FRESNO, Calif. (KFSN) — The City of Fresno is updating its Sidewalk Vending Ordinance following a recent court decision that found parts of local streetvending rules in conflict with state law.

The Fresno City Council last week approved an amendment intended to bring the city’s ordinance into compliance. A San Diego court ruling in favor of a street vendor led to the change, finding that some city rules on sidewalk vending broke state law.

In response, the Fresno City Council voted to modify the allowable hours of operation for mobile food vendors. Councilmember Miguel Arias said the city is still maintaining other requirements.

“We moved time limits city-wide, but we are still enforcing the business permit and public health permit; those are still being enforced and resulting in citations if you don’t have those permits,” Arias said.

Administrative fines for unpermitted sidewalk vending involving food prepared on a heated surface requiring fuel will continue as follows:

First violation: a written warning
Second violation: fine up to $100
Third violation: fine up to $200
Fourth violation: fine up to $500

Fines for other unpermitted sidewalk vending remain:

First violation: a written warning
Second violation: fine up to $25
Third violation: fine up to $50
Fourth violation: fine up to $100

The city’s changes are intended to ensure Fresno’s regulations align with state law while still enforcing basic health and business permit requirements.
