\u2019s filing<\/a>, she requested that the court reinstate their 50\/50 custody agreement.<\/p>\n

She claimed Martinez causes Maceo to be \u201cangry and combative\u201d at her due to his \u201ccontinued attempts to align Maceo with him and against me in many areas of our child\u2019s life and activities.\u201d<\/p>\n

Berry was seen in Los Angeles with her son<\/a> days after the restraining order filing. <\/p>\n
