FRESNO, Calif. (FOX26) — The California State University system is suing the U.S. Department of Education Office for Civil Rights.

The lawsuit is to protect San Jose State from retroactive punishment from the federal government.

The issue is a transgender volleyball player who played on the San Jose State women’s volleyball team during the 2022 through 2024 seasons.

The CSU chancellor sent out this statement saying the CSU and San Jose State followed all NCAA rules and federal law at the time and will not accept a proposed resolution agreement from the federal government in this case.
