But Leicestershire’s approach was heavily criticised by the CDP in a scathing decision published on Wednesday, more than five weeks since the end of the Championship season.

Richard Whittam KC, the CDP’s chair, said Leicestershire had shown “a woeful lack of understanding” of the regulatory process and that the club had “gambled” by deciding not to hire lawyers for the initial hearing in the hope that they could “have another go” at an appeal. Whittam added in his judgement: “The club is the author of its own misfortune.”

The judgement published on Wednesday also made clear how close the match in question – Leicestershire’s win over Glamorgan at Uptonsteel Grace Road on August 20-23 – had come to being abandoned. Several batters were struck on the body, and match referee Ian Ramage logged 37 instances of variable bounce across the four days.

Umpires Ben Debenham and Mike Burns said an abandonment had been discussed and that it was “a close call” while Glamorgan captain Kiran Carlson said he had been “close to walking his players off”. Coach Richard Dawson, who has since left for a job with England’s Test team, said he had never seen a worse pitch in his 30 years in professional cricket.

Leicestershire were initially docked 27 points in September for the pitch, which was rated ‘poor’. Eight of those points were later reinstated when the CDP admitted that it had failed to consider a new playing condition for 2026, which said any substandard pitch would automatically cost a team the points earned in the relevant match.

After those eight points were reinstated, the margin separating Leicestershire, in ninth, and eighth-placed Essex was cut to only 17 points, leaving open the possibility that a successful appeal could secure their Division One status for 2027. The appeal was held across two hearings last month, and Leicestershire belatedly instructed lawyers to represent them.

Leicestershire relied on three grounds of appeal, arguing that: the disciplinary tribunal came to a decision “to which no reasonable body could have come”; there was “significant procedural irregularity” due to an expedited timetable, designed to resolve the issue before the end of the season; and that fresh, significant evidence had become available.

Their appeal was dismissed on all three grounds, and the CDP was unusually critical of how Leicestershire had approached the matter. Whittam said that the club had taken “a conscious decision” not to instruct lawyers or seek an adjournment, and this represented “a serious error of judgement”.

The club said in its statement on Wednesday it was “deeply frustrating” that new evidence – including a witness statement from former PCB curator Tony Hemming – was not considered, but Whittam made clear that the evidence was “highly unlikely” to have made a difference to the outcome of the appeal.

The appeal heard differing views as to the impact of the club’s decision to allow a Bollywood film crew to use Grace Road on the surface. Head groundsman Callum Lewin said the event had overrun by five hours – which he described as “horrendous” – and that the producer had refused to allow the pitch to be covered, meaning it sat exposed to the elements for 13 hours.

The CDP supported the view of Andy Mackay, the ECB’s pitch and grounds advisor, and said: “Whilst… this was not the sole determinative factor in the problems which arose, it played a part and any competent person would have insisted on the need for a protective mat as a condition of hire.”

Essex said in a statement on Wednesday: “The Cricket Regulator has today confirmed that Leicestershire’s point deduction for a breach of ECB Pitch Regulations has been upheld. The outcome confirms that Essex County Cricket Club will participate in Division 1 of the Rothesay County Championship in 2027.

“Essex County Cricket Club would like to thank all members, supporters, and sponsors for their loyal support during this period of uncertainty.”

Matt Roller is a senior correspondent at Cricinfo. @mroller98

Leicestershire’s relegation to Division Two of the County Championship has, finally, been confirmed after their appeal against a…

[34
132648,1721,36623,49,50,132647,101,56,54,55
post-824630","post","type-post","status-publish","format-standard","has-post-thumbnail","category-cricket","tag-bulletin","tag-cricket","tag-daily","tag-headlines","tag-news","tag-package","tag-sports","tag-uk","tag-united-kingdom","tag-unitedkingdom
["GET
