FRESNO, Calif. (FOX26) — A U.S. ICE agent accused of attacking a 72-year-old Fresno homeowner and the man’s daughter can return to his home in Texas if he posts bail, a Fresno County judge ruled Tuesday.
32-year-old David Gonzalez III of McAllen, Texas, appeared in custody in Fresno County Superior Court.
The homeowner’s daughter said she came home around 3:15 a.m. and found Gonzalez asleep on the lawn on October 9th.
She got her father, who woke him, and then said the man appeared intoxicated and attacked him and knocked him to the ground.
The daughter went to help her father, and she too was knocked to the ground.
The homeowner retrieved a firearm and shot Gonzalez.
Investigators said it is unknown why Gonzalez was in the area, but it has been confirmed he was off-duty and alone at the time.
He was brought into the courtroom in a wheelchair because he was shot by the homeowner during the alleged attack.
The judge set Gonzalez’s bail at $37,000. He would need 10 percent, or $3,700, to pay a bail bondsman.
Police said the 72-year-old man who shot Gonzalez is not facing criminal charges and was legally in possession of the firearm used.
