The Northern California man who was hospitalized after being shot by federal immigration officers is in FBI custody, the lawyer representing his family said. Carlos Ivan Mendoza Hernandez was shot multiple times on April 7 along Interstate 5 in the Patterson area of Stanislaus County. The Department of Homeland Security said ICE agents fired defensive shots as Mendoza Hernandez tried to drive into them. His lawyer Patrick Kolasinski disputes that. He said Hernandez had to undergo several surgeries due to his injuries, which included a gunshot wound to the jaw.U.S. Immigration and Customs Enforcement (ICE) Acting Director Todd Lyons initially stated that Mendoza Hernandez was a Los Angeles-area gang member wanted for questioning in connection with a murder in El Salvador. However, Kolasinski said the country told him Mendoza Hernandez was acquitted of that murder in 2019.According to the attorney, the U.S. Department of Justice told Kolasinski that the agency is not holding Mendoza Hernandez as a suspect at this point.Last week, Kolasinski told members of the media that Hernandez was only being held because of his injuries that required medical attention. However, a 1:12 p.m. email from Kolasinski said he was informed that the FBI served a warrant and arrested Hernandez immediately after he was released from the hospital. The U.S. Attorney’s Office said it would issue a press release on Tuesday. A group of people gathered outside of the Sacramento County Jail on Monday evening demanding to know where Mendoza Hernandez is being held, despite the sheriff’s office confirming he is not in their jail. “They’re trying to silence his voice, but that is not going to happen. We are here to speak out for those that do not have a voice. We will find you.
