FRESNO, Calif. (FOX26) — Timothy Seth Chavez was in Fresno Superior Court on Wednesday to face charges in the fatal crash that killed a mother and son on Monday.

Police say the crash on McKinley at Highway 41 was caused when Chavez ran a red light and T-boned the car driven by 41-year-old Martha Hernandez.

The force of the crash pushed her car into a nearby canal.

Her body was pulled from the canal a short while later, while her 9-year-old son, Adrian, was not located for several hours, about 3 miles downstream.

Police said Chavez left his disabled vehicle on foot. He later turned himself in at the Fresno County Jail on Tuesday.

The complaint alleges that Chavez committed vehicular manslaughter of the mother and son, with a deadly weapon, a vehicle, as well as leaving the scene of a deadly accident.

A felony, was committed by Timothy Seth Chavez, who did unlawfully, and knowingly, being a driver of a vehicle involved in an accident resulting in death to John Doe , fail, refuse, and neglect to give to the injured person and to a traffic and police officer at the scene of the accident his/her name and address, the registration number of his/her vehicle, and the name of the owner of said vehicle; to exhibit his/her operator’s license; to render reasonable assistance to the injured person; and perform the duties specified in Vehicle Code sections 20003 and 20004.
