OAKLAND — A Hayward man has pleaded not guilty by reason of insanity to an alleged sexual assault of a local masseuse, after his lawyer argued in court that the incident fits in with his history of delusions.
Alexis Miller, 47, is charged with assault, attempted rape and attempted sodomy in a May 2025 attack at a massage parlor on the 900 block of C Street in Oakland. An employee testified at Miller’s Feb. 26 preliminary hearing that Miller entered the business, began “thrusting” his hips, then jumped on her when she told him, “we don’t do those things here.”
“I was suffocated, and I just wanted to breathe,” the woman testified, adding that she was hospitalized with “unbearable pain” afterwards. He allegedly began to grind on her and pulled her pants down, but others interceded, preventing the attack from going further, authorities said.
Miller entered his not guilty plea on March 12. His lawyer argued at the preliminary hearing that Miller lacked the mental state to have committed the crimes, citing the fact that Miller was declared incompetent to stand trial and hospitalized in Napa before being deemed mentally “restored” and returned to jail.
The defense attorney, Del Martyn Bahner, said Miller was diagnosed with a schizoaffective disorder that causes him to have paranoid delusions. Miller’s trial date has not yet been set.
Judge Kevin Wong, who presided over the hearing, said Miller’s alleged criminal behavior appeared different from his history of delusions, which generally involved perceiving electrical shocks, being “attacked” by AI, or statements referring to interactions with God, according to court records.
