OMAHA, Neb. (WOWT) – The saga of a Southwest Omaha eyesore now moves to the courts.
A California-based real estate company is suing the city of Omaha for what it terms is a breach of an agreement surrounding the old Westmont Inn hotel near 109th and M streets.
First Alert 6 has obtained a copy of the lawsuit filing.
It states that Newport Blue Impact of Newport Beach, California, was not granted due process when the Omaha City Council passed a resolution using KENO funds to demolish the long-time abandoned building.
The company is asking a district court judge to issue a temporary restraining order and a temporary injunction stopping any attempts to demolish the property by the city.
Newport Blue claims the company would suffer irreparable harm if the site is demolished, as the property’s value would drop from $8.8 million to around $800,000.
